AMENDMENT NO. 4 TO AGREEMENT
STANDARD AGREEMENT FOR PROFESSIONAL SERVICES

WHEREAS, The City of Fort Worth and Callahan & Freeman Architects (Consultant)
made and entered into City Secretary Contract No. 54172 (The Contract) which was
administratively authorized the 20th day of July, 2020, for Fort Worth Police
Department’s South Patrol Division; and Amendment No. 1 was approved by M&C 20-
0549 in the amount of $262,600.00 for completion of Construction Drawings and
Construction Phase Service; and Amendment No. 2 was administratively approved in
the amount of $78,290.00 for additional services for an Oncor utility easement, and
construction administration services for extended construction schedule, value
engineering service, and structural redesign coordination of this project; and
Amendment No. 3 was administratively approved in the amount of $1,400.00 for
additional services to produce a second Oncor utility easement.
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional services for extended construction schedule.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:

Article I – Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional professional services associated with the design and
construction administration of this project. The total cost of these additional
services is $37,500.00 plus $0.00 in reimbursable expenses. The scope of
services is described more fully in Attachment “F”.
2.
Article II – Compensation, first paragraph, is amended as follows:
“Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment “F”. Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment “F”. However, the total fee paid by the City shall not
exceed a total of $464,790.00 unless the City and the Consultant mutually agree
upon a fee amount for additional services and amend this Agreement
accordingly.”

Additional A-E Fee Request
Dear Alfonso:
Callahan & Freeman Architects respectfully requests additional fee on the Fort Worth Police Department
South Patrol Division project. This request relates to additional construction administration effort on our
part due to the extended time the Contractor is taking to complete the construction.
Amendment Number 2 to our agreement added fee to extend the completion date to December 2023. It
now appears that construction will not be complete until April of 2024 approximately four months
more.
We are averaging 15 hours a week on the project in an effort to get the Contractor to complete his
work. This times 4 months = 240
punch list was developed before the project was ready which took us an additional 10 hours of effort.
Therefore our total request is for an additional 250 hours of work.
At our current billing rate of $150/hr. this totals $37,500.
Therefore, assuming the Contractor will be complete by April, we request an additional fee in the
amount of $37,500.
As you know, it has been an effort for us and the City to get this project completed in a satisfactory way.
We look forward to the day the Police Department can move in!

Associated with the South Patrol Division
RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 4 to the Professional Services Agreement with Callahan &
Freeman Architects (CSC No. 54172), in the amount of $37,500.00 for a revised contract value of $464,790.00, including reimbursable
expenses, for design and construction administration services associated with the South Patrol Division (City Project No. 101661).
DISCUSSION:
On October 16, 2018, City Council authorized Mayor & City Council Communication (M&C) L-16155, for acquisition of approximately 15.3 acres
of land, at 8800 McCart Avenue, in the amount of $2,000,255.00 and to pay estimated closing costs up to $14,000.00 for the construction of a new
police station in southwest Fort Worth (City Project No. 101661).
On August 6, 2019, City Council authorized award of a design-build contract (M&C 19-0025, CSC No. 52546) with Speed Fab-Crete Corporation
for the Fort Worth Police Department's new South Patrol Division Facility. The programing and design of this facility was progressing, through their
architect, Callahan & Freeman Architects, however contractual issues with Speed Fab-Crete Corporation required that the contract be terminated.
Based on the prior selection and work completed to date, the City entered into a professional services agreement (CSC No. 54172) with
Callahan & Freeman Architects to continue the design work, in the amount of $85,000.00. In August 2020, Staff recommended that the City
Council authorize Amendment No. 1 in the amount of $262,600.00 for the balance of the design and construction administration of this project
(M&C 20-0549). Amendment Nos. 2($78,290.00) and 3($1,400.00) were administratively executed for exhibit coordination for Oncor easements
and recommended value engineering of the structure. Staff now recommend that the City Council authorize Amendment No. 4 to the professional
services agreement in the amount of $37,500.00 for a revised amount of $464,790.00 including reimbursable expenses for design and
construction administration services.

FUNDING: Funding is budgeted in the CCPD Capital Projects Fund for the Police Department for the purpose of funding the South Police Station
project, as appropriated.
Office of Business Equity: A waiver of the goal for Business Equity subcontracting requirements was requested, and approved by the DVIN, in
accordance with the applicable Ordinance, because the purchase of goods or services is from sources where subcontracting or supplier
opportunities are negligible.
This project is located in COUNCIL DISTRICT 6.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the CCPD Capital Projects
Fund for the South Police Station project to support the approval of the above recommendations and the execution of the amendment to the
agreement. Prior to expenditure being incurred, the Property Management and Police Departments have the responsibility to validate the
availability of funds.
