Home My WebLink AboutContract 60058-R1A1CSC No. 60058-R1A1 FIRST RENEWAL AND FIRST AMENDMENT TO FORT WORTH CITY SECRETARY CONTRACT NO. 60058 This First Renewal and First Amendment to Fort Worth City Secretary Contract No. 60058 ("Agreement") is made between Agilent Technologies Inc. ("Seller") and City of Fort Worth ("Buyer"), a Texas home -rule municipal corporation through its duly authorized Assistant City Manager acting by and through its duly -authorized representative, each individually referred as a "Party" and collectively as the "Parties". WHEREAS, Buyer and Seller entered into an Agreement identified as Fort Worth City Secretary Contract No. 60058 beginning September 6, 2023 ("Agreement"); WHEREAS, it is the collective desire of both Buyer and Seller to amend the Agreement to replace exhibit F due to updated pricing; and WHEREAS, it is the collective desire of both Buyer and Seller to renew the Agreement, as amended, for an additional year term. NOW THEREFORE Buyer and Seller do hereby agree to the following: I. AMENDMENT TO AGREEMENT The following terms are hereby amended to either replace any conflicting terms in the Agreement or shall be added to the terms and shall be binding and enforceable as if they were originally included therein and the amended agreement shall be referred to as the Agreement in all future documents: Exhibit F, which is attached hereto and incorporated herein, is made a part of this Agreement for all purposes, replacing the previous Exhibit F. II. RENEWAL OF AGREEMENT The Agreement, as amended herein, is hereby renewed and extended for a renewal term commencing on September 6, 2024 and ending on September 5, 2025, unless terminated earlier in accordance with the Agreement. ALL OTHER TERMS SHALL REMAIN THE SAME All other provisions of Agreement which are not expressly amended herein shall remain in full force and effect. IV. ELECTRONIC SIGNATURE This Amendment and Renewal may be executed in multiple counterparts, each of which shall be an original and all of which shall constitute one and the same instrument. A facsimile copy or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall have the same effect as anoriginal.
