HomeMy WebLinkAboutContract 61773CITY SECRETARY CONTRACT No.: 61773 MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF FORT WORTH AND THE FORT WORTH PROFESSIONAL FIREFIGHTERS ASSOCIATION This is a Memorandum of Understanding (MOU) between the City of Fort Worth, hereinafter called "the City, " and the Fort Worth Professional Firefighters Association, IAFF Local 440, hereinafter called "the Association." I. PURPOSE & SCOPE The purpose of this MOU is to state the parties' agreement with regard to Article 5, Section I and 2, and Article 33, Section 3 of the Collective Bargaining Agreement between the parties to authorize the participation to the City of Fort Worth Fire Fighters in the newly - instituted PSPS Project Completion Incentive Program. IL BACKGROUND The City has established the Public Safety Payroll Solution ("PSPS") project to improve the payroll software for Fort Worth's police officers and firefighters in order to reduce payroll processing time, automate the payroll system for efficiency, and process payroll without errors. Many City employees from many City departments have been involved in this multi -year project, as part of their assigned job duties. The Financial Management Services (FMS), Information Technology (IT) Solutions, Human Resources (HR), Fire, and Police Departments, with approval from the HR Director, have developed the PSPS Project Completion Incentive Program ("the Program") that is attached hereto as Exhibit A. The stated purposes of the Program are to incentivize the assigned team members for their expected contributions and dedication throughout predefined phases of the project, leading up to its successful completion. These guidelines aim to motivate individuals, promote retention, establish continuity, foster teamwork, and maintain high standards of performance throughout the project lifecycle to meet certain identified target dates and the proposed completion date. III. AGREEMENT OF THE PARTIES Because there is some question whether the Collective Bargaining Agreement allows the City to add a benefit to fire fighters that was not in effect on the effective date of the current Collective Bargaining Agreement, this MOU is intended to interpret and clarify the Collective Bargaining Agreement to allow for the Program (Exhibit A) to apply to eligible fire fighters. Eligibility for the benefits offered by the Program will be determined by the terms of the Program, as set out in Exhibit A. The City and the Association agree that any payment received by any fire fighter under the Program will not be part of the fire fighter's base pay, as that term is used in Texas Local Government Code Section 143.041(b). The parties also agree that any payment to a fire fighter under the Program will be based on the fire fighter's step pay rate at his or her civil service rank, and not based on any acting pay rate. WORTH, TX In order to ensure that the incentive provided in the Program is available to eligible fire fighters, the City and the Association, through this MOU, agree that fire fighters, as that term is used in the Collective Bargaining Agreement, may participate in the Program, under the terms and conditions set out in Exhibit A. The process outlined in the Program (Exhibit A) must be followed to be eligible for this incentive. The Human Resources Department may modify or cancel the Program at any time, with or without notice. Failure to follow the guidelines in the Program will result in non-payment and is not subject to grievance or appeal. IV. EFFECTIVE DATE AND SIGNATURE To the extent allowed under applicable law and the Collective Bargaining Agreement, the parties agree that the change to City policy referenced in this MOU, as allowed under Article 5, Sections 1 and 2, and Article 33, Section 3 of the Collective Bargaining Agreement, as it affects fire fighters, will be effective as of the date this MOU is signed by the last authorized representative of the parties to sign. The parties further agree that this MOU will continue to be in effect until the termination or modification of the Program by the City for any reason. If the Program is modified, this MOU will remain in effect, to the extent applicable after such modification.
