HomeMy WebLinkAboutContract 48142-R2CSC No. 48142-R2 SECOND RENEWAL FOR CITY SECRETARY CONTRACT NO. 48142 FORT WORTH MEACHAM INTERNATIONAL AIRPORT HANGAR AND GROUND LEASE AGREEMENT LEASE SITE 34S This SECOND RENEWAL TO CITY SECRETARY CONTRACT NO. 48142 ("RENEWAL") is made and entered into by and between the CITY OF FORT WORTH ("Lessor"), a home rule municipal corporation organized under the laws of the State of Texas and 300 SERIES AVIATION, LLC ("Lessee"), an Texas Limited Liability Company, acting by and through PAUL NUS its duly authorized PRESIDENT, each individually referred to as a "party" and collectively referred to as the "parties." RECITALS The following statements are true and correct and form the basis of this Agreement. WHEREAS, On or about August 31, 2016, Lessor and Lessee entered into City Secretary Contract ("CSC") No. 48142, a Hangar and Ground Lease for the lease and use of real property known as Lease Site 34S, and any improvements and facilities thereon ("Leased Premises") at Fort Worth Meacham International Airport ("Airport') hereinafter referred to as the Lease; and WHEREAS, the Lease provides for a three (3) year initial term with options for up to two, five-year renewal terms; and WHEREAS, on September 1, 2019, the Lessee exercised the first renewal through CSC No. 48142-R1, which is scheduled to expire on August 31, 2024; and WHEREAS, the Lessor and Lessee wish to exercise the second and final renewal term provided under the Lease, commencing on September 1, 2024 and ending on August 31, 2029. NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, Lessor and Lessee hereby agree as follows: 1. The Lease is hereby renewed and extended for the second and final permitted renewal term of five (5) years, commencing on September 1, 2024 and expiring on August 31, 2029. 2. In accordance with the established Schedule of Rates and Charges, this lease site of 7,999 square feet of Ground Space at the current Lease rate of $0.47 per square foot will generate revenue of $3,759.53 per year or $313.29 monthly and 2,100 square feet of Hangar Space at the current Fort Worth Meacham International Airport 300 Series Aviation, LLC Renewal Option No. 2 to CSC No. 48142 Pagel of 4 OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX Lease fate of $2,609.80 per year or $217.48 per month. 3. All other terms and conditions of the Lease shall remain in full force and effect. The statements set forth in the recitals above are true and correct and form the basis upon which Lessor and Lessee have entered into this Agreement. The Lease is a public document on file in Lessor's City Secretary's Office and is incorporated herein by reference for all purposes. All other provisions and conditions of the Lease that are not expressly amended herein or directly in conflict with the provisions and conditions of this Amendment shall remain in full force and effect.
