On February 21, the City Council opened the benefit hearing on the Assessment
Paving of Feliks Gwozdz Place (formerly Myrtle Street) from Hemphill to
Lipscomb (M&C G-7932) . Mr. Joe Cardova, representing the Panther Boys Club,
and Norma Raye Cole, owner of an apartment building on the street spoke
requesting reduction or waiver of the assessments against their properties,
and the Council continued the benefit hearing for one week to obtain
additional information.
Myrtle Street from Lipscomb to May was included in the 1985-88 Capital
Improvement Program at the request of the Allied Communities of Tarrant
(ACT) . The name of the street was changed on November 15, 1988 (M&C G-7819) .
A contract for the construction of the portion from Lipscomb to Hemphill was
awarded on January 17, 1989 (M&C C-11413) . Feliks Gwozdz Place from Hemphill
to May Street is being designed for construction under a separate contract.
The only property owners on the project (and the amounts of their proposed
assessments) are Mrs. Cole ($2,750) . Panther Boys Club ($10,350), and Family
;services, Inc. ($11,593) . The Director of Real Property Management advised
the staff on the amount of enhancement to property values that would, in this
opinion, result from the proposed construction, and the individual
assessments were adjusted accordingly.
There are several options available for the Council's consideration:
1. The assessments can be levied as proposed, in accordance with
the adopted Assessment Paving Policy. Under this option the
attached payment schedule would be available to the property
owners.
2. The benefit hearing can be continued for several weeks and an
independent appraiser retained for a second opinion on the
amount of enhancement to property values and, consequently,
the amount of the assessments.
3. The entire project can be cancelled and the construction
contract rescinded.
Staff is available to provide additional information if Council desires.
