HomeMy WebLinkAboutOrdinance 16653-10-2005Ordinance Na. ~~~~..~'f0"~-~~ AN ORDINANCE INCRE=ASING ESTEMATED RECEIPTS AND APPROPRIATIONS 1N THE SPECIAL TRUST FUND, MUNICIPAL COURT TECHNOLOGY FUND IN THE AMOUNT OF $1,086,262 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING TECHNOLOGICAL ENHANCEMENTS FOR THE MUNICPAL COURT, MAKING THIS ORDINANCE= CUMULATIVE OF PRIOR ORDINANCES IN CONI=LiCT HERE=WITH; AND PROVIDING AN EFFECTIVE DATE. BE lT ORDAINED E3Y THE CITY COUNCIL OF THE: CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund, Municipal Court Technology Fund in the amount of $1,086,262 from available funds far the purpose of funding technological enhancements for the Municipal Court. s1=cTl©N z. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Trust Fund Municipal Court Technology Fund for the Integrated Case and Electronic Document Management System RECOMIUIENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specia{ Trust Fund Municipal Coin Technology Fund in the amount of $1,D86,262.DD for the lntegrated Case and Electronic Document Management System. DISCUSSION: On August 24, 1999, (M&C G-12638) the City Council approved an ordinance creating the Municipal Court Technology Fund in the Specia! Trust Fund. Funding is derived from a technology fee assessed on defendants convicted of a misdemeanor in Municipal Court. The fund, as designated, may be used to fund the purchase of technology enhancements for the Municipal Court. On .lanuary 28, 2003, (M&C C-19450) the City Council authorized the City Manager to negotiate and execute an agreement with Maximus, Inc., and appropriated $1,D8D,DDD.DD for Phase I for the purchase of a case management and electronic document management system for the Municipal Court. The total base implementation cost far the information system was estimated at $2.6 million. Because financing of the project is derived from annual technology fees, additional supplemental appropriations were anticipated. Upon completion of negotiations a contract in the amount of $1,848,549.00 was awarded to MAXIMUS to begin development of Phase ! of the case management and electronic management system. This M&C appropriates revenues collected during the 2004-05 1=fiscal Year. The $1,D86,262.00 appropriation will be used to fund the second phase of this project. Additional appropriations will be required to fund ongoing technology costs associated with the new system. City Council action will be requested as additional revenue is collected and required for the ongoing costs. FISCAL 1NFORIVIATIONICERTIFICATION: The Finance Director certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Special Trust Fund. The Municipal Court will be responsible for collecting and depositing technology fees.
