HomeMy WebLinkAboutContract 60236-A1CSC No. 60236-A1 AMENDMENT No . 1 TO CITY SECRETARY CONTRACT No. 60236 WHEREAS, the City of Fort Worth (CITY) and Aguirre & Fields, L.P., (ENGINEER) made and entered into City Secretary Contract No. 60236, (the CONTRACT) which was administratively authorized on the loth day of October, 2023 in the amount of $ 98,440.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Heritage Trace Parkway, CPN 103300; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $2,901,192.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $2,999,632.00. 99 All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. OBJECTIVE The scope of the contract is to design an extension to Heritage Trace Parkway. The project limits are from Business 287 (Saginaw Boulevard) to Wagley Robertson Road in the City of Fort Worth. The design project is for a new east -west roadway across a greenfield connecting the roadways at the limits. The project contemplates the design of a 4-lane divided arterial with intersection improvements, street lights, shared paths, and a railroad crossing near Saginaw Boulevard, with the ability to expand to 6 lanes in the future. While the project is currently funded for design with local funds, federal or state funds will be pursued for construction. If obtained, the non -local funds will require federal design standards, permits, studies, clearances and public meetings. Except for using federal design standards, all other federal requirements are not part of the scope of this contract. The Engineer and the City agreed to expedite administratively a contract for to advance the project activities and this amendment supplements that contract to account for all activities contemplated for this project. The purpose of this amendment is to augment the scope of the original administratively approved contract with the remainder of the required services not included in it and as described in this attachment. ENGINEER will manage the work outlined in this scope to ensure efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER will manage change, communicate effectively, coordinate internally and externally as needed, and proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. 1.1. Managing the Team: (The following items in this paragraph are a continuation of the original agreement and are extended by the terms of this amendment) • Lead, manage and direct design team activities • Ensure Quality Control / Quality Assurance (QC/QA) is practiced in performance of the work. Refer to Task 10 for further details. • Communicate internally among team members • Task and allocate team resources 1.2. Communications and Reporting: • Attend a pre -design project kickoff/charter meeting with CITY staff to confirm and clarify scope for complete project, understand CITY objectives, and ensure economical and functional designs that meet CITY requirements. (This will include full CITY staff as original kickoff was a `jump start" contract and therefore comprehensive.) • Attend one (1) constructability review meeting with CITY representatives, including Traffic Management, at the 60% submittal milestone • Conduct and document monthly project update meetings with CITY Project Manager • Conduct review meetings with the CITY at the end of each design phase • Conduct and document biweekly design team meetings • Conduct QC/QA reviews and document those activities. Refer to Task 10 for further details • Prepare invoices, in accordance with Attachment B to this Standard Agreement and submit monthly in the format requested by the CITY. Multi -month billing is not allowed. Months in which no work is being invoiced shall require submission of a $0.00 invoice. Prepare and submit monthly Project Status Reports in the format provided by the Transportation and Public Works Department. Prepare and submit baseline Project Schedule initially, and Project Schedule updates with a schedule narrative monthly, as required in Attachment D to this Standard Agreement in compliance with the City's Specification 00 31 15 entitled Engineer Project Schedule. This PROJECT requires a Tier 3 schedule as defined in the City's Specification 00 31 15 entitled Engineer Project Schedule. CONCEPTUAL DESIGN (30 PERCENT). The Conceptual Design shall be submitted to CITY per the approved Project Schedule. The purpose of the conceptual design is for the ENGINEER to identify, develop, communicate through the defined deliverables, and recommend the design concept that successfully addresses the design problem, and to obtain the CITY's endorsement of this concept. ENGINEER will develop the conceptual design of the infrastructure as follows. 2.1. Data Collection • Traffic Count Data: Microsoft Excel spreadsheet of Raw 24-hour and Turning Movement Count data gathered at 15-minute intervals at a minimum on all raw data collected. Provide Daily Summaries by Approach and Peak -Period Summaries by Approach. Spreadsheet shall be uploaded to the CITY's document management system (BIM360) folder `TPW Traffic Count Data'. 2.2. Subsurface Utility Engineering Provide Subsurface Utility Engineering (SUE) per Task 8. 2.3. Utility Clearance • Potential CITY relocations will be identified and coordinated, but design of any relocations are not included at this time. • In the case of a public (city owned) utility conflict, the ENGINEER will identify CITY facilities to avoid or minimize conflicts with existing utilities, and where known and possible consider potential future utilities in designs. • In the case of a private Utility Conflict, the ENGINEER will provide a PDF set of plans with the utility conflicts highlighted and a Utility Conflicts Table of those conflicts to be included in a Utility Clearance Letter for coordination. The ENGINEER may need to coordinate directly with the private utility provider if that provider needs to undertake design to adjust their utility's location. • The ENGINEER shall upload a PDF file of the approved preliminary plan set to the designated project folder in the City's document management system (BIM 360) for forwarding to all utility companies which have facilities within the limits of the project. The PDF file should be created directly from the CAD files. • Full utility coordination efforts to include: • Preparation of a utility conflict matrix at each milestone submittal • Progress coordination meetings (assumed 4 group meetings and 20 individual meetings) • Review alternatives to relocations • Prepare status reports and utility schedules City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 4 of 28 FORT WORTH • Review utility adjustment plans and assist with permits, agreements/reimbursement (12 plan reviews and 1 reimbursement agreement) 2.4. Engineering Design Report To ensure adherence to project scope, that design approach is in line with project objectives, and to obtain concurrence on development of the conceptual layout, ENGINEER shall prepare and submit a design report in the format provided by the CITY prior to developing conceptual plans. The CITY shall review and provide feedback on the report prior to ENGINEER starting the conceptual design. Drainage Report shall consist of the following • Conceptual iSWM Checklist in accordance with the current CITY iSWM Criteria Manual for Site Development and Construction • Hydrologic Analysis for four (4) crossings • Delineate drainge boundaries • Develop hydrologic pararmeters for Post -development and Pre - development Conditions • Calculate Hydrology • Hydraulic Anslysis for four (4) crossings • Develop HEC-RAS models for Post -development and Pre -development Conditions • Scour analysis for four (4) bridges • Riprap design • Develop downstream assessment • Develop HEC-HMS models for downstream assessment • Prepare technical memo 2.5 The Conceptual Design Package shall include the following: • Preliminary cover and index of sheets including project limits, area location map and beginning and end station limits. • Quantity Summary page and each design sheet shall include a quantity take off table. • Traffic Engineering study corridor analysis study or alignment/feasibility study to support the recommended design alternative. Intersection Control Evaluation Report (ICE) may be required if applicable. City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 5 of 28 FORT WORTH • Develop growth rate based on historical traffic volumes and NCTCOG's Travel Demand Model. • Develop future year traffic volumes for 20-years. • Complete a Highway Capacity Software (HCS) analysis to determine approximately when the roadway will need to be widened from three (3) to six (6) lanes. • Traffic Signal Warrant Analysis at four locations including the intersections with: Wagley Robertson Rd, US-287 (grade separation) Old Decatur Road, and the neighborhood entrance at Magnolia Blossom Trail. The analysis will follow City guidance or procedures outlined within the Texas Manual on Traffic Control Devices • Complete Warrant 1, Eight -Hour Vehicular Volume • Complete Warrant 2, Four -Hour Vehicular Volume • Complete Warrant 7, Crash Experience • Conceptual Design Report (Arterials) in the format provided by the CITY • SUE Plan sheets sealed by a licensed professional engineer registered in the State of Texas. • PDF set of plans with the utility conflicts highlighted and a Utility Conflicts Table • Traffic Count Data: Microsoft Excel spreadsheet of Raw 24-hour and Turning Movement Count data gathered at 15-minute intervals at a minimum on all raw data collected. Typical sections shall include existing and proposed ROW, existing and proposed lane widths and direction arrows, existing and proposed curbs, sidewalks, and retaining walls. • Conceptual plan and profile sheets showing existing and proposed horizontal roadway alignments, existing and proposed ROW, existing and proposed sidewalks and driveways, proposed lane dimensions and lane arrows, existing drainage structures, city owned and franchise utilities, and existing roadway vertical alignments (profiles). • Documentation of key design decisions. • Estimates of probable construction cost. ASSUMPTIONS • All storm water calculations and design shall conform to the CITY current iSWM Criteria Manual for Site Development and Construction. PRELIMINARY DESIGN (60 PERCENT). Preliminary plans and specifications shall be submitted to CITY per the approved Project Schedule. ENGINEER will develop the preliminary design of the infrastructure as follows. 3.1. The Preliminary Design Drawings and Specifications shall include the following: • Preliminary cover and index of sheets including project limits, area location map and beginning and end station limits. • SUE Plan sheets sealed by a licensed professional engineer registered in the State of Texas. • Utility Conflict Matrix • Quantity Summary page and each design sheet shall include a quantity take off table. • Preliminary iSWM Checklist in accordance with the current CITY iSWM Criteria Manual for Site Development and Construction. • Traffic Control Plan including all construction signage and pavement markings which will be in accordance with the latest edition of the Texas Manual on Uniform Traffic Control Devices. • A Project Control Sheet, showing all Control Points, used or set while gathering data. Generally on a scale of not less than 1:400. The following information shall be indicated for each Control Point: Identified (existing City Monument #8901, PK Nail, 5/8" Iron Rod); X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on City Datum only; descriptive location (i.e. set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). • Updated existing and proposed typical section sheets. • Updated roadway plan and profile sheets displaying station and coordinate data for all horizontal alignment P.C.'s, P.T.'s, P.I.'s; station and elevation data of all vertical profile P.C.'s, P.T.'s, P.I.'s, low points, and high points; lengths of vertical curves, grades, K values, e, and vertical clearances where required. • No less than two bench marks per plan/profile sheet. • Bearings given on all proposed centerlines, or baselines. • Station equations relating utilities to paving, when appropriate. • Overall project easement layout sheet(s). • Intersection layout sheets including ROW lines, horizontal alignments, utilities, curbs, sidewalks, driveways, lane dimensions and arrows, and existing and proposed contours (0.25' intervals) City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 8 of 28 FORT WORTH • Preliminary roadway details to include curbs, curb expansion joints, driveways, sidewalks, pavement, streetlights, traffic signals and all applicable utility details. • Preliminary signing, pavement marking, illumination and signal layouts. ENGINEER will delineate the watershed based on contour data and field verification and document existing street, right-of-way and storm drain capacities for the subject site. A drainage area map will be drawn at maximum 1" = 200' scale from available 2-foot contour data with the contours labeled. Data source and year will be provided by the CITY. Calculations regarding street and right-of- way capacities and design discharges (5-year and 100-year frequencies) at selected critical locations will be provided. Other frequencies as required by iSWM criteria may be appropriate for outfalls and sensitive locations. Capacities of existing storm drain will be calculated and shown. All calculations shall conform to CITY criteria delineated in the CITY's current iSWM Criteria Manual for Site Development and Construction. All locations in the project area where 100-year runoff exceeds available storm drain and right-of-way capacities shall be clearly identified. The ENGINEER's responsibility includes recommendations for improvements of the existing system as deemed reasonable and consistent with CITY standards. • Storm drain layout sheets showing location and size of all inlets, manholes, junction boxes, culverts and piping to include storm drain profiles showing existing and proposed flow lines, flows, lengths and slopes of pipe, top of ground profile over pipe and connections to existing or proposed storm sewer systems. • Documentation of key design decisions. • Estimates of probable construction cost. 3.2. Geotechnical Investigation/Pavement Design Soil investigations, including field and laboratory tests, borings, related engineering analysis and recommendations for determining soil conditions will be made. In addition to the above investigations, borings and appropriate field and laboratory analysis will be made at reasonable intervals along the project alignment for the Contractor's use in determining soil conditions for preparing bids and a Trench Safety Plan. • The ENGINEER shall prepare a detailed geotechnical engineering study and pavement design in conformance with the City of Fort Worth Pavement Design Standards Manual, 2005. The study shall include recommendations regarding utility trenching and identify existing groundwater elevation at each boring. • This will consist of: • Three (3) 85 feet borings for bridge overpass railroad (assuming bridge is less than 600 feet) • Two (2) 50 feet borings for the new embankment/retaining walls bridge overpass railroad (less than 30 feet in height) City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 9 of 28 FORT WORTH • Four (4) 85 feet borings for the bridge creek crossing (two parallel bridges — with less than 300 feet) • Three (3) 20 feet borings for pavement • Geotechnical Assumptions: • No railroad permit, flagging or insurance is required • No tree or brush clearance required • Clear access to private properties provided. 3.3. Constructability Review • Prior to the 60 percent review meeting with the CITY, the ENGINEER shall schedule and attend a project site visit with the CITY Project Manager and Construction personnel to walk the project. The ENGINEER shall summarize the CITY's comments from the field visit and submit this information to the CITY in writing. 3.4. Public Meeting After the preliminary plans have been reviewed and approved by the CITY, the ENGINEER shall prepare project exhibits, assist the project manager in preparing a presentation of the most appropriate format (most usually in Power Point), and attend one (1) public meeting to help explain the proposed project to residents. The CITY shall select a suitable location, time and date. The Engineer needs to coordinate with the City's project manager to format the mailing list of all affected property owners. 3.5. Utility Clearance The ENGINEER will consult with the CITY's Transportation and Public Works Department, Water Department, and other CITY departments, public utilities, private utilities, private utilities and government agencies to determine the approximate location of above and underground utilities, and other facilities (current and future) that have an impact or influence on the project. ENGINEER will design CITY facilities to avoid or minimize conflicts with existing utilities, and where known and possible consider potential future utilities in designs • Where conflicts cannot be avoided, coordination of Utility Conflicts will be identified at the Conceptual phase and begin at the Preliminary Design phase. In the case of a private Utility Conflict, the ENGINEER shall upload a set of plans in PDF format with the utility conflicts highlighted and a Utility Conflicts Table of those conflicts in the City's document management system (BIM 360). The PDF file should be created directly from the CAD files. At each design milestone, the City PM will issue a Utility Clearance Letter to be accompanied by said plans and table to all utility companies which have facilities within the limits of the project for coordination The ENGINEER may need to coordinate directly with the private utility provider if that provider needs to undertake design to adjust their utility's location. City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 10 of 28 FORT WORTH • ENGINEER to obtain utility As -built plans and/or do field visits to confirm relocation is complete and that the utility has been relocated in accordance with the plans and the project needs, report any discrepancies found, and provide documentation to support findings. • ENGINEER to upload all utility As -built plans in the City's document management system (BIM 360) ASSUMPTIONS • Three (3) sets of 11"x17" size plans will be delivered for the 60% design for review coordination. • One (1) set of the Project Manual (Contract and Specifications) will be delivered for the 60% design. • The following shall be uploaded to the designated project folder in the City's document management system (BIM 360): ■ Single PDF file created from design CAD drawings. ■ The Project Manual (Contract and Specifications) ■ All other submitted documents and checklists • The CITY's front end and technical specifications will be used. The ENGINEER shall supplement the technical specifications if needed. • One (1) Public Meeting is assumed. • ENGINEER shall not proceed with Final Design activities without written approval by the CITY of the Preliminary Design plans. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT). Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as follows: • Final draft construction plans (90%) and Project Manual shall be submitted to CITY per the approved Project Schedule. • The ENGINEER will provide a PDF set of plans with the utility conflicts highlighted and a Utility Conflicts Table of those conflicts to be included in the Utility Clearance Letter to be issued by the City PM. • Following a 90% construction plan review meeting with the CITY, the ENGINEER shall submit Final Plans (100%) to the CITY per the approved Project Schedule. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in State of Texas. • Drainage Study checklist in accordance with the current iSWM Criteria Manual for Site Development and Construction. • A Quantity Summary page will be included in both the 90% and 100% design plans. Each design sheet of the plans shall also include a quantity take off table. • The ENGINEER shall submit an estimate of probable construction cost with both the 90% and 100% design packages. This estimate shall use standard CITY or TxDOT bid items, as applicable. ASSUMPTIONS • Three (3) sets of 11"x17" size drawings and one (1) set of the Project Manual will be delivered for the 90% Design package. • A PDF and DWF file for the 90% Design will be created from design CAD drawings and will be uploaded to the project folder in the City's document management system (BIM 360). • One (1) sets of 11 "xl7" size drawings and one (1) set of specifications will be delivered for the 100% Design package. • A PDF and DWF file for the 100% Design will be created from design CAD drawings and will be uploaded to the project folder in City's document management system (BIM 360). DELIVERABLES A. 90% construction plans and specifications including QC/QA documentation. B. Utility relocation package. C. Final Drainage Checklist D. 100% construction plans and Project Manual including QC/QA documentation. OPCC's to be accompanied by unit price sources, assumptions, and any other information that documents the accuracy of the OPCC at the time when is issued. F. Digital cover sheet for the signatures of authorized CITY officials. TASK 5. BID PHASE SERVICES. NOT INCLUDED OMITTED TASK 6. CONSTRUCTION PHASE SERVICES. ENGINEER will support and perform activities related to ROW and land as outlined below, per scoping direction and guidance from the CITY's Project Manager. 7.1. Right -of -Way Research The ENGINEER shall determine rights -of -way and easement needs for construction of the project. Required temporary and permanent easements will be identified based on available information and recommendations will be made for approval by the CITY. 7.2. Right-of-Way/Easement Preparation and Submittal. The ENGINEER shall prepare documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements. The ENGINEER shall prepare a ROW and Easement parcel reference map showing and designating all land interest for project. The map shall be revised as necessary throughout the land acquisition process. The documentation shall be provided in conformance with the checklists and templates available on the City's document management system (BIM 360) Project Resources folder. 7.3. Temporary Right of Entry Preparation and Submittal Prior to construction, the ENGINEER should coordinate with the City project manager to identify all needed Temporary Right of Entries from landowners. It is assumed that letters will only be required for land owners adjacent to construction or who are directly affected by the project and no easement is required to enter their property. The documentation shall be provided in conformance with the checklists and templates available on the City's document management system (BIM 360) Project Resources folder. 7.4 Property Acquisition Services The scope of work will include providing project management, appraisal, property acquisition, and title and closing services for fee simple acquisition of properties for the Heritage Trace Parkway project located in Tarrant County, Texas ASSUMPTIONS Right -of -Way research includes review of property/right-of-way records based on current internet based Tarrant Appraisal District (TAD) information available at the start of the project and available on -ground property information (i.e. iron rods, fences, stakes, etc.). It does not include effort for chain of title research, parent track research, additional research for easements not included in the TAD records, right-of-way takings, easement vacations and abandonments, right-of-way vacations, and street closures. This estimate assumes that no Federal funds are being utilized. Should Federal funds be used, Review Appraisals will be required for each Appraisal conducted, and those have not been included in this estimate. Relocation services are not included. Two (2) Railroad crossing agreements D. ROW and Easement parcel map E. Property acquisition for up to 11 parcels TASK 8. SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES. ENGINEER will provide survey support as follows. 8.1. Design Survey • As a supplement to the original survey, ENGINEER will provide HEC cross - sections at four (4) locations. Cross -Sections will be taken at the face of any structures, and 50 feet, 100 feet and 200 feet upstream and downstream, and will extend a minimum of 100 feet out from the top of bank. ENGINEER will perform field surveys to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, elevations of all sanitary and adjacent storm sewers, rim/invert elevations, location of buried utilities, structures, trees (measure caliper, identify overall canopy, and have qualified arborist identify species of trees), and other features relevant to the final plan sheets. Existing drainage at intersections will be verified by field surveys. Spot elevations will be shown on intersection layouts with cross slope to fit intersecting grade lines. • The minimum survey information to be provided on the plans shall include the following: — A Project Control Sheet, showing ALL Control Points, used or set while gathering data. Generally on a scale of not less than 1:400: — The following information about each Control Point; a. Identified (Existing. CITY Monument #8901, PK Nail, 5/8" Iron Rod) b. X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on CITY Datum only. c. Descriptive Location (Ex. Set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). Temporary Right of Entry Preparation and Submittal • Omitted 8.3. Subsurface Utility Engineering Provide Subsurface Utility Engineering (SUE) to Quality Level D, C, 8, and A, as described below. The SUE shall be performed in accordance with Cl/ASCE 38-02. Qualitv Level D • Conduct appropriate investigations (e.g., owner records, County/CITY records, personal interviews, visual inspections, etc.), to help identify utility owners that may have facilities within the project limits or that may be affected by the project. • Collect applicable records (e.g., utility owner base maps, "as built" or record drawings, permit records, field notes, geographic information system data, oral histories, etc.) on the existence and approximate location of existing involved utilities. • Review records for: evidence or indication of additional available records; duplicate or conflicting information; need for clarification. • Develop SUE plan sheets and transfer information on all involved utilities to appropriate design plan sheets, electronic files, and/or other documents as required. Exercise professional judgment to resolve conflicting information. For information depicted, indicate: utility type and ownership; date of depiction; quality level(s); end points of any utility data; line status (e.g., active, abandoned, out of service); line size and condition; number of jointly buried cables; and encasement. Qualitv Level C (includes tasks as described for Qualitv Level D) • Identify surface features, from project topographic data and from field observations, that are surface appurtenances of subsurface utilities. • Include survey and correlation of aerial or ground -mounted utility facilities in Quality Level C tasks. • Survey surface features of subsurface utility facilities or systems, if such features have not already been surveyed by a professional surveyor. If previously surveyed, check survey data for accuracy and completeness. Level B (includes tasks as described for Qualitv Level M • Select and apply appropriate surface geophysical method(s) to search for and detect subsurface utilities within the project limits, and/or to trace a particular utility line or system. • Based on an interpretation of data, mark the indications of utilities on the ground surface for subsequent survey. Utilize paint or other method acceptable for marking of lines. • Unless otherwise directed, mark centerline of single -conduit lines, and outside edges of multi -conduit systems. • Resolve differences between designated utilities and utility records and surveyed appurtenances. • Recommend additional measures to resolve differences if they still exist. ENGINEER will provide permitting support for the CITY to obtain any and all agreements and/or permits normally required for a project of this size and type, as follows: 9.1 Texas Department of Transportation (TxDOT) Coordination • Meet and coordinate with agency for information purposes. • Responding to agency comments and requests Currently the project is not federally funded, but coordination with TxDOT will be maintained to keep the possibility open for future federal funds for construction. 9.2. Railroad Permit • Meet, negotiate and coordinate to obtain approval of the agency issuing the agreement and/or permits. • Completing all forms/applications necessary. • Submitting forms/applications for CITY review • Submitting revised forms for agency review • Responding to agency comments and requests 9.3 Texas Department of Licensing and Regulation (TDLR) Omitted 9.4 Storm Water Pollution Prevention Plan Omitted 9.5 Environmental Services These services are a supplement to the services provided in the original contract to prepare an environmental constraints analysis. • Task 1 Phase I Environmental Site Assessment The American Society for Testing and Materials (ASTM) E 1527-21, Standard Practice for Environmental Site Assessments; Phase I Environmental Site Assessment Process, will be used as a guidance document for the performance of the ESA -I. This standard is consistent and compliant with the Environmental Protection Agency's All Appropriate Inquiry (AAI) Rule and may be used to comply with the provisions of the All Appropriate Inquiry Final Rule. The objective of the ESA-1 is to evaluate historical and present uses of the site for evidence of impacts by hazardous substances regulated under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and petroleum products to permit the CLIENT to satisfy one of the requirements to qualify for the "innocent landowner defense, contiguous property owner, or bona fide prospective purchaser" to CERCLA liability. The ESA-1 will be conducted by an environmental professional meeting requirements as set forth in City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 19 of 28 FORT WORTH 40 CFR §312.10(b) under standards of good commercial and customary practices that constitute "appropriate inquiry into the previous ownership and uses of the property" as defined in 42 USC § 9601(35)(8). The scope of work for the ESA-1 include the following components as a minimum: Review of Existing Data and Records Review of Records and Resource Materials: ENGINEER will review reasonably ascertainable pertinent records and resource materials that are practically reviewable within the cost and time constraints of the ESA-1. Federal, state, local, and facility records will be evaluated for environmentally significant information regarding the site and documented facilities or incidents within the approximate minimum search distance established by the environmental professional in accordance with the ASTM standard. Review of Recorded Land Title Records: ENGINEER will review records of fee ownership, leases, land contracts, easements, liens, and other encumbrances on or of the property as provided by CLIENT or owner, for the purpose of identifying past owners or operators on the site who may have been involved in activities known or reported to include the generation, handling, or disposal of hazardous waste. Site Reconnaissance ENGINEER will perform a site reconnaissance in an attempt to identify recognized environmental conditions in connection with the property. The environmental professional shall visually and physically observe the property, and any structure(s) located on the property not obstructed by bodies of water, adjacent buildings, or other obstacles for environmental hazards and conditions related to the property. The adjoining properties, structures, and potential recognizable environmental hazards and conditions of the property shall be observed visually from all adjacent public thoroughfares, roads, or access points, as well as subject property. The extent of the site reconnaissance is subject to limiting conditions such as weather, impassable obstacles, or access restricted by owners or occupants. Interviews In order to comply with the AAI rules, it is mandatory for ENGINEER to conduct interviews with current owner(s) and occupant(s) of the subject property. Should the CLIENT not wish ENGINEER to contact current or past owners or occupants, the CLIENT shall notify ENGINEER in writing. Additional interviews will be conducted with parties such as current and past facility managers, past owners, operators or occupants of the property, and employees of the government, environmental regulatory personnel, fire department personnel, health department personnel, and occupants or owners of adjoining properties or operations as necessary and or practical to meet the objectives and performance factors of the AAI rule. Interviews include inquiries in person, by telephone, or by written correspondence. Information from interviews shall be documented including persons interviewed, date and time of the City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 20 of 28 FORT WORTH interview, and information provided. In the event an interview is not possible, this possible data gap will be discussed in the report. Findings Evaluation and Report Preparation The final report of the ESA -I will include: 1) documentation of information sources; 2) the facts and description of environmental conditions relevant to the site; 3) the identity and qualifications of the environmental professional(s) involved in the performance of the ESA -I, including signed declarations; 4) the opinion by the environmental professional of the impact of recognized environmental conditions in connection with the property; and 5) recommendations for further action if deemed warranted. U.S. Small Business Administration (SBA) Loans & Third Party Reliance Due to requirements developed by the SBA as a result of SOP50-10[5] effective June 2008 (revised March 2009), ENGINEER cannot extend reliance on the ESA -I report to the SBA or its development company loan programs (a.k.a. Certified Development Company [CDC]), should CLIENT seek funding through the SBA or its CDC under an SBA 7(a) and 504 loan program; however, reliance may be extended to parties pursuing loan options other than SBA -related programs provided third party agrees to ENGINEER's standard terms and conditions and a fee of $250.00. Reliance on the information provided in a ESA -I report for the purposes of conducting "All Appropriate Inquiry" (AAI) is subject to the conditions in ASTM E 1527-21 §4.6 describing the continued viability of an ESA -I. In general, ENGINEER will not extend reliance or liability on the information provided in the ESA -I report beyond ASTM E-1527's "shelf life" requirements, currently 180 days, unless an update assessment has been performed by ENGINEER. Additional Business Environmental Risk Considerations This ESA -I is not intended to be a detailed study to identify or quantify all potential environmental concerns. Other issues not included within the standard ESA -I scope of work, but which may be performed as additional scope services include, but are not limited to, the investigation and/or evaluation of asbestos - containing building materials (ACBM), lead -based paint, lead and other contaminants in drinking water, radon gas, indoor air quality, or ecological, cultural and historical resources (i.e., threatened or endangered species, archeological resources, sole source aquifers, etc.). Such factors could pose an additional "business environmental risk" to parties involved and can also be evaluated in conjunction with, or supplemental to the ESA -I. No additional business environmental risk considerations are proposed for the ESA -I at this time. • Task 2 Protected Species Habitat Evaluation This task includes an assessment of habitat for rare, threatened, and endangered species and U.S. Fish & Wildlife designated critical habitat. ENGINEER will research readily available environmental information from appropriate local, state, and federal agencies relative to the project area. This will City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 21 of 28 FORT WORTH include a review of desktop resources such as USGS topographic maps, aerial photography, Texas Parks and Wildlife Department (TPWD), Natural Diversity Database (TXNDD) Element of Occurrence Records (EOR), and TPWD Rare Resources by County lists. A U.S. Fish & Wildlife designated critical habitat field visit will be conducted in support of the assessment. The vegetation of the project area will be characterized, as will the ecological setting in accordance with TPWD map publications, including The Vegetation Types of Texas. This field data will aid in determining the potential presence habitat suitable for state and federally listed species and critical habitat in the proposed project area. ENGINEER will prepare a report documenting the findings, including any recommendations for additional activities or implementation of best management practices during construction. • Task 3 Waters of the U.S. Delineation ENGINEER will conduct field investigations and prepare a Waters of the U.S. (WOUS) (including wetlands) determination and delineation report for the site in accordance with current federal delineation methodology including the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual and 2010 Regional Supplement for the Great Plains Region. A determination will be made regarding the presence of potential WOUS, as defined using prescribed USACE guidance, that may be subject to Clean Water Act Section 404 jurisdiction. Should any potential jurisdictional features be identified, ENGINEER will identify and delineate the boundaries, including special aquatic sites (e.g., wetlands), and collect a minimum of two representative wetland sample data points. If no surface water features are identified, two Wetland Determination Data Forms will be completed to document negative findings. ENGINEER will prepare a delineation report for the site complete with appropriate field data forms to provide documentation of these conditions. The report will include: • Brief description of the project, methods/sampling procedures, and results as required by the USACE; • Boundaries of any WOUS identified in the field; • Figure depicting the location of each wetland sample data point; • Completed wetland data forms; • Area (acres and/or linear feet) of potential jurisdictional waters of U.S. shown on an exhibit; • Pertinent published data (e.g., historical USGS topographic maps, historical aerial photography, Federal Emergency Management Agency maps, National Wetland Inventory Maps, and USDA soil surveys) to support the findings. • Task 4 SHPO Consultation ENGINEER'S archaeologist will complete a State Historic Preservation Office (SHPO) consultation form and brief cover letter based on the information generated during the Environmental Constraints Analysis (ECA). The document City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 22 of 28 FORT WORTH will be submitted to the CLIENT for review. Once the CLIENT has reviewed the document, and all comments addressed, ENGINEER will produce a final version of the document to submit to the THC for their review and concurrence. The submittal can be done by the CLIENT or by ENGINEER, depending on the Client's preference. The THC will have final determination on the appropriate level of effort needed to comply with the ACT. • Task 5 Intensive Archaeological Investigations Agency Coordination, Permitting, and Project Management If during consultation the THC determines that intensive cultural resources investigations are warranted, ENGINEER will consult with the THC to generate an ACT permit application and SOW that will clearly outline the methods of investigations for the proposed project. The SOW will be submitted to the THC for review and permit issuance. Once the Texas Antiquities Committee JAC) Permit number is received, ENGINEER will begin coordination for mobilization of an intensive archaeological investigations for the proposed project. Project management will consist of project set up, coordination of schedules with the CLIENT and subcontractors (if applicable), scheduling ENGINEER'S staff, and establishing management and safety protocols. Field Investigations At minimum, an intensive pedestrian survey augmented with shovel testing may be required for the proposed undertaking. To conduct this work, ENGINEER'S Archaeologists will utilize shovel testing, in addition to the visual inspection of the ground surface, to search for shallowly (less than 3 feet [80 centimeters (cm)]) buried cultural deposits. If feasible, using only survey -level efforts and field methods, the staff will document and assess the State Antiquities Landmark (SAL) and National Register of Historic Places (NRHP)-eligibility of cultural resources identified during the survey. If it is determined that the depths of impacts for the proposed project extend beyond 3 feet (80 cm), deep- testing excavations may be required. ENGINEER recommends up to eight (8) backhoe trench excavations within the Project Area. Backhoe trenches will be excavated by a professional backhoe operator, and all excavations will be performed in accordance with Occupational Safety and Health Administration (OSHA) guidelines (29 CFR Part 1926) and the Texas Trench Safety Act (H.B. 1569). Backhoe trenches will range from 10 to 16 feet (3 to 5 meters [m]) in length and will be 3 feet (1 m) wide to allow ease of access. The trenches will reach a depth of up to 6 feet (2 m) below surface, or to the depth of impacts anticipated for the proposed undertaking. If, upon the examination of the walls of the trenches, cultural materials and/or features suggest that archaeological materials may extend below the base of the trench, the trench will be widened and deepened in such a manner as to meet OSHA trenching guidelines, and allow for the safe ingress and egress of staff. Staff will not be allowed to enter any trenches that do not meet OSHA guidelines. Trench depths will not exceed 12 feet (4 m) below the ground surface. City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 23 of 28 FORT WORTH ENGINEER will apply a limited artifact collection policy, as part of which only artifacts that are temporally diagnostic and associated with intact soil deposits or features will be collected. Furthermore, depending on the temporal affiliation of a feature, documentation may also include the collection of a sample of the feature content. Diagnostic materials and feature samples can aid in assessing the ages of the deposits and features and will have to be curated at a state -accredited curation facility. By collecting only temporally diagnostic artifacts, ENGINEER will limit cost for permit -mandated curation. All work will comply with the THC's Rules of Practice and Procedure, Chapter 26, Section 27, and the Council of Texas Archeologists (CTA) Guidelines for Cultural Resources Management Reports. Reporting and Curation Following the completion of the field investigations, ENGINEER'S staff will produce a draft technical report of findings. The draft will be produced in accordance with the Rules of Practice and Procedure of the THC, as outlined in Chapter 26, Section 27, and the CTA Guidelines for Cultural Resources Management Reports. It will describe the cultural setting of the Project Area, methodologies, and the investigative findings. The draft report also will include recommendations for further work or no further work with appropriate justifications based on the requirements of 13 TAC 26.5(35), 13 TAC 26.20(1), and 13 TAC 26.20(2).The report will be submitted to the CLIENT for review. Upon approval, ENGINEER will submit copies of the draft report to the THC for their 30-day review. Following the completion of the review, ENGINEER will make revisions, if any, and prepare the final report under the ACT Permit. Any diagnostic artifacts collected during field investigations will be submitted for final curation to the Center for Archaeological Research at the University of Texas at San Antonio for curation. Furthermore, all project related documentation produced during the investigations will be curated in accordance with federal regulation 36 CFR Part 79, and THC requirements for State Held -in -Trust collections • Task 6 Section 404 Nationwide Permit If required following review of preliminary design and Nationwide Permit (NWP) options, ENGINEER will prepare a PCN for the appropriate NWP in accordance with the USACE Fort Worth District's application process. This scope includes permit application seeking coverage under a NWP. ENGINEER will complete the application and coordinate with CLIENT for pertinent project information and required data. Such data includes information regarding project location, applicant, property ownership, project impacts and mitigation (See Limitations), and supporting graphics for the agency's review. The application will be submitted to CLIENT for review and signature prior to submitting to the USACE. This task also involves coordinating required drawings with CLIENT, obtaining adjacent property owner contact information, compiling required figures and attachments, GIS support activities for required drawings, conducting quality reviews, clerical support, and addressing two rounds of comments each from CLIENT and the USACE. ASSUMPTIONS City of Fort Worth, Texas Heritage Trace Parkway Attachment A CPN 103300 Release Date: 07.22.2021 Page 24 of 28 FORT WORTH • Permit preparation will begin after approval of the Conceptual Design. • Up to three (3) meetings are assumed with railroad for the railroad permit. • Up to three (3) meetings are assumed with TxDOT LIMITATIONS (Environmental) • Additional Studies: o Any studies, field visits, or other activities that may be requested by CLIENT or other parties and are not specifically referenced in this proposal are excluded from this scope of work. These may include, but are not limited to, preparation of an environmental assessment, public involvement, stream or wetland mitigation, or others. Unless noted otherwise, no state or local permits will be obtained (i.e. Floodplain, etc.). ENGINEER will coordinate with the local floodplain administrator for review of design within the floodplain. • Cultural Resources o Project Area: This scope of work is based on information provided by the CLIENT at the time of this proposal. Cost associated with this proposal are based on a 1.5-mile linear Project Area within a corridor no larger than 100 feet (30 m) wide, with a maximum depth of impacts at 6 feet below current grade throughout. Any changes to the Project Area may result in adjustments to the proposed scope of work and will be addressed in a subsequent change order. o Agency Consultation: This scope of work is based on information provided by the CLIENT. If during the agency consultation portion of this scope of work, the reviewing agency requests additional investigations or adjustments to the proposed scope of work, the costs associated with such will be addressed in a subsequent change order. o Additional testing/data recovery/construction monitoring: ENGINEER assumes no additional testing/data recovery/construction monitoring will be required for this proposed scope of work. If during the investigations deposits are discovered, and the reviewing agency requests additional investigation to determine their significance, the costs associated with such investigations will be addressed in a subsequent change order. o In-depth Archival Research: ENGINEER assumes no in-depth archival research will be required for the proposed project. If during the investigations deposits are discovered, and the reviewing agency requests in-depth archival research to determine their significance, the costs associated with such investigations will be addressed in a subsequent change order. o Mechanical Equipment/Operator. If the CLIENT requests to provide their own appropriate machinery and certified operator for the duration of the proposed undertaking, cost will be adjusted. o Public Right -of -Way Coordination: This scope of work does not include costs associated with public right-of-way coordination efforts. This includes, but is not limited to, obtaining right-of-way permits, lane closures, traffic control, or barricade construction. Any efforts associated with public right-of-way coordination is the responsibility of the CLIENT. o Reconstruction of Existing Surface/Subsurface Conditions: This scope of work does not include costs or efforts associated with the reconstruction of the existing surface/subsurface conditions to be impacted by backhoe trenching investigations. This includes, but is not limited to, paved roads, sidewalks, curbs, signage, and underground utility easements. Any efforts required to repair or replace the existing surface/subsurface back to its original condition is the responsibility of the CLIENT. o Historic -age Above -ground Structures: If any above -ground resources of historic -age are encountered during the course of investigations, ENGINEER'S Archaeologists will thoroughly record the building/structure in relation to any archaeological deposits that might be present and associated with the resources; however, no Standing Structure Survey will be completed as a part of this scope of work. A Standing Structure Survey and recommendations for further work associated with the above -ground structure must be conducted and determined by an Architectural Historian that meets the Secretary of the Interior Qualifications for Section 106 of the National Historic Preservation Act. o Documentation of Cultural Resources: ENGINEER assumes the documentation of a maximum of two (2) new archaeological sites for the project based on its cultural and environmental setting. Should additional archaeological sites or cultural resources (including above ground structures) be encountered, the costs associated with documenting those resources will be addressed in a subsequent change order. o Access: ENGINEER assumes unfettered access the Project Area. Any right -of -entry permissions, gate combinations, etc. required to access restricted areas should be provide by the CLIENT to ENGINEER prior to field mobilization. o Unmarked Burials: In the event that human remains are encountered in any subsurface context, work will halt immediately, precautions will be taken, and a new proposal and fee will be submitted to ensure compliance with the amended Texas Health and Safety Code for unmarked burials. ENGINEER will make reasonable efforts to complete the work within the budget and will keep the City informed of progress toward that end so that the budget or work effort can be adjusted if found necessary. ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be adjusted, nor is the City obligated to pay ENGINEER beyond these limits. If ENGINEER projects, in the course of providing the necessary services, that the PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether by change in scope of the project, increased costs or other conditions, the ENGINEER shall immediately report such fact to the City and, if so instructed by the City, shall suspend all work hereunder. When any budget has been increased, ENGINEER's excess costs expended prior to such increase will be allowable to the same extent as if such costs had been incurred after the approved increase. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. Method of Payment A. The ENGINEER shall be paid by the City based upon an invoice created on the basis of statements prepared from the books and records of account of the ENGINEER, based on the actual hours and costs expended by the ENGINEER in performing the work. B. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. C. ENGINEER shall prepare and submit invoices in the format and including content as presented in Exhibit B-1. D. Payment of invoices will be subject to certification by the City that such work has been performed. III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Transportation and Public Works Department, Water Department monthly progress reports and schedules in the format required by the City. DISCUSSION: On October 10, 2023, a contract in the amount of $98,440.00 was awarded to Aguirre and Fields, L.P. (CSC No. 60236), selected as the most qualified consultant based on an RFQ process for data collection, initial permitting, and design activities. The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of Amendment No.1 to the engineering services agreement with Aguirre & Fields, L.P. in an amount of $2,901,192.00 for engineering services associated with the design of the extension of Heritage Trace Parkway. The scope of this amendment includes full design services, including identifying affected stakeholders, defining and evaluating design alternates, identifying right-of-way needs, franchise utility locations and relocation coordination, coordinating with regulatory agencies such as Texas Department of Transportation (TXDOT) and the Army Corps of Engineers as required, assisting with community outreach and preparation of bidding documents for the project. The project is currently funded for design only. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued.Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding is budgeted in the 2022 Bond Program and Transportation Impact Fee Cap Funds for the TPW Department for the purpose of funding the Heritage Trace Pkwy 1 project, as appropriated. Aguirre & Fields, L.P. is in compliance with the City's Business Equity Ordinance by committing to 15.06% MWBE participation on this project. The City's MWBE goal on this project is 13%. This project is located in COUNCIL DISTRICT 10. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Transportation Impact Fee Cap and 2022 Bond Program Funds for the Heritage Trace Pkwy 1 project to support the approval of the above recommendation and execution of the amendment.
