AN ORDINANCE VACATING AND EXTINGUISHING A
TRIANGULAR PORTION OF WEST TERRELL AVENUE RIGHT
OF WAY CONTAINING 4,058 SQUARE FEET AND A 20-FOOT
BY 20-FOOT PUBLIC OPEN SPACE EASEMENT SITUATED IN
THE WM. WELCH SURVEY, FORT WORTH, TARRANT
COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN
SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That a portion of West Terrell Avenue, being an irregular triangular tract of
variable width and length containing approximately 4,058 square feet or 0.093
acres of land and a 20-foot by 20-foot Public Open Space Easement, situated in
the Wm. Welch Survey, Abstract No. 1644, City of Fort Worth, Texas, as
recorded in Cabinet A, Slide 5803, Plat Records, Tarrant County, Texas, and as
more specifically described in Exhibit A attached hereto and incorporated herein
by reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated street right-of-way
and Public Open Space Easement are hereby released and shall revert to the
adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such
time all utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RIGHT-OF-WAY VACATION
LEGAL DESCRIPTION
Being a tract of land situated in the WM. Welch Survey, Abstract No. 1644, in the City of Fort Worth, Tarrant
County Texas, being a part of West Terrell Avenue right-of-way, and said tract of land being more particularly
described as follows:
BEGINNING at a point found for the southeast corner of Lot 3-R, Block 1, Harris Hospital Addition, an addition to
the City of Fort Worth, according to the plat recorded in Cabinet A, Slide No. 5803, Plat Records, Tarrant County,
Texas, intersection of the west right-of-way line of South Henderson Street (80' right-of-way) and the existing
north right-of-way line of West Terrell Avenue (60' right-of-way) and said point being the beginning of a curve
to the right having a central angle of 16'04'33", a radius of 200.00 feet, and a chord bearing and distance of
South 31'34'21 " West, 55.93 feet;
THENCE continuing with said west right-of-way line of South Henderson Street and with said curve to the right in
a southwesterly direction, an arc length of 56.12 feet to a 5/8" iron rod with yellow cap stamped "Dunaway
Assoc. Inc." found for the new proposed north right-of-way line of West Terrell Avenue and at the beginning of a
non-tangent curve to the left having a central angle of 25'0306", a radius of 486.93 feet, and a chord bearing
and distance of North 7T 19'22" West, 211.21 feet;
THENCE with said new proposed north right-of-way line of West Terrell Avenue and with said curve to the left in
a northwesterly direction, an arc length of 212.90 feet to a 5/8" iron rod with yellow cap stamped "Dunaway
assoc. Inc." found;
THENCE West, continuing with said new proposed north right-of-way line of West Terrell Avenue, a distance of
42.55 feet to a P.K. Nail found in the aforementioned existing north right-of-way line of West Terrell Avenue and
being the centerline of formally Fifth Avenue;
THENCE North 89'40'00" East, with said existing north right-of-way line of West Terrell Avenue and with the
southerly line of aforementioned Lot 3-R, Block 1, a distance of 29.90 feet to a point;
THENCE North 89'44'23" East, continuing with said existing north right-of-way line of West Terrell Avenue and with
said southerly line of Lot 3-R, Block 1, a distance of 248.00 feet to the POINT OF BEGINNING and containing
4,058 square feet or 0.093 acres of land.
