J. BOAZ ROAD On August 23, 1988, at the Benefit Hearing for the Assessment Paving of FM 1220 (Boat Club Road) from Ten Mile Bridge Road to W. J. Boaz, Mr . Scott Walker appeared representing owners of property adjoining the street. Mr. Walker questioned why only part of the property was being assessed. The attached map shows the section of Boat Club Road from Ten Mile Bridge Road to W.J. Boaz Road that is covered under Minute Order No. 82693, approved by City Council on May 7, 1985 (M&C G-6332) . The map also shows the city limit lines. Part of the roadway is entirely within the City of Fort Worth, part is in Tarrant County, and part is on the border between the City and the County. Where the City annexed property, the annexation included the full width of the street, so that the street is the border between the City and the County, the roadway is in the City with abutting property on one side in the County and on the other side in the City. The State is improving Boat Club Road north from the City limits approximately one mile to Park Street. This section of roadway lies entirely within the County. The construction contract is being administered by the State Department of Highways and Public Transportation under the Federal Aid Urban Systems program. The State is paying for the pavement, and the City and/or the County are responsible for curb, gutter, drainage, and driveway approaches, with the determination of financial responsibility being based on who has juris- diction of the roadway. Therefore, where the street is on the border and is in the City, the City's financial participation is based on the cost of curb and gutter and drainage for both sides of the street. The City of Fort Worth is proposing to levy assessments for a portion of the cost of the improve- ments against owners of property on both sides of the roadway on the sections of the road which are in the City. This involves property in the City and in the County, an action which is permitted under state law. Tarrant County officials have not elected to assesses for their share of the improvements which are in their jurisdiction; the County-at-large will pay the full cost of the County's share of the work. Under this proposal , all properties on both sides of the road between points A and B and between points C and D will be assessed according to City Policy and State Law. Properties between points B and C are within the County and will not be assessed. The property belonging to Mr. Walker' s client is located west of Boat Club Road and runs from a point approximately 2,250 feet south of point B to a point approximately 2,040 feet north of point C. J. BOAZ ROAD This situation applies only to Mr. Walker's client's property. The -assessment rate, which provides for the curb and gutter and drainage, is $12.22 per foot. The total estimated cost of the project from Ten Mile Bridge Road to Park Street is $5,015,938.07, of which the property owner share is $153,659.04 (3.0%), the City-at-large share is $78,951 .03 (1 .6%) , and the State share is $4,783,328.00 (95.4%) , including a portion of the cost which is being paid by the County., Mr. Walker also had questions about the ownership of one parcel of land. The staff has met with Mr. Walker, and the questions have been resolved.
