Subject: UPDATE ON REQUEST FOR RENEWAL OF EXPIRED
BUILDING PERMIT FOR 3221 JOYCE DRIVE
On June 7 , 1988 , Mr. Ralph Hooper appeared
before the City Council and requested they approve a
renewal of an expired building permit for 3221 Joyce
Drive . Mr. David Ivory, Senior Assistant City Manager,
pointed out that because the request was not listed as
an agenda item, no vote could be taken. However, Mr.
Ivory indicated that the problem would be investigated
and brought back to City Council . Upon examination by
staff, it was determined that the Building Official ,
Mr. Lester Paige , and/or the Construction and Fire
Prevention Board of Appeals , and not the City Council ,
had jurisdiction to act upon the subject request .
HISTORICAL DISCUSSION
On October 6 , 1986 , Mr. Ralph Hooper applied
for a building permit for Lot 6 , Block 25 , Alta Mere
Addition located at 3221 Joyce Drive , and paid a
$150 - 00 circulation processing fee. The plans were
circulated to the Water Department and to the Plans
Examiners in the Development Department for review. In
early November, 1986 ,Mr.Hooper received a letter
informing him that his construction plans did not meet
the Uniform Building Code ( 1982 ) and also the other
trade codes, namely plumbing and electrical . Mr.
Hooper was also informed by letter,dated October 20 ,
1986 , that a fire hydrant was required and provision of
fire protection was a condition to obtaining a building
permit.
On March 18 . 1987 , Mr. Hooper applied to the
Construction and Fire Prevention Board of Appeals for a
waiver of the fire hydrant and a six-month extension
for the building permit , which was to expire on April
6 . 1987 - extended to September 16 , 1987 . Mr. Hooper's
request was denied by the Board for a waiver of the
fire hydrant based upon Section 10 .301 of Uniform Fire
Code . The building permit application extension to
September 16 , 1987 was approved on April 16 , 1987 , Mr.
Hooper was notified by letter of the Board 's decision
(Case No. 27-87 ) .
On April 13 , 1987 , the Water Department
mailed Mr-Hooper a cost estimate for the fire hydrant
total cost $2 ,349 . 89 . On August 17 , 1987 , the
00r•. required amount for the fire hydrant was paid. The
water and sewer taps were paid for on September 24 ,
1986 .

REGULATIONS AND ENFORCEMENT OF ORDINANCE NO. 9280
The building permit was .issued on September
10 , 1987 ,Mr. Hooper paid a total of $205. 25 for the
permit . No work was done on the site since the permit
was issued . On June 7 , 1988 , Mr. Hooper requested that
he be allowed to construct the garage using the permit
issued on September 10 , 1987. The Uniform Building
Code , adopted by Ordinance Number 9280 , states that a
permit expires after 180 days, if not commenced in
that time ( It has not. ) In order to renew action on a
permit after expiration, the applicant must pay -"a new
one-half permit fee . Therefore , on June 7 , 1988 , Mr.
Ralph Hooper ' s request was denied by the Acting
Assistant Building Official , Jolene Loftus.
Mr. Lester Paige , upon reviewing the
request , has decided to grant a renewal of the expired
permit based upon the fact that Mr. Hooper has been
working on obtaining financing for his project.
Therefore , it can be inferred that he was indeed
working on the permit.
Upon written request from Mr. Hooper to
renew the expired permit and payment of one-half the
original building permit fee (which would amount to
$102 .63) , the permit can be renewed for six ( 6 ) months
with an expiration date of December 10 , 1988 and an
understanding that no further extensions or renewals
will be granted for the current project , and that Mr.
Hooper would not be required to comply with new
ordinances passed in April 1988 that would require a
bufferyard zone .
FU_RTHER ACTION
On June 10 , 1988 , the Acting Assistant Building
Official notified Mr. Hooper by telephone and mail . On
the telephone , Mr. Hooper indicated agreement with Mr.
Paige 's decision.

RE: Renewal of Expired Building Permit for
3221 Joyce Drive
Dear Mr. Hooper:
Per our conversation today, June 10, 1988, the following conditions for
renewal of said expired permit have been determined by Mr. Lester E. Paige Jr. ,
Building Official for the City of Fort Worth. They include:
1. Submittal of a written request for renewal of the subject
permit;
2. Submittal must be done within fifteen (15) days of the date
of this letter;
3. Renewal of the permit will be for six (6) months with an
expiration date of December 10, 1988;
4. Payment of one-half of the original permit fee (which
amounts to $102.63) must be paid for renewal of the permit;
5. No further extensions and/or renewals would be allowed for
the current project;
6. The new bufferyard zone ordinance, Ordinance No. 10096, passed
on April 19, 1988, would not apply to the subject permit.
If you agree and comply with the above conditions, a renewal will be granted.
