This item is being included on the May 10th Pre-Council Agenda for discussion and future a cti on. If desired, additonal information will be provided upon request. uglas Harm I /City Manager DH/sf:2 ISSUED BY THE CITY MANAGER FORT WORTH, TEXAS REVISED OUTLINE OF NORTH FORT WORTH AIRPORT ACCESS CONCEPTS April 29, 1988 A. Right of Access. 1. A primary function of the Airport is to serve industrial businesses that require aviation support. A unique attraction of the Airport will be the availability of direct aircraft access onto the Airport from adjacent tracts. This Airport access concept permits a business both to maintain its own aviation related activities and to conduct its aviation related business as an integrated part of its own facility. 2. The City shall enact an ordinance granting to off- Airport owners access rights in accordance with the terms set forth in this outline, subject to operating and regulatory standards necessary for the safe and efficient operation of the Airport. This ordinance shall be incorporated into the FAA Grant Agreement for the Airport. 3. Each off-Airport owner having access to the Airport shall designate an "Access Area" for aircraft. The designated "Access Area" shall be the only area on that owner's tract of land where aircraft may be maneuvered, stored, repaired, operated or otherwise permitted on such owner's land, except that aircraft in the process of original manufacture will be permitted on that owner's land outside the Access Area until the completion of the manufacturing process. Each owner of an off-Airport tract which has airport access must erect and maintain physical barriers (fences, building walls, etc.) between the designated Access Area and the remainder of that owner's tract. City and other government officials responsible for operation and safety on the Airport shall have the same rights of entry, inspection, and regulatory authority in the Access Area of each off-Airport owner's tract that they have on the Airport. In addition, all safety and operational rules and regulations applicable on the Airport shall be applicable in all Access Areas and on the access ways and taxiways leading from the Airport property to the private Access Areas. or ,,. 4 . It is intended that traditional Fixed Base Operators (FBO's) will be operated only on the Airport. Therefore, no business offering to the general public traditional FBO services will be operated off the Airport. Services traditionally offered by FBO's to the general public include; maintenance and repair of aircraft; aircraft storage; inspection and licensing of aircraft; the sale of miscellaneous aircraft parts, equipment and accessories; flight training for small general aviation aircraft; and the sale of fuel. This does not preclude the operation on the adjacent tracts of aviation uses (a) supporting a user's own aircraft (i.e. storage, maintenance and self-fueling; provided, however, that self-fueling may be limited to those users whose aircraft operations exceed certain levels based on the number of aircraft or quantity of fuel consumed) , or (b) associated with a user's aviation related business of manufacturing of or performing major repairs and modifications on aircraft or aircraft parts and components. $. Facilities Use Fee. 1. Users of the Airport runway and taxiways from adjacent tracts, whether located in Fort Worth or in Haslet, will pay the City of Fort Worth a facilities use fee. The facilities use fee will be based on an assumed land value of $72,000 per acre of Access Area as of the date the Airport first becomes operational. The fee will be set at a level providing . 10% return annually to the City of Fort Worth, (or an annual charge of $.165 per square foot of Access Area) . Each off-Airport owner having access shall pay a minimum facilities use fee based on 150,000 square feet of Access Area, or $24,750. 00 for the first year after opening of the Airport. Owners with more than 150,000 square feet of Access Area shall be charged based on their actual square footage of Access Area. 2. The facilities use fee shall change from year to year in a percentage amount not to exceed the percentage change for the year of the Consumer Price Index for the Dallas/Fort Worth Metropolitan area (CPI) . The City shall notify each owner having access to the Airport of the change and the new amount of that owner's facilities use fee. 3. The facilities use fee will be charged to an off- Airport owner beginning on the date that owner first gains physical access to the Airport from that tract. Access rights will continue indefinitely so long as the access fee is paid and applicable regulations are obeyed. 4. The City recognizes that the increased tax revenues from the adjacent tracts located within the City of Fort Worth will be a direct result of the existence of and availability of direct access to the Airport. Consequently, the City of Fort 'Worth intends to provide a credit against the facilities use fee for any owner who substantially develops his tract so as to enhance the tax revenues to the City. In any year, if the ad valorem tax levied by the City of Fort worth on the land and improvements on an owner's entire tract is equal to more than twice the amount of the minimum facilities use fee on that tract, the facilities use fee shall not be charged to the owner. Instead, the City shall transfer to the Airport operating fund a portion of the ad valorem taxes collected from that owner, in an amount equal to the facilities use fee for that owner for that year; provided, however, that the amount transferred shall never exceed 50% of the ad valorem taxes collected from that owner for that year. 5. In addition to the facilities use fee, the off-Airport owner also will pay a customary fuel flowage fee established by the City for any self-fueling operations on his tract. �r► C. Access Ways, 1. Aircraft access onto the Airport from the adjacent tracts will be accomplished by taxiways or ramps connecting into Airport taxiways. The exact locations and configurations of these access taxiways or ramps will be determined from time to time after further land use planning. It is important that the design be responsive to the requirements of potential users. Such locations and configurations shall be as determined by the owner of the adjacent property and shall be limited only by operational safety and efficiency considerations as determined by the City and the FAA. 2. Easements will be granted in favor of the City (i.e. the public) and the users for the access taxiways on the adjacent property. The construction standards of these access taxiways will be subject to approval by the City and the FAA. The taxiways will be a part of the Airport operations Area and will satisfy the FAA sponsor assurances that will be applicable to the City- owned Airport property. The City will have the right to require on-going compliance with these assurances in these areas. The cost of initial construction will be ' . f the responsibility of the property owner. The cost of maintaining these access taxiways will be a part of the regular operating costs of the City and be paid for from general City funds (not funds dedicated to the Airport) . Costs for reconstructing the access taxiways will be assessed to the benefited adjacent owners in the same manner as normal assessments by the City for street reconstruction. 3. It is recommended that City Council adopt an ordinance granting access to off-airport property owners adjacent to the North Fort Worth Airport. DISCUSSION: The Perot Group has proposed a major development in North Fort Worth which includes plans for industrial, commercial, and residential development. A major focal point is a new general aviation reliever airport proposed as the North Fort Worth Airport. The Airport which is a combined public/private effort includes the City of Fort Worth, The Perot Group, and the Federal Aviation Administration. The Airport as proposed will have an 8,200 foot runway able to accommodate heavy transport aircraft. The Perot Group proposes to dedicate approximately 378 acres for the construction of a runway, associated taxiways, navaids, hangars-, and other approved aviation related facilities. The proposed land dedication does not provide sufficient space to allow development of major facilities such as defense contractors, major air freight industries, major industrial manufacturing, and assembly operations that require large acres of land. Therefore, The Perot Group proposes a concept of off-airport access which will allow off-airport private tracts of land access to the public airport. The aircraft will. +gain access between the Airport and off-airport private land via access taxiways. - City Staff, FAA Staff, and The Perot Group have held several meetings to arrive at a mutually agreeable Off-Airport Access Concept. In order to enact this concept, the City must adopt an ordinance granting off-airport property owners a license establishing access rights in accordance with the terms set forth in the Off-Airport Access Concept, subject to operating and regulatory standards necessary for the safe and efficient operation of the Airport. This ordinance shall be incorporated into the FAA Grant Agreement for the Airport. Following several committee meetings and a work session of the Aviation Advisory Board, the Board at their . May 5, 1988 meeting, recommended City Council adoption of the ordinance granting access to off-airport property owners adjacent to the North Fort Worth Airport.
