HomeMy WebLinkAboutOrdinance 26706-01-2024ORDINANCE NO. 26706-01-2024 AN ORDINANCE INCREASING THE NUMBER OF AUTHORIZED SWORN POSITIONS IN THE POLICE DEPARTMENT BY ADDING SIX (6) POSITIONS IN THE CLASSIFICATION OF POLICE OFFICER AND ONE (1) POSITION IN THE CLASSIFICATION OF SERGEANT EFFECTIVE JANUARY 23, 2024, TO REFLECT POSITIONS ASSOCIATED WITH THE COPS HIRING PROGRAM GRANT; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 143.021(a), Texas Local Government Code provides that a municipality's governing body shall by ordinance (i) establish the classifications of police officers and (ii) prescribe the number of positions in each classification; and WHEREAS, on October 17, 2023, the City Council adopted Ordinance 26497-10-2023, which established the Police Department's sworn personnel staffing levels, effective October 1, 2023, as follows: Assistant Chief 3 Deputy Chief 6 Commander 6 Captain 17 Lieutenant 50 Sergeant 212 Corporal/Detective 262 Police Officer 1,319 Total 1,875; and WHEREAS, the Police Chief has requested that the City Council adjust the number of authorized positions in the existing classification of Police Officer in the Police Department by six (6) and in the existing classification of Sergeant by one (1), effective January 23, 2024, to reflect the addition of positions associated with the award of a grant from the United States Department of Justice, Community Oriented Policing Services (COPS) Hiring Program, and thereafter prescribe the number of authorized positions in the Police Department to conform with the proposed changes as set forth below in order to effect efficient economy of the operations of the Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Ordinance No. 26706-01-2024 Page 1 of 3 That, following the formal adoption of this ordinance, the following positions shall be the only sworn positions in each classification (rank) authorized in the City of Fort Worth Police Department effective January 23, 2024, until modified by subsequent ordinance: Assistant Chief 3 Deputy Chief 6 Commander 6 Captain 17 Lieutenant 50 Sergeant 213 Corporal/Detective 262 Police Officer 1,325 Total 1,882 SECTION 2. That the "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the City Council in its adoption of this ordinance as well as the Department in its implementation. SECTION 3. That this ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior police staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, Ordinance No. 26706-01-2024 Page 2 of 3 since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall be effective January 23, 2024, with respect to the change in positions as reflected above, and it is so ordained. Goodall, City Secretary Ordinance No. 26706-01-2024 Page 3 of 3 City of Fort Worth, Texas Mayor and Council Communication DATE: 01/30/24 M&C FILE NUMBER: M&C 24-0097 LOG NAME: 35FY24 PD STAFFING ORDINANCE COPS HIRING SUBJECT (ALL) Adopt Ordinance Amending Police Department Staffing Effective January 23, 2024, to Increase the Number of Authorized Civil Service Positions in the Specified Classifications by a Total of Seven RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance prescribing the number of authorized sworn positions in the Police Department effective January 23, 2024, increasing the number of authorized positions in the classification of Police Officer by six (6) and in the classification of Police Sergeant by one (1), thereby increasing the total of authorized civil service positions from 1875 to 1882. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) and the attached ordinance is to take actions to increase the authorized staffing of the Police Department for Fiscal Year (FY) 2024. On May 9, 2023, M&C 23-0364 was approved authorizing the grant application from the United States Department of Justice, Community Oriented Policing Services (COPS) Hiring Program (CHP) to hire eleven (11) new officers for the Fort Worth Police Department. On November 2, 2023, the Fort Worth Police Department received notice of the grant award. As a result of the City's budget process, four (4) of the positions that were applied for received funding therefore the award will be revised to accommodate seven (7) positions, as opposed to the original eleven (11) positions. This alteration is intended to prevent misappropriation of funds through supplanting. Accepting the grant requires an increase in the number of authorized positions within the Police Department. The Police Department requests six (6) positions in the classification of Police Officer and one (1) position in the classification of Police Sergeant, effective January 23, 2024, to coincide with the date of this action, for the CHP grant period beginning October 1, 2023 - September 30, 2027. The Officer positions will serve in the Explorer Program, the Police/Clergy Program, the Community Safety Partnership Program and Police Athletic League (FWPAL). The Sergeant position will serve in the Community Safety Partnership Program. These seven (7) positions will be designated as temporary, "overage" positions, during FY2024 since the positions are being requested outside of the formal budget development process. The department will request these positions as part of its authorized strength during the FY2025 budget process.
