Subject: Contract for the installation of Community Facilities
Medical Center (M&C C-10859)
On March 24, 1988 (M&C C-10859), the Community Facilities Contract for Medical
Center was submitted to City Council for approval. Ms. Beverly Walker,
representing Curtis L. Hunter, Jr. , the owner of the west 40 feet of the east 80
feet of Lot 1, Block 17, Edwards Heirs Addition, appeared before council stating
that access to the subject property had been disrupted and the owner had not
consented to vacating Cannon Street. It was recommended that the subject
Community Facilities Contract be continued for two weeks to allow City staff to
research the project and report back to the Council.
On March 25, 1988, a site visitation by the Development Coordinator and
developer's engineer, Mr. Ed Childress of Gordon S. Swift Consulting Engineers,
confirmed her statement. Further investigation revealed that:
1) Cannon Street had not been vacated and would not be vacated;
2) It was apparent that the contractor inadvertently went beyond the
construction limit during preliminary site preparation; and
3) The barriers referred to by Ms. Walker were positioned to primarily
restrict dumping on the site, not access.
As a result of this investigation, the developer has agreed (at his expense) to
regrade and recompact the roadway on a continuous basis to assure unrestricted
access to all the property fronting on Cannon, Cooper and 12th Street until the
streets are constructed to City Standards and to remove the barriers.
On March 29, 1988, the reconstruction agreement was discussed with Ms. Walker
and she was satisfied with the developer's arrangements. Ms. Walker was also
informed that the subject streets would be upgraded at sometime in the very near
future, to City standards in accordance with the City's assessment paving
policy.
