HomeMy WebLinkAboutContract 61924CSC No. 61924 Letter of Intent Between the City of Fort Worth and the City of Haslet Regarding Properties Seeking Release from the Extraterritorial Jurisdiction WHEREAS, the 88" Texas Legislature, Regular Session, adopted Senate Bill 2038 which amends Chapter 42 of the Texas Local Government Code, to add Subchapters D and E (the "Act"); and WHEREAS, the Act authorizes property owners to release their property fi•om a municipality's extraterritorial jurisdiction upon delivery of a petition to the municipality; and WHEREAS, as a result of the Act, some property owners have effectuated the release of their property from a municipality's extraterritorial jurisdiction and have thereafter sought to be included in an adjacent municipality's extraterritorial jurisdiction or corporate limits; and WHEREAS, the Act impacts a municipality with respect to its Certificate of Convenience and Necessity ("CCN"); and WHEREAS, the City of Fort Worth and the City of Haslet (each individually referred to herein as "City"), are adjacent municipalities that share common boundaries, and are empowered by state law and the Texas Constitution to establish their respective corporate and extraterritorial boundaries; and WHEREAS, in order to promote health, safety, and welfare, confirm corporate and extraterritorial jurisdiction boundaries, and to ensure proper regional planning and cooperation between the municipalities, the City of Fort Worth and the City of Haslet, desire to communicate and cooperate with each other regarding properties seeking release from one municipality and inclusion in the other municipality; NOW, THEREFORE, the City of Fort Worth and the City of Haslet express their intent as follows: 1. The City of Fort Worth and the City of Haslet express their intent to communicate and cooperate with each other regarding properties seeking release from one City's extraterritorial jurisdiction or CCN, or seeking to be included in one City's extraterritorial jurisdiction, corporate boundaries, or CCN, for properties that were located in the other City's extraterritorial jurisdiction or CCN prior to September 1, 2023. 2. The City of Foil Worth and the City of Haslet will communicate with each other and will not adjust the boundaries of their extraterritorial jurisdiction, municipal limits, or CCN to add property that was located in the other City's extraterritorial jurisdiction or CCN prior to September 1, 2023, except where mutually agreed to by the City of Fort Worth and the City of Haslet.
