HomeMy WebLinkAboutOrdinance 26895-05-2024AT Ordinance No. 26895-05-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CRIME CONTROL AND PREVENTION DISTRICT CAPITAL PROJECTS FUND IN THE AMOUNT OF $49,100.00 FOR THE PURPOSE OF FUNDING THE ENTERTAINMENT DISTRICTS STUDY (CITY PROJECT NO. 105315) TRANSFERRED FROM THE CULTURE AND TOURISM FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Crime Control and Prevention District Capital Projects Fund, in the amount'of $49,100.00, for the purpose of funding the Entertainment Districts Study project (City Project No. 105315). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt an appropriation ordinance increasing estimated receipts and appropriations in the Crime Control and Prevention District Capital Projects Fund in the amount of $49,100.00 for the purpose of funding the Entertainment Districts Study (City Project No. 105315) transferred from the Culture and Tourism Fund and 2. Amend the Fiscal Years 2024-2028 Capital Improvement Plan. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate funds in the Crime Control and Prevention District Capital Fund pledged by the Public Events Department of the Culture and Tourism Fund in the amount of $49,100 for partial funding of the entertainment district public safety assessment. On January 30, 2024, the Fiscal Year 2024 (FY24) Crime Control and Prevention District (CCPD) budget was amended to provide funding to address safety concerns in the four (4) entertainment districts, including a comprehensive study on the safety and vitality of the Fort Worth's entertainment districts for strategic planning on safety in Downtown, Stockyards, West 7th and the Near Southside districts (M&C 24-0096). To that end, the City has entered into a professional services agreement with Safe Night, LLC in the amount of $148,200.00 to provide consultation and conduct a public safety assessment (M&C 24-0098). Funding for the study was pledged by both City and local partners. The CCPD funds of $49,100.00 were appropriated on January 30, 2024. The actions of this M&C will appropriate the Public Events Department, Culture & Tourism Fund amount of $49,100.00, as referrenced on M&C 24- 0098. Public Events will prepare a separate M&C (25FY2413UDGETAMENDMENT) to transfer their portion of funds from the Culture & Tourism Fund to the CCPD Capital Projects Fund. The remaining funds of $50,000.00, which were pledged by local stakeholders and collected in the Special Donations Fund, were appropriated on April 9, 2024 (M&C 35FY24 Police Donations). Funding for this project was not included in the FY2024-2028 Capital Improvement Plan due to the need for the study occurring after the development of the annual CIP process. The action in this M&C will amend the FY2024-2028 Capital Improvement Plan as approved in connection with Ordinance 26453-09-2023. Funding is budgeted in the Capital Interfund Transfer Out account within the Culture & Tourism Fund for the purpose of funding the PD Entertainment District project within the CCPD Capital Projects Fund. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the Culture & Tourism Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the CCPD Capital Projects Fund for the PD Entertainment project to support the above recommendations. Prior to an expenditure being incurred, the Police Department has the responsibility of verifying the availability of funds.
