R . d 9:00 a.m. 1me ece1ve : _____ _ City Secretary Contract Number: 59SGS-Al---- FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 59565 A STANDARD AGREEMENT FOR GENERAL PROFESSIONAL SERVICES BETWEEN THE CITY OF FORT WORTH AND HALFF ASSOCIATES, INC. This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 59565 ("First Amendment'') is made and entered into by and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, and Halff Associates, Inc. ("Consultant"), a Texas corporation. WHEREAS, the City and Consultant entered into a Standard Agreement for General Professional Services for Consultant to provide City with drainage and floodplain review services, City Secretary Contract Number 59565 ("Agreement"); and WHEREAS, the City and Consultant executed the First Renewal of the Agreement to extend the term to September 31, 2024; and WHEREAS, due to an increase in the amount of services City desires Consultant to perform, the City and Consultant desire to amend the Agreement to increase the total compensation that may be paid to Consultant; NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends City Secretary Contract No. 59565: 1. The first paragraph of Article II of the Agreement is amended in its entirety to be and read as follows: Consultant shall be compensated in an amount up to $1,100,000.00 ("Contract Amount") in accordance with the Fee Schedule shown in Attachment "B." Payment shall be considered full compensation for all labor (including all benefits, overhead, and markups), materials, supplies, and equipment necessary to complete the Services. 2. a.All other provisions of the Agreement which are not expressly amended herein, shall remain in full force and effect. b.All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in the Agreement. Adding Funds in an Amount Not to Exceed $200,000.00 for a Revised Contract Totaling $1,100,000.00 for Drainage and Floodplain Review Services RECOMMENDATION: It is recommended that the City Council authorize execution of Amendment No. 1 to Ciry Secretary Contract No. 59565, a Professional Services Agreement with Halff Associates, Inc. adding funds in an amount not to exceed $200,000.00 for a revised contract totaling $1,100,000.00 for Drainage and Floodplain Review Services. DISCUSSION: On May 23, 2023 Mayor & Council Communication (M&C 23-0389), the City Council authorized execution of professional services agreement with Halff Associates, Inc., in the amount of $900,000.00 for drainage and floodplain review services associated with private development projects. Halff Associates, Inc., provides staff augmentation to reduce review time of the drainage and floodplain design component of private development projects. Halff Associates, Inc., performs this work on an on-call, time, and materials basis. Additional contract capacity is necessary due to an increase in meetings and total reviews of drainage studies and Infrastructure Plan Review Center (IPRC) plan reviews. These reviews include multiple review cycles of the same project, developer requested meetings & discussions outside of formal review cycles and mandatory pre-submittal meetings for IPRC projects. Funding will be available in the Stormwater Utility Fund for the Transportation & Public Works Department in Fiscal Year 2024 & 2025. MWBE: A waiver of the goal for Business Equity subcontracting requirements was requested, and approved by the DVIN, in accordance with the applicabie Ordinance, because the purchase of goods or services from sources where subcontracting or supplier opportunities are negligible. The project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation funds are available in the current operating budget, as previousiy appropriated, and upon adoption of the Fiscal Year 2025 Budget by the City Council, funds will be available in the Fiscal Year 2025 Operating Budget, as appropriated, in the Stormwater Utility Fund. Prior to an expenditure being incurred, the Development Services and Transportation and Public Works departments have the responsibility to validate the availability of funds.
