TO CITY SECRETARY CONTRACT No. 57178
WHEREAS, the City of Fort Worth (CITY) and BGE, Inc. (ENGINEER) made
and entered into City Secretary Contract No. 57178, (the CONTRACT) which
was authorized M&C 22-0096 on the Sth day of February, 2022, in the amount
of $1,595,280.00; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Big Fossil Creek Collector Parallel Main 402, Phase IVA from Belknap
Street to Interstate 820, CPN 103289; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $385,460.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,980,740.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Dear Mr. Norwood:
Based on the determination of the preferred alignment, the scope of work for the project has changed. The
following summarizes the scope and fee changes required to complete the design of the referenced project.
At the request of the City, the scope also includes efforts associated with the evaluation and design/rehab
of the existing siphon structure on the 54-inch interceptor under Big Fossil Creek near Broadway Ave,
manhole replacement within the industrial park and new 8-inch sewer to serve 2405 Austin Rd.
Task 6.0 Design
Design of Upstream Structure — The existing siphon upstream junction structure has failed and needs
replacement. The Engineer shall design the replacement for the existing structure.
Design of existing siphon barrels — The Engineer will evaluate and provide a detailed design for the
replacement of existing siphon barrels.
Design of Downstream Structure — The Engineer shall evaluate and provide a detailed design for the
rehabilitation/replacement of the existing downstream structure.
Replacement of Manhole M00402A, Sta 72+77 — The Engineer shall evaluate and provide a detailed
design for the replacement of the existing manhole structure.
Streambank stabilization — Review of hydrologic and hydraulic analysis and detailed design of bank
stabilization plans for siphon rehab crossing. The plans for the tributary crossings are limited to erosion
control type improvements and exclude structural design. It is anticipated that stabilization plans will be
implemented between 50 and 100-foot-wide sections along Big Fossil Creek and the tributaries.
Austin Rd 8-inch Sewer Extension — detailed design for an 8-inch sanitary sewer main extension
approx. 2,000 linear feet from termination of S-16687 to service connection of 2405 Austin Rd.

Task 8.0 Construction Phase Services
Construction Phase Support — it is anticipated that the efforts associated with the siphon Rehabilitation
and manhole repair will be incorporated into a change order as part of the BFC phase Il contract with Circle
C. The Engineer will provide construction phase services support for siphon Rehabilitation and manhole
repair efforts (no bid phase support anticipated). Austin Rd Sewer Line will be incorporated into a different
construction package.
Task 9.0 ROW/Easement Services
Additional Easement Preparation along 54-inch parallel interceptor — Additional easements are
required for the proposed route and existing sewer rehab. During the preliminary scoping of the project, it
was estimated that 8 permanent and 8 temporary easements would be required for the anticipated proposed
route, and 15 temporary construction easements would be required to access the existing pipeline. After the
selection of the proposed route, it has been determined that 24 permanent and 32 temporary easements will
be required. Additionally, 18 temporary and 4 permanent easements have been identified for the
rehabilitation of the existing main.
Easement Preparation for siphon rehab, manhole repair & Austin Rd sewer line — The Engineer shall
prepare documents to be used to obtain permanent and/or temporary easements required for siphon
rehabilitation, manhole repair, and Austin Rd sewer line — 5 easements total anticipated.
Task 10.0 Survey
Additional Boundary Survey along 54-inch parallel interceptor — Additional effort, beyond originally
scoped, was required to complete the property base map. Most of the subject tracts were metes and bounds
tracts that were large and expansive, some of these being remainder tracts (areas sold off but not reflected
in the purchase deed). Most of the lands around the perimeter of the subject tracts were platted subdivisions.
To ensure subject tracts were located and represented properly, the survey team obtained and drew in 55
plats. Many were illegible, and efforts were taken to retrieve the originals from archive storage and photos
taken since the original reproduction was such poor quality, some of the plats were mathematically incorrect
or were missing information (bearings, distances, etc.) which led to searching for additional property
corners to help resolve these issues. All these plats had to be verified in the field and constructed digitally
to some extent (deed sketching). Although the project only traverses 18 parcels, 53 Deeds, 332 property
corners, and 106 easement documents were required to assist in the development of an accurate property
base map, as well as approximately 150 property corners searched for but not found in the field.
Topo survey for siphon rehab & Austin Rd sewer line — provide topo survey required for the
design/rehabilitation of existing siphon — approx. 150 LF upstream and downstream of existing alignment.
Provide topo survey of Austin Rd Sewer line for approx. 2000 LF.
Provide Level C&D SUE for the proposed Austin Rd sewer extension.

Task 11.0 Environmental Assessment
Prepare an environmental report documenting potentital waters of U.S. and threatened and endangered
species habitat for the siphon Rehabilitation, manhole repair & Austing Rd Sewer Line efforts. All tasks
required to produce the written Report(s) will be performed in accordance with the most recent requirements
and sufficient for submittal to the USACE and/or applicable agency. The proposed work entails the
following activities necessary for developing the reports:
• Prepare a general information section describing general information pertinent to the PROJECT
and a PROJECT description;
• Prepare maps identifying the locations of the facilities for each resource report developed;
• Prepare and conduct a State threatened mussel species investigation anticipated to be required in
association with proposed impacts to Big Fossil Creek (siphon rehab area + Phase 4A). A
summary report of the survey will be provided.
• Prepare and conduct a cultural resources investigation after coordination with the Texas
Historical Commission. It is anticipated that an Antiquities permit application/submittal will be
required as a result of the proposed impacts to Big Fossil Creek, which will result in an
archeological survey with potential deep prospection (trenching) required (siphon rehab area +
Phase 4A).
• ENGINEER will assist in coordinating with the Agencies (e.g., TPWD, USACE, THC) and
perform necessary investigations/fieldwork as determined necessary.
ASSUMPTIONS
• It is anticipated that a cultural resources investigation will be required based on consultation with the
THC. As Big Fossil Creek is a perennial stream, it is also expected that the THC will require deep
prospection of the proposed site. The cost associated with this proposal assumes that no cultural
resource site(s) will be discovered in association with the investigation. The discovery of a cultural
resource site would be considered out of the scope of this project and would be subject to an
additional work authorization.
• It is assumed that Clean Water Act compliance will be achieved through a Nationwide Permit without
the requirement of a pre -construction notification (PCN).
• A Phase I Environmental Site Assessment will not be performed for the project. Hazardous materials
appendices will include historical site data representative of ASTM Environmental Site Assessment
information.
• No hazardous materials issues will be identified as a result of the field visit/historical data that would
require additional services.
• All alignment sheets, impacts, access, and extra workspace are identified for the preferred alternative
and will be provided in a coordinately correct digital format.
• No protected species issues other than those associated with threatened or endangered mussel species
will be identified, and additional surveys/mitigation will be required as a result of research or
consultation with either TPWD or USFWS.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 in the amount of $385,460.00, to City Secretary Contract
No. 57178, an engineering agreement with BGE, Inc., for the Big Fossil Creek Collector Parallel,
Phase IV A project for a revised contract amount of $1,980,740.00; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water and Sewer Capital Projects Fund in the amount of $385,460.00, transferred from available
PayGo funds within the Water and Sewer Fund, for the purpose of funding the Big Fossil Creek
Collector Parallel, Phase IV A from project (City Project No. 103289) and to effect a portion of
Water's contribution to the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
On February 8, 2022, Mayor and Council Communication (M&C) 22-0096, the City Council authorized
an engineering agreement in the amount of $1,595,280.00 with BGE, Inc., (City Secretary Contract No.
57178) for the Big Fossil Creek Collector Parallel, Phase IV A project.
Amendment No. 1 will provide for additional survey and design for the replacement of the existing siphon
structure on the 54- inch sewer interceptor under Big Fossil Creek near Broadway Avenue upstream and
downstream junction structures, streambank stabilization, additional boundary surveys, design for an 8-
inch sanitary sewer main extension on Austin Road to provide and maintain sewer service to existing and
future customers and environment assessment.
It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of
within the annual budget ordinance, as projects commence, additional funding needs are identified, and to
comply with bond covenants. The actions in the M&C will appropriate funds in support of the Water's
portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvement Program, as follows:

Business Equity: BGE, Inc., agrees to maintain its initial M/WBE commitment of 19 percent that it made
on the original agreement and extend and maintain that same M/WBE commitment of 19 percent to this
first amendment. Therefore BGE, Inc., remains in compliance with the City's M/WBE Ordinance and
attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form
executed by an authorized representative of its company.
This project is located in COUNCIL DISTRICT 4, in Haltom City and North Richland Hills.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water & Sewer Fund and upon
approval of the above recommendations and adoption of the attached appropriation ordinance, funds will
be available in the W&S Capital Projects Fund for the Big Fossil Creek Sewer PH IV A project. Prior to any
expenditure being incurred, the Water Department has the responsibility to validate the availability of
funds.
