(ENGINEER) made and entered into City Secretary Contract No. 61189, (the CONTRACT) which was authorized M&C 24-0172 on the 27 day of February, 2024, in the amount of $3,695,990.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No.1 in the amount of $0.00 administratively authorized on July 16, 2024; and WHEREAS, the CONTRACT involves engineering services for the following project: Eagle Mountain Water Treatment Plant Expansion, CPN 105176; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $11,149,078.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $14,845,068.00. 3. Engineer will prepare front end technical specifications and associated drawings and figures necessary for the pre -procurement of electrical gear to be provided for the EMWTP expansion design. The proposal documents will include requirements for capital costs and warranty provisions. Owner will submit proposal documents to qualified equipment manufacturers. Engineer will answer questions from the electrical equipment manufacturers, prepare required addenda, and attend proposal opening. Engineer will evaluate the received proposals with Owner and provide a recommendation of award for the pre -selection equipment. DELIVERABLES: A. Draft and Final Pre -procurement Proposal Documents. An electronic copy of the draft and final package will be submitted of these documents for review. B. Addenda to the documents. C. Evaluation Spreadsheet Tabulation and Recommendation for Award. To improve the project schedule and reduce packaging concerns, the Engineer will prepare pre -procurement documents for plate -settler. Engineer will prepare front end technical specifications and associated drawings and figures necessary for the pre -procurement of the plate settlers to be provided for the EMWTP expansion design. The proposal documents will include requirements for capital costs and warranty provisions. Owner will submit proposal documents to qualified equipment manufacturers. Engineer will answer questions from the plate settler manufacturers, prepare required addenda, and attend proposal opening. FINAL DESIGN (60- and 90-PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100-PERCENT). — Added in Amendment 2. Upon approval of the PDR, ENGINEER will develop EMWTP Expansion Project design documents (plans and specifications) for submittal to TCEQ for approval and for bidding to General Contractors. Task 5.1— 60% Plans and Specifications. The plans, opinion of probable construction cost (prepared in accordance with AACE guidelines), and specifications for the EMWTP expansion will be completed to a 60% level and submitted to City for review and comment. The 60% review shall be defined and consist of the minimum level of completion by the following disciplines: • Task 5.1.1 — Process Mechanical. This includes General/Standard Sheets (70%), Process Mechanical design, specification and hydraulics (70%). • Task 5.1.2 — Instrumentation and Control (I&C): This includes PIDs (90%), Instrumentation specifications (50%) and control narratives (30%). • Task 5.1.3 — Structural: This includes structural design drawings and specifications to 60% level of completion. • Task 5.1.4 — Geotechnical: This includes geotechnical design and foundation design calculations advanced to 60% level of completion. • Task 5.1.5 — Architectural: This includes architectural plans and specification to 60% level and completion and code analysis to 90%. • Task 5.1.6 - Building Mechanical. This includes design specifications and drawings for building mechanical and fire protection to 50% level of completion. This also includes code analysis to 90%. • Task 5.1.7— Electrical. This includes design progression for specifications and plans to 50% level of completion. • Task 5.1.8 - Civil — This includes civil design for grading, pavement, drainage and yard piping to 70% of completion for drawings and specifications. Task 5.1.9 Miscellaneous Design and Quality Tasks: This task includes a 60% cost opinion, 60% construction schedule, 60% technical review committee and general specifications, 90% sheet list, 60% constructability review, and 60% red -yellow -green quality reviews. Task 5.2 — 90% Plans and Specifications. The plans and specifications for the EMWTP will be completed to a 90% and submitted to City for review and comment. An OPCC will be updated at this milestone. Engineer shall update plans and specifications with any final comments prior to finalizing for Construction. Engineer will seal and sign the completed documents. • Task 5.3.1 — Process Mechanical: This includes General/Standard Sheets (95%), Process Mechanical design, specification and hydraulics (100% ). • Task 5.3.2 — Instrumentation and Control (I&C): This includes PIDs (100%), Instrumentation specifications (100%) and control narratives (100%). • Task 5.3.3 — Structural: This includes structural design drawings and specifications to 100% level of completion. • Task 5.3.4 — Geotechnical: This includes geotechnical design and foundation design calculations advanced to 100% level of completion. This also includes code analysis to 100%. • Task 5.3.7— Electrical. ASSUMPTIONS • Owner will return to the Engineer one set of consolidated comments within two weeks of submittal. CDM Smith assumes the control system network design for the Phase 4 expansion facilities will be an isolated extension with a dedicated fiber optic network connection directly to the existing plant SCADA control system network. No additional external or outside connections will be provided for this network extension. The new network connection point will be to an existing network port in the Phase 3 network room as directed by the City. CDM Smith has not included any engineering efforts for assessment or evaluation of the existing SCADA system network architecture with regards to cybersecurity or access of outside communications to the existing network system. CDM Smith assumes any required cybersecurity effort to connect and protect the new Phase 4 network to the existing network will be performed by internally by the City with their own resources in accordance to internal policies and procedures. CDM Smith cost opinions will follow the AACE International cost estimating guidelines for the appropriate milestone submittal. DELIVERABLES A. Five sets of 1/2-size drawings and five specifications will be delivered for the 60-percent design package. B. Five sets of 1/2-size drawings and five specifications will be delivered for the 90-percent design package. C. Five sets of/2-size drawings and five specifications will be delivered for the 100-percent Design package. A DWF file for the 100% Design will be created from design CAD drawings and will be uploaded to the project folder in. E. Detailed opinion of probable construction costs at 60-, 90- and 100-percent designs. F. Original cover mylar for the signatures of authorized CITY officials. TASK 6. BID PHASE SERVICES. — Added in Amendment 2. ENGINEER will support the bid phase of the project as follows. 6.1 Bid Support • The ENGINEER shall upload all plans and contract documents onto the City's web -based document management system (e-Builder) for access to potential bidders. • Contract documents shall be uploaded in a .xIs file. • Plan Sets are to be uploaded to e-Builder in two formats, .pdf and AM files. The .pdf will consist of one file of the entire plan set. The AM will consist of individual files, one for each plan sheet, and will be numbered and named in a manner similar to that of the plan set index. • The ENGINEER shall sell contract documents and maintain a plan holders list on e-Builder from documents sold and from Contractor's uploaded Plan Holder Registrations in e-Builder. The ENGINEER will develop and implement procedures for receiving and answering bidders' questions and requests for additional information. The procedures shall include a log of all significant bidders questions and requests and the response thereto. The log shall be housed and maintained in the project's e-Builder folder titled Request for Information. The ENGINEER will provide technical interpretation of the contract bid documents and will prepare proposed responses to all bidders' questions and requests, in the form of addenda. The ENGINEER shall upload all approved addenda onto e-Builder and mail addenda to all plan holders. • Attend the prebid conference in support of the CITY. • Assist the CITY in determining the qualifications and acceptability of prospective contractors, subcontractors, and suppliers. • When substitution prior to award of contracts is allowed in the contract documents, the ENGINEER will advise the CITY as to the acceptability of alternate materials and equipment proposed by bidders. • Attend the bid opening in support of the CITY. • Tabulate and review all bids received for the construction project, assist the CITY in evaluating bids, and recommend award of the contract. A copy of the Bid Tabulation and the CFW Data Spreadsheet created utilizing CFW Bidtools only are to be uploaded into the project's Bid Results folder on e-Builder. 6.2 Final Design Drawings City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 7 of 13 ATTACHMENT DESIGN SERVICES FOR EAGLE MOUNTAIN WATER TREATMENT PLANT PHASE IV EXPANSION CITY PROJECT NO.: 105176 • Final Design Drawings shall be submitted in both Adobe Acrobat PDF format (version 6.0 or higher) format and DWF format. There shall be one (1) PDF file and one (1) DWF file for the TPW plan set and a separate PDF and DWF file for the Water plan set. Each PDF and DWF file shall be created from the original CAD drawing files and shall contain all associated sheets of the particular plan set. Sinqular PDF and DWF files for each sheet of a plan set will not be accepted. PDF and DWF files shall conform to naming conventions as follows: 8. TPW file name example — "W-1956—org47.pdf" where "W-1956" is the assigned file number obtained from the CITY, "_org" designating the file is of an original plan set, "47" shall be the total number of sheets in this file. Example: W-0053_org3.pdf and K-0320_org5.pdf II. Water and Sewer file name example — "X-35667_org36.pdf" where "X- 35667" is the assigned file number obtained from the CITY, "_org" designating the file is of an original plan set, "36" shall be the total number of sheets in this file. Example: X-12755_org18.pdf Both PDF and DWF files shall be uploaded to the project's Final Drawing folder in e-Builder. 2) In addition to the PDF and DWF files, the ENGINEER shall submit each plan sheet as an individual DWG file with all reference files integrated into the sheet. If the plans were prepared in DGN format, they shall be converted to DWG prior to uploading. The naming convention to be used for the DWG files shall be as follows: 8. TPW files shall use the W number as for PDF and DWF files, but shall include the sheet number in the name — "W-1956_SHT01.dwg", "W- 1956_SHT02.dwg", etc. II. Water and Sewer file names shall use the X number as for PDF and DWF files, but shall include the sheet number in the name — "X- 12155_SHT01.dwg", "X-12755_SHT02.dwg", etc. For information on the proper manner to submit files and to obtain a file number for the project, contact the Department of Transportation and Public Works Vault at telephone number (817) 392-8426. File numbers will not be issued to a project unless the appropriate project numbers and fund codes have been assigned and are in the Department of Transportation and Public Works database. DELIVERABLES A. Addenda B. Bid tabulations C. Recommendation of award D. Construction documents (conformed, if applicable) TASK 7. CONSTRUCTION PHASE SERVICES — Not Included. TASK 8. PERMITTING AND FUNDING COORDINATION —Amended as follows. ENGINEER will coordinate with the following permitting and funding stakeholders for this project: • Texas Water Development Board (TWDB) — For project funding. • Texas Commission on Environmental Quality (TCEQ) — To obtain approvals for the EMWTP expansion and necessary exceptions to the Rules and Regulations. • Please note that coordination activities with these agencies will extend past the PDR completion deadlines and into the Final Design schedule and future amendment work. 8.1 Stakeholder Coordination Meetings — Modified in Amendment 2. Coordinate with the identified agencies and entities as necessary for the design of the proposed infrastructure and provide and obtain information needed to prepare the design. This includes two coordination meetings with TCEQ (one near the start of the project, one at 30% design) and TWDB. With respect to coordination with permitting authorities, ENGINEER shall communicate with permitting authorities such that their regulatory requirements are appropriately reflected in the designs. ENGINEER shall work with regulatory authorities to obtain approval of the designs, and make changes necessary to meet their requirements, as part of the design scope. 8.2 PDR Submittal — No change from original scope. 8.3 CT Study — No change from original scope. City of Fort Worth, Texas Attachment A PMO Release Date: 08.1.2014 Page 9 of 13 ATTACHMENT DESIGN SERVICES FOR EAGLE MOUNTAIN WATER TREATMENT PLANT PHASE IV EXPANSION CITY PROJECT NO.: 105176 8.4 Membrane System Approval — Added in Amendment 2. CITY will procure additional membrane equipment for installation as part of the EMWTP expansion. ENGINEER will coordinate with the selected membrane filter manufacturer to obtain operating parameters of the new system and submit necessary information to TCEQ for approval. The parameters and operations to be confirmed include: number of membrane units and modules installed; square footage of modules; pre-treatment train processes; membrane backwash cycle procedure; membrane enhanced filtrate maintenance wash procedure; minimum membrane chemical CIP frequency and duration; and filtrate flux rate. ENGINEER will also confirm membrane rack and module characteristics and properties related to direct integrity testing (DIT) calculations. This information will be submitted to TCEQ for approval. 8.5 Final Design Submittal — Added in Amendment 2. Engineer will review and submit documents to be in compliance with Texas Commission on Environmental Quality (TCEQ) Rules and Regulations. Engineer will meet with TCEQ in Austin as part of Task 7.1 to review specific critical design items for the Eagle Mountain WTP to facilitate timely review and approval. The agreement was subsequently revised by Amendment No. 1 with a net total amount of $0.00 administratively authorized on July 16, 2024 that allowed for replacing the work task for unit process evaluation with the work task for Environmental Permitting and Texas Water Development Board report document. This Mayor and Council Communication (M&C) is to authorize the final Design of Eagle Mountain Water Treatment Plant 35 MGD Expansion and Pump Station 2 project. The proposed expansion project will increase the plant's design capacity from between 35 and 50 million gallons per day and master plan the site for a future ultimate build out of 200 million gallons per day.
