FIRST AMENDMENT
TO CITY SECRETARY CONTRACT NO.61721,
EASEMENT ENCROACHMENT LICENSE AGREEMENT
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 61721,
EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and
between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas
("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or
Development Services Department Director, and MCMASTER-CARR SUPPLY COMPANY, an
Illinois corporation ("Licensee"), acting herein by and through its duly authorized Vice President.
RECITALS
WHEREAS, City and Licensee made and entered into City Secretary Contract No.61721 on
August 91", 2024 (the "Agreement'), to authorize Licensee use of a City drainage easement ("Public
Property") for the purposes of private storm drain connections; and
WHEREAS, the City owns a sanitary sewer, storm sewer and floodplain easements (the "Public
Property") adjacent to the Property, as shown, recorded in the plat records of Denton County, as plat
number FP-23-132 and Denton County Deed records, as Document Number 2024-282; and
WHEREAS, the parties wish to amend the Agreement to include a fence, which will encroach in,
on, above, or below the Public Property; and
WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the
Agreement to revise "Exhibit A" in the Agreement to depict the revised encroachment area.
NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized
representatives, enter into the following that amends the Agreement:

1.
"Exhibit A" in the Agreement is hereby replaced with the attached revised description of the
encroachment area, labeled as "Revised Exhibit A." The definition of "Encroachment" in the Agreement
is hereby amended to include both private Storm Water Connections and a fence.
2.
The effective date of this Amendment shall be the date of its execution by the City.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain in
full force and effect.

ENCROACHMENT
BEING a line segment situated in the Thomas Epps Survey, Abstract No. 395, City of Fort Worth, Denton County,
Texas;
BEGINNING at a point in the west line of Lot 2, Block 8, Gateway North Addition, an addition to the City of Fort Worth
according to the plat recorded in Instrument No. 2024-282 of the Official Public Records of Denton County, Texas,
from which a 1-inch iron rod found for corner in the said west line bears South 00046'07" East, a distance of 317.33
feet;
THENCE North 00046'07" West, along the said west line, a distance of 22.38 feet to the POINT OF TERMINATION,
from which a 5/8-inch iron rod with cap stamped "PELOTON" found for the most westerly northwest corner of said Lot
2 bears North 00046'07" West, a distance of 770.01 feet.
