TO CITY SECRETARY CONTRACT No. 54939
WHEREAS, the City of Fort Worth (CITY) and BGE Inc., (ENGINEER) made
and entered into City Secretary Contract No. 54939, (the CONTRACT) which
was authorized M&C 20-0856 on the 17th day of November, 2020, in the amount
of $99,880.00; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Sanitary Sewer Main Extension on Misty's Run £rom Keller Hicks Road
to Old Denton Road, CPN 103030; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $35,619.00(Sewer).
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $135,499.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

As requested, BGE has developed a scope and fee pc�oposal for the evaluation of the trench bacicfill
for Misty's Run fi•om Keller Hicks Road to Old Denton Road.
Proposed Project Scope
We propose to evaluate the trencl� bacicfill matet�ial and verify the use of the trench geoteXtile fabi�ic
at 3 locations throughout the treuch alignment. These objectives will be accomplished by performing
3 test pits under the supeivision of a geotechnical engineering sub-consultant. Pavement settlement
will be uleasuced using a straiglit edge before pet•fol•ining the test pits. These test pits will penetrate
appt•oximately 7 feet below the existing pavemeut oi• Lultil encountering the geotextile fabric or
crushed stone embedment material.
A flat bucket head will be used for eacavation to minimize soil disturbance, and in-situ density and
moisture content will be measured at appi•oYimately 1-foot intervals using a nuclear density gauge.
Also, we propose to push 2 Shelby tubes at each test pit location to obtain undistut•bed samples for
in-situ density and moisture content measurements. A bag sample will also be collected fi�om each
test pit to determine maYimum diy density and optiinum moisture content per ASTM D 698. The test
pits will also be used to vei•ify the use of trencl� geotextile fabi•ic between the trench backfill and the
crushed rock embedment material. Based on the measured densities and the measured pavecnent
settlement, the density of trench backfill material will be bacl<-calculated and compared with the
specified compaction requirements.
Assumptions
The proposed scope of work is based on tlie City of Fort Worth providing a contractor to perform
excavation of the test pits in the presence of oui• geotechnical engineer and technician

will be responsible for backfilling and cotnpacting the excavated material and patching the pavement
to the satisfaction of the City of Fort Woi�th inspectors. Ouc• proposed fee estimate is based on the
assumption tliat eacli test pit can be pei•formed, backfilled/compacted, and patched within 1 day (a
total of 3 days to perform a113 test pits).

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 in the amount of $35,619.00, to City Secretary Contract
No. 54939, an engineering agreement with BGE, Inc, for the Sanitary Sewer Main Extension on
Misty's Run project for a revised contract amount of $135,499.00; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water and Sewer Capital Projects Fund in the amount of $35,619.00, transferred from available
PayGo funds within the Water and Sewer Fund, for the purpose of funding the Sanitary Sewer Main
Extension Misty's Run project (City Project No. 103030) and to effect a portion of Water's
contribution to the Fiscal Years 2024-2028 Capital Improvement Program.
DISCUSSION:
On November 17, 2020 Mayor and Council Communication (M&C) (20-0856), the City Council adopted
an Appropriation Ordinance in the amount of $140,080.00 for the purpose of funding Sanitary Sewer Main
Extension on Misty's Run from Keller Hicks Road to Old Denton Road.
The $140,080.00 included funding in the amount of $99,880.00 for an engineering agreement with BGE,
Inc. (City Secretary Contract No. 54939) to prepare plans and specifications for the project and
$48,200.00 for project management, utility coordination and material testing. On November 9, 2021,
(M&C 21-0873) a construction contract was awarded to Reyes Group Ltd for installation of the sewer
work. Subsequent to completion of the work and final restoration of the pavement surface, the roadway
began to settle. The City has refused to accept the project from the contractor. The Water Department has
used other contracts to install remedial pavement measures along Misty's Run.
Amendment No.1 will provide for excavation and evaluation of the trench fill material to determine if it was
properly placed and compacted and to provide a permanent solution.
It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY),
instead of within the annual budget ordinance, as projects commence, additional funding needs are
identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of
the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvement Program, as
follows:

The amendment for this project was not reviewed by The Business Equity Division for a business equity
goal, as it was anticipated to be under the $100,000.01 threshold.
This project is located in COUNCIL DISTRICT 10.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water & Sewer Fund and upon
approval of the above recommendations and adoption of the attached appropriation ordinance, funds will
be available in the W&S Capital Projects Fund, for the SS Extension on Misty's Run project. Prior to any
expenditure being incurred, the Water Department has the responsibility to validate the availability of
funds.
