TO CITY SECRETARY CONTRACT No. 50312
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 50312, (the
CONTRACT) which was authorized M&C C-28566 on the 30th day of January,
2018,in the amount of $3,099,361.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No.1 in
the amount of $229,755.00 authorized by M&C C-29067 on March 19th, 2019,
Amendment No.2 in the amount of $366,004.00 authorized by M&C C-29178 on
June 25th, 2019, Amendment No.3 in the amount of $211,344.00 authorized by
M&C 20-0137 on March 3rd, 2020, Amendment No. 4 in the amount of $392,668.00
authorized by M&C 20-0460 on June 23rd, 2020 and Amendment No. 5 in the
amount of $323,249.00 authorized by M&C 22-0290 on April 12th, 2022; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Lake Arlington Lift Station and Force Main, CPN 100995; and
WHEREAS, it has become necessary to execute Amendment No.6 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $1,511,941.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $6,134,322.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Freese and Nichols, Inc. (FNI) is providing this proposal to amend the Engineering Design Services and
Construction Services for the Lake Arlington Lift Station and Force Main (City Project Number 100995).
The following fee includes the costs for permitting changes and updates, archeological survey and
construction monitoring, work effort changes due to schedule delay, bank stabilization redesign,
resident construction representation for the force main, and design and construction work for the M-
503 emergency repair. FNI records show that this proposal would serve as Contract Amendment No. 6.

Lake Arlington Lift Station and Force Main

Amendment No. 6- Scope of Work
Amendment No. 6 proposes to cover work for the expedited delivery of the Lake Arlington Force Main
Parts 1 and 2, following a 2-year delay of work to accommodate easement acquisition. FNI was notified
to proceed with completing the final design in February 2024. The project was first issued for bid and
began advertising in March 2024. Contract documents will be reissued for bid June 2024 and opened
July 2024.
Work included in this amendment pertains to changes in City, State and Federal permitting and their
respective work requirements, additional work due to schedule delays, providing resident project
representation for construction, and emergency M-503 work.
TASK 1— Permitting Updates
a. USACE Nationwide Permit 58 Preconstruction Notification (PCN)
This project was originally permitted under NWP 12 (now NWP 58) with no PCN submittal. At
that time there were no threatened/endangered (T/E) species issues with the alignment.
However, since that time the tricolored bat (TCB) and alligator snapping turtle (AST) have been
proposed for listing, and each have potential habitat issues along the alignment. TCB habitat
includes forested areas and AST habitats include aquatic features and terrestrial habitat near
aquatic features.
FNI will prepare and submit Nation Wide Permit 58 PCN. FNI will coordinate a pre-application
meeting between the USACE and City to seek guidance from the regulatory division on
requesting an emergency permit due to the interceptor failures. FNI will coordinate with the
contractor and City to follow habitat guidance provided by the Fort Worth District until the
species are officially listed. If they are listed, FNI will immediately report updated federal
guidance to Contractor and City.
b. City of Fort Worth Urban Forestry Permit
FNI worked with the City of Fort Worth Urban Forestry department to gain clarification on the
process to apply the Urban Forestry Permit requirements to the force main. Due to the delay in
the overall project, trees have increased in size, gone into decline, and canopy coverage has
changed. Additional work included:
• Desktop review of updated aerial photographs to recalculate possible tree canopy
coverage
• Rework of mitigation fee worksheet
• Additional site visits to verify significant trees
• Multiple meetings with urban forestry department to clarify standards for applying the
UFP to linear projects

Due to the limited application of the permit language to linear projects, FNI will provide a
Certified Arborist to work with the Urban Forestry team and contractor to identify and verify
significant trees and tree canopy limits for both the phase 1 and phase 2 permitting during
construction. The Arborist will work with the contractor during construction to identify locations
to implement tree protection and/or mitigation to complete the permit, determine replanting
requirements and/or mitigation fees, and observe its requirements.
Assumptions:
• No more than one week of field investigation of existing conditions for both parts 1 and
2
• Up to two 8-hour site walks per phase per project (part 1 and part 2 are assumed to be
separate projects)
• Up to two 2-hour virtual meetings with the City and contractor per phase per project
(part 1 and part 2 are assumed to be separate projects)
• A replanting plan is an additional service
Task 2— Archeological Survey & Construction Monitoring
Amaterra performed expedited field survey including additional mechanized trenching and shovel
testing efforts completed in March 2024. Field survey included investigation of additional locations
based on updated THC-approved trenching guidelines, which are more stringent requirements than
required during the original project timeframe.
The Texas Historic Commission has provided conditional approval of the permit but is requiring
construction monitoring to be performed by an archaeologist near two identified gravesites and
cemeteries. FNI and Amaterra will prepare a new Texas Antiquities Permit Application for the proposed
construction monitoring. The permit application form and scope of work will be submitted to the THC
for approval and a permit number. Schedule will be coordinated to allow access to the construction site
during the work in the areas identified by THC. The monitoring team will be present on site while the
construction activities take place, looking for any disturbances to the natural soil within the construction
area. Monitors will observe all excavation machines as they conduct their work. If human remains or
funerary objects are discovered during the project, all ground-disturbing work at that location will be
stopped and the City of Fort Worth and the THC will be notified immediately. Upon this notification, the
City will request assistance in developing a work plan for the appropriate and respectful identification,
analysis, and treatment of the human remains.
After discovery, further exploratory investigations may be performed around the discovery site within
the project limits to determine whether other burials are present nearby. The purpose of these
investigations will be to determine whether the burial is an isolated occurrence or part of a larger group
of burials associated with the nearby cemetery. After all the investigations within the project area have
been performed and burials located, a Notice of an Abandoned Cemetery will be filed with the Tarrant
County Clerk according to the provisions in the Texas Health and Safety Code. A supplemental request
will then be submitted to develop a burial work plan, with input from the City and the THC.

A cultural resources survey report will be prepared that follows CTA/THC report guidelines and
summarizes the historical background, previous investigations, site conditions, field methodology,
monitoring results, conclusions, and recommendations. The next steps of investigation will be
recommended based on the results of the monitoring. Site photographs and maps of all subsurface
observations will be included in the report. The draft report will be submitted to FNI and the City for
review and then to the THC. Once approved a final report will be submitted to close the permit. All
project records will be submitted to the Texas Archaeological Research Laboratory (TARL) in Austin for
curation.
Assumptions:
• The project is subject to Section 106 and the ACT.
• The project area matches the description presented in the draft report for the Lake Arlington
Force Main Pipeline Project, dated April 15, 2024.
• Only two cemetery locations will be monitored.
• Field monitoring will be completed in no more than 6 field days for the Field Director, and 2 field
days for the Principal Director/Bioarchaeologist, including travel, pedestrian inspection, and
shovel testing.
• Work can be completed in no more than two round trips for the Field Director and one round
trip for the Principal Investigator.
• Right of entry at the time of field investigations with all access coordinated by others prior to
initiating fieldwork. If escorts are required, they will be provided by others and will be available
on a standard work-week schedule (Monday-Friday 8 AM — 5 PM).
• No collection of any artifacts for curation. Any displaced remains/artifacts or materials
• will be field recorded, then returned to their find location.
• One round of review and revision for each deliverable.
Task 3— Work Changes Due to Delay and Expedited Project Effort
Due to the project delay from an assumed complete date of March 2022 and expedited restart in
February 2024 and actual complete date of June 2024, additional effort and costs were incurred
including:
• PM reporting extension of 45 months with a force main design extension of 15 months.
o March 2022 was the anticipated date for complete design per Amendment No 5
o July 2023 was the end of the scheduled reporting per Amendment No. S
o Design was completed June 2024
o Construction is anticipated to take 30 months with award anticipated Aug 2024 and NTP
Oct 2024
• FNI met with FW Water weekly to discuss and track outstanding items, address questions, and
provide background on status items as requested.
• Plans were modified to include up-to-date Fort Worth standards that had changed since the
project was placed on hold.
o The City requested the aerial crossing design be revised to extend the casing and piers
to maintain aerial pipe beyond the northeastern horizontal bend at the lake crossing.

Elevating the horizontal bend and designing to resist forces within and elevated and
cased alignment required significant coordination, calculations, and design approach
changes with the design team and pipe manufacturers beyond what was anticipated.
The engineering and coordination effort required above and beyond what effort was
assumed for a buried horizontal bend is included in this amendment.
• Specifications were modified to include up-to-date Fort Worth standards that had changed since
the project was placed on hold.
• Plans were Issued for Bid on March 21, 2024. FNI attended a prebid meeting, reviewing
contractor qualifications, responded to contractor questions, and assisted the City in issuing
addenda.
• FNI Re-issued all plans and specifications for Bid on June 5, 2024
o All plans and specifications were revised to remove indicators of addenda issued during
the first bid period and resealed for bid
o FNI assisted in a second pre-bid conference, answering contractor questions, and issuing
additional addenda.
Additionally, the Lake Arlington lift station was constructed in 2020. Due to the delay in the force main
project issuance for bid, the lift station could not be operationally tested.
• FNI provided additional RPR for the lift station to work between the contractor and City and
determine a closure and acceptance process for the lift station. FNI prepared multiple
closeout scenarios for the lift station, considering testing, warranties, and ownership
options and potential outcomes. This amendment includes a part-time lift station RPR effort
extension of S months, from the original completion date of July 2022 to Dec 2022.
• Once the construction of the force main is completed the lift station will need to be
operationally testing. This amendment includes up to one week (40 hours) of Engineering
and RPR assistance with operational testing for the lift station once the force main is
substantially complete and connected to the system.
Task 4— Bank Stabilization Redesign
Due to continued erosion, the existing aerial crossings experienced additional exposure, which needed
to be accounted for in a modified design. The limits of the bank protection were adjusted and accounted
for the changes to the site. Additionally, the City requested that FNI design a culvert crossing along a
newly constructed section of the pipeline where erosion was threatening the manhole and maintenance
pad. FNI sized and provided sheets to construct the culvert crossing.

FNI will provide up to three 4-hour site visits, including travel, to observe construction, answer
questions, and provide clarifications relating to the plans and specifications. Up to two sheet revisions
are anticipated to respond to RFIs.
Task 5— Full-Time Construction Resident Representation (RPR)
For the construction phase of the Lake Arlington Force Main, Freese and Nichols (FNI) proposes to
provide a full-time (defined as 10 hours per day (including travel time), 5 days per week) Resident
Project Representative (RPR) on-site during the 30-month construction schedule to perform the
following services:
• RPR will act as the Owner/Engineer agent at the site and be supervised by the Engineer-of-
Record (EOR).
o FNI recognizes that the CITY may have INSPECTORS at the site during construction. RPR will
coordinate with the CITY INSPECTORS daily.
o RPR will coordinate with other on-going contracts the CITY may have related to the
construction of the Force Main (i.e. gravity sewer and lift station startup).
o FNI assumes that the CITY will contract directly with a construction material testing firm in
these services. RPR will coordinate with the CONTRACTOR the CMT activities at the site.
• Review contractor baseline schedule, schedule of values, and submittal schedule and consult
with EOR concerning acceptability.
• Attend the pre-construction meeting and regularly scheduled construction progress meetings
and distribute meeting minutes to the Owner Project Team (OPT) consisting of the Owner,
Contractor, and Engineer. Serve as liaison between the Contractor and EOR/Owner.
• Confirm that shop drawings are submitted/approved before any work requiring shop drawing
approval progresses.
• Conduct on-site investigations of the Work in progress to determine if the Work is in general
conformance with the Contract Documents (CD)
o Report to the EOR any Work that the RPR believes does not comply with the CDs or any test
reports that indicate materials do not meet the specified requirements
o Verify that tests, equipment/system start-ups and training are conducted in the presence of
appropriate personnel
o Accompany visiting inspectors representing the Owner or other agencies having jurisdiction
over the project and record the results of these inspections

• Assist the EOR when clarifications/interpretations of the CDs are needed and transmit to the
Contractor any clarifications/interpretations.
• Assist the EOR in the consideration and evaluation of Contractor initiated changes to the CDs
and draft change orders, field orders or written amendments to be executed and made part of
the CDs.
• Furnish daily construction reports of the progress of the Work and upload these reports in
the City of Fort Worth eBuilder system.
• Report to Owner and EOR immediately the occurrence of any accidents at the site.
• Review application for payment submitted by the contractor for compliance with the
established procedure and forward with recommendations to the EOR for processing and
signatures noting particularly the relationship of the payment request to the schedule of values,
Work completed and materials/equipment at the site but not incorporated in the Work.
• Before Substantial Completion, submit to the contractor a list of observed items requiring
completion or correction.
• Conduct, in the presence of the OPT, a final inspection and prepare a list of items noted that
require correction.
• Observe whether all items listed for correction are corrected and make recommendation to the
EOR/Owner concerning final acceptance of the Work
• Limitations of the RPR
o Shall not authorize any deviation from the Contract Documents or substitution of materials
or equipment (including "or-equal" items), unless authorized by Engineer.
o Shall not exceed limitations of Engineer's authority as set forth in Agreement or the Contract
Documents.
o Shall not undertake any of the responsibilities of Contractor, Subcontractor, Suppliers, or
Contractor's superintendent.
o Shall not advise on, issue directions relative to or assume control over any aspect of the
means, methods, techniques, sequences, or procedures of construction unless such advice or
directions are specifically required by the Contract Documents.
o Shall not advise on, issue directions regarding or assume control over safety precautions and
programs in connection with the Work or any activities or operations of Client or Contractor.
o Shall not accept shop drawing or sample submittals from anyone other than the Contractor.
o Shall not participate in specialized field or laboratory tests or inspections conducted by others,
except as specifically authorized by Engineer.
Task 6— M-503 Emergency Repair
Design of 1,060 linear feet of 54-inch sewer line near 7000 East Rosedale Street. The sewer line design
will include a plan and profile of the sewer line emergency replacement, a site-specific erosion control
plan, and applicable City standard details. A structural evaluation of temporary stabilization and
development of the erosion control plan is also included.

• Up to six meetings with City staff and/or the emergency contractor

Task 7— M-195 Emergency Repair
Design of 600 linear feet of 24-inch sewer line across Southwest Loop 820 near Thelin Street. The sewer
line design will include plan and profile of the 24" sewer line replacement and applicable City standard
details. A geotechnical investigation as required for the tunnel design is also included.
Project management includes internal and external communication, design direction, quality control,
meetings with the CITY, coordination with TxDOT on the permitted roadway crossing, coordination with
Haltom City on permitting requirements.
General representation for construction support will include shop drawing reviews, site visits, reviews
and responses of RFIs, a final punch list, and record drawings.
Personnel and Vehicle Identification: When conducting site visits to the project location, the ENGINEER
or any of its sub-consultants shall carry readily visible information identifying the name of the company
and the company representative.
Assumptions
• Up to two meetings with City staff.
• 3 monthly Water Department progress reports and schedule updates will be prepared.
• PDF copies of the design package will be delivered.
• FNI will provide documentation and exhibits, the CITY will submit the TxDOT application.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a contract with Belt Construction of Texas, LLC in the amount of
$59,657,497.33 for the Lake Arlington Lift Station, Force Main, and Sanitary Sewer Mains Project
Parts 1 and 2;
2. Authorize execution of Amendment No. 6 to City Secretary Contract No. 50312, an Engineering
Agreement with Freese & Nichols, Inc., in the amount of $1,511,941.00 for construction support
services for the Lake Arlington Lift Station Force Main, and Sanitary Sewer Mains project for a
revised contract amount of $6,134,322.00 (City Project No. 100995);
3. Adopt the attached Resolution expressing official intent to reimburse expenditures with proceeds
from future debt for the Lake Arlington Lift Station, Force Main, and Sanitary Sewer Mains project;
and
4. Adopt the attached Appropriation Ordinance adjusting appropriations in the Water and Sewer
Commercial Paper Fund by increasing appropriations in Lake Arlington Lift Station, Force Main, and
Sanitary Sewer Mains project (City Project No. 100995) in the amount of $63,066,715.00 and
decreasing appropriations in the W&S Commercial Paper project (City Project No. UCMLPR) by the
same amount, to effect a portion of Water's contribution to the Fiscal Years 2024-2028 Capital
Improvement Program.

DISCUSSION:
On January 30, 2018, Mayor and Council Communication (M&C) C-28566 authorized an engineering
agreement with Freese and Nichols, Inc., (City Secretary Contract No. 50312) in the amount of
$3,099,361.00 for the preparation of plans and specifications for the Lake Arlington Lift Station and Force
Main project. The agreement was subsequently revised by Amendment No. 1 in the amount of
$229,755.00 (M&C C-29067, March 19, 2019) that provided for the design of 1,000 linear foot aerial
crossing of the force main across Lake Arlington and additional geotechnical investigations at 8 locations
along the force main; Amendment No. 2 in the amount of $366,004.00 (M&C C-29178, June 25, 2019) that
provided for the preparation of plans and specifications for additional tunneling design, archeological
survey, additional survey along Quail Road, lead testing along lift station access road and design for
erosion improvements on Village Creek Tributary near Salt Road; Amendment No. 3 in the amount of
$211,344.00 (M&C 20-0137, March 3, 2020) that provided for preparation of additional temporary and
permanent easement documents, urban forestry permit application, and additional subsurFace utility
engineering (SUE) services, Amendment No. 4 in the amount of $392,668.00 (M&C 20-0460, June 32,
2020) that provided for resident project representation (RPR) and start up assistance on Lake Arlington
Lift Station; and Amendment No. 5 in the amount of $329,249.00 (M&C 22-0290) April 12, 2022 that
provided for additional easement acquisition assistance, plan redesigns, aerial crossing design and
additional resident project representation support.
Amendment No. 6 provides for construction management, resident project representative, and
construction support services including shop drawings, submittal reviews, change order review,
archeological monitoring tracking, and record drawings.
Construction of the project was advertised for bid on June 06, 2024 and June 13, 2024 in the Fort Worth
Star-Telegram. On July 18, 2024 the following bids were received:

*The bid submitted by McKee Utility Contractors, LLC for Part 2 has been determined to be non-
responsive due to failure to submit the required M/WBE documentation within the required time period
after bid submittal.
The project was advertised in two parts with the City reserving the right to award contracts to the
respective responsive low bidders of Parts 1 and 2 or to the responsive bidder of both parts combined.
Staff recommends the award of the combined project to Belt Construction of Texas, LLC in the amount of
$59,657,497.33.
In addition to the contract cost, $1,356,717.00 is required for project management and inspection and
$540,559.00 is provided for project contingency.
This project will have no impact on the Water Department operating budget when complete.
Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation
authority authorized under the Callable Commercial Paper Program (CP) will be used to provide interim
financing for this project until debt is issued. Once debt associated with this project is sold, bond proceeds
will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the
attached Reimbursement Resolution. Under federal law, debt must be issued within approximately three
years in order for these expenses to be reimbursable. Adoption of the attached resolution does not
obligate the City to sell bonds, but preserves the ability of the City to reimburse itself from tax-exempt
bond proceeds.
It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan
throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence,
additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will
appropriate funds in support of the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028
Capital Improvement Program.

Business Equity: The Business Opportunity Division placed a�6 percent business equity goal on this
solicitation/contract. Belt Construction of Texas, LLC, has agreed/committed to utilize 16.68
percent business equity subcontractor participation for the scope of work, meeting the City's Business
Equity Ordinance. Any changes in subcontractors will be reviewed by the Business Equity Division.
Business Equity: Business Equity placed a 12.90 percent business equity goal on this project. Freese
and Nichols, Inc., is committing to 3.63 percent MWBE participation, and Good Faith Effort (GFE) with
supporting documentation was submitted, which is in accordance with the City's Business Equity
Ordinance. Any changes in subcontractors will be reviewed by the Business Equity Division.
The project is located in COUNCIL DISTRICTS 5 and City of Kennedale.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds will be available in the Commercial Paper project within the
W&S Commercial Paper Fund and upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the W&S Commercial Paper Fund for the Lake
Arlington FM, LS and SS project to support the above recommendations and execution of the construction
contract and amendment to the engineering agreement. Prior to any expenditure being incurred, the Water
Department has the responsibility to validate the availability of funds.
