RECITALS WHEREAS Licensee i the owner of the real property located at 501 We t Risinger Road, Fort Worth Texas 76140 ('Property') being more particularly described as, Lot 3, Block I, Ri inger South, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Tarrant County Deed Records, by Instrument umber D217135618;and WHEREAS the City owns a sewer easement (the 'Public Property') adjacent to the Property, dedi ated to the City by plat, as depicted on the final plat of the property (FP-20-042) which plat is recorded in the plat records of Tarrant Countv as instrument number D220346237; and WHEREAS, Licensee de ires to construct, place, and maintain certain improvements which will encroach in on above or below the Public Property; and WHEREAS, to accommodate then ed of the Licensee the City will allow th encroachment under the terms and conditions as set forth in this Agreement. NOW, THEREFORE, the City and Licensee agree a follow : AGREEMENT l. The City, in consideration of the payment by Licen ee of the fee set out below and covenants and agreement hereinafter contained to be kept and performed by Licen ee, hereby grants permis ion to Licensee to encroach in on above or below and occupy a portion of the Cit 's Public Property as described in and at the location hown on Exhibit "A" but only to the e tent hown thereon for the purpose of con tructing installing, and maintaining an irrigation line (the "Encroachment"). pon completion of Tier 11 Easement Encroachment greement Page I of 11 Revised 12/2022 tk�e l:ncroachment, l.icensee agrees to be responsit�le for maintaining the I:ncroacllment ���ithin the Public Property. 1_iccnsee shall naE expand or otherwise cause the Encraachment to further inFrin�c in or o�i thc f'ublic Property beyond what is speciE7cally described in Exhibit "A." 2. All constructi<�n, installation. �naintenancc, and operation of the Encroach�i�ent and the use or occupancy ai� the Puhlic Property shall comply with and be performed in strict coTnpliance witE� this Agreement and ���ith the charter, ordinances. cades. and policies of the Cic�. Prior to the construction or instaliatioE� af the Encroachment, Licensee shall subrrit all plans and speciiications to the Director of the Develo�ment Services Departmcni or duly authorized representative. Lic�nsee shall not cornmence construction or installation of the Encroact�mcnt nor make any use of the Puhlic Property until after the execution of�this Agreement. 3. Lice«see, at no e�cpense to the City, shall makc proper pravisians tor thc relocatio� and installation of anti existing or future uti�ities af_lected by such Encroachment anci the use and occupancy of� the P��blic Yro�ertti, including the securin� the approvai and conser�t of thc ap}�ropriatc utiEity companies and a�enci�s of thc State of Texas and its political subdivisions. I« thc cvcnt that any installation, rcinstallation, relocation, ar repair o1� aR}� existing or future utilit� or imprc�vetnenCs owned by or canstructcd by or on behalf af the public or at public expense is made more cc�stly by virt�i� of the construction, maintcnance, or exister�ce of the 1=,ncroac�m�nt and use of Public E'roperty, L.icensee shall pay to City an additianal amount cqual to sucE� additional cost as detennined hy th� Director of'I�ransportatior� and I'ublic Warks, the Director of the Water Department, the Director of the Dcve[�pment Serv�ces Departmcnt, or ti�eir duly auEharized represenkati�e. �. 'I�hc CitJ shall have no responsibility or liabilitv for an� dama�es related to the Ener�achment resultint� fi•o�n th� City's use of the Public Property; however, the City shall make reasonable efforts to minimiie sucl� damage. 5. Ir� order to defray all costs of� inspection and supervision which the City has incurred or will incur as a result of the constr�iction, maintenance, inspectian or management ol� the Encroachment and €�s�; of f'ublic Property as pr���ided for by lhis A��reement, Licensee agrces to pay to Cit}- ai the ti�r�c this Agreement is requested an ap�lication fee in the sum of Nine 1-iundred Do�lars (S90U.00). 7. "['he term af this Agrecmcnt sha{1 be fo� thirty (3U) ycars, commencin�.: on t��e date this Agree�ncnt is executed by City. l3owever. the City may ter�r�inate this Agreement upon Li�ensee's noncampliance with any a�� thc terms of this Agrecment. Licensee agrees to camply fully with all applicab�e federal, state, an� local laws, statutes, ordinanccs, codes, and regulations in connection with the constructinn, operation, and maintena�ce: of the Encrc�achment and usc af the Public i'roperiy. 13. Licensee a�r�es to pay �romptly when duc all fees, taxes, or rentals �rovided for by this A�reement or by any fcderal, state, or local statute, law, ar rebulation. l 4.
