Worth Subdivision Fort Worth, Tarrant County, Texas THIS SUPPLEMENTAL AGREEMENT (the "Supplement") is made as of 10/2/2024 , by and between UNION PACIFIC RAILROAD COMPANY, a Delaware corporation ("Railroad") and the CITY OF FORT WORTH, a municipal corporation or political subdivision to be addressed at 200 Texas Street, Fort Worth, TX, 76102 ("Political Body"). RECITALS By instrument dated September 6th, 2022, Union Pacific Railroad Company and the Political Body entered into an agreement identified by the UPRR Project number above (the "Agreement"). The Political Body has requested a Supplemental Agreement to include an addendum to Exhibit C Railroad Material and Force Account Estimates (the "Exhibit"). AGREEMENT NOW, THEREFORE, IT IS MUTUALLY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: SECTION 1 -AMENDMENT OF THE AGREEMENT Railroad amends the Agreement to include an addendum to the Exhibit. The Agreement Section 7, and the related Exhibit attached to the Agreement, is amended to include an Estimate to cover additional work in the amount of Forty­ Five Thousand and 00/100 Dollars ($45,000.00) as shown on the Exhibit Addendum, attached hereto and hereby made a part hereof as Exhibit to the Agreement, which shall be, and hereby is amended to include the attached Exhibit Addendum. SECTION 2-EFFECTIVE DATE This Supplemental Agreement shall be effective as of the instrument date above.
