HomeMy WebLinkAboutOrdinance 27185-09-2024ORDINANCE NO.27185-09-2024 AN ORDINANCE INCREASING THE TOTAL NUMBER OF AUTHORIZED SWORN POSITIONS IN THE POLICE DEPARTMENT BY TWELVE (12) BY ADDING NINE (9) POSITIONS IN THE CLASSIFICATION OF POLICE OFFICER, AND THREE (3) POSITIONS IN THE CLASSIFICATION OF SARGENT, EFFECTIVE OCTOBER 1, 2024; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 143.021(a), Texas Local Government Code provides that a municipality's governing body shall by ordinance (i) establish the classifications of police officers and (ii) prescribe the number of positions in each classification; WHEREAS, on January 30, 2024, the City Council adopted Ordinance 26706-01-2024, which established the Police Department's sworn personnel staffing levels, effective January 23, 2024, as follows: Assistant Chief 3 Deputy Chief 6 Commander 6 Captain 17 Lieutenant 50 Sergeant 213 Corporal/Detective 262 Police Officer 1,325 Total 1,882 ;and WHEREAS, the Police Chief has requested that the City Council increase the total number of authorized positions in the Police Department by nineteen (19), with one (1) Sergeant position and six (6) Officer positions that were added in connection with COPS Grant (Ordinance 26706- 0 1 -2024) being "converted" from "overage" to regular authorized strength and with such positions the remaining twelve positions consisting of three (3) additional position in the existing classification of Sargeant and nine (9) additional positions in the existing classification of Police Officer, to reflect the Civil Service staffing included in the Fiscal Year 2025 Budget, and thereafter prescribe the number of authorized positions in the Police Department to conform with the Ordinance No. 27185-09-2024 Pagel of 3 proposed changes as set forth below in order to effect efficient economy of the operations of the Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That, following the formal adoption of this ordinance, the following positions shall be the only sworn positions in each classification (rank) authorized in the City of Fort Worth Police Department effective October 1, 2024, until modified by subsequent ordinance: Assistant Chief 3 Deputy Chief 6 Commander 6 Captain 17 Lieutenant 50 Sergeant 216 Corporal/Detective 262 Police Officer 1334 Total 1894 2. That the "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the City Council in its adoption of this ordinance as well as the Department in its implementation. 3. That this ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior police staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. That this ordinance shall be effective October 1, 2024, with respect to the addition of fifteen (15) positions included in the adopted budget as reflected above, and it is so ordained. Adopt the attached ordinance to revise Civil Service staffing in the Police Department, effective October 1, 2024; and 2. Adopt the attached ordinance prescribing the salaries for all peace officers in the Police Department, effective October 1, 2024. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) and the attached ordinances is to take actions associated with the recently adopted Fiscal Year (FY) 2025 Budget for the Police Department. Adoption of the first ordinance will revise Civil Service staffing levels in the Police Department. Approval of this M&C will add a total of 19 Civil Service positions to the budgeted authorized strength in the Police Department (including seven positions being "converted" from overage status) to reflect the FY2025 adopted budget as follows: 1. Fifteen Officer positions for Patrol, Community Outreach, and the School Resource Office Program (six of which are "converted"); and 2. Four Sergeant positions for additional support to the SWAT, Wellness, Community Outreach, and School Resource Officer programs (one of which is "converted'. In January, 2024, seven "overage" positions (6 Officer,1 Sergeant) were authorized outside of the budget process in the Community Outreach Unit in connection with the Police Department receiving a Community Oriented Policing (COPS) grant from the United States Department of Justice (M&C 24-0097, Ordinance 26706-01-2024). As part of the grant approval process in FY2024, the Department stated it would request the positions as part of its authorized strength for FY2025. Adoption of this M&C and the first attached ordinance "converts" those overages into regular authorized positions accounted for as part of the FY2025 authorized strength. The staffing ordinance also adds twelve new positions (3 Sergeants, 12 Officers),to reflect the recently adopted budget. The chart below reflects changes in authorized strength from the most recent prior staffing ordinance (Ordinance 26706-01-2024). 024). This ordinance reflects the salary schedule for the "evergreen" period of the Meet and Confer tabor Agreement (MCA) (M&C 20-0356; CFW Contract No. 543566). Negotiations on an updated MCA are currently being finalized. Once the agreement is fully executed a revised salary ordinance with updated schedule will be presented for adoption. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION ! CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the Fiscal Year 2025 Budget by the City Council, funds will be available in the Fiscal Year 2025 operating budget, as appropriated by the General Fund and Crime Control & Prev Distr Fund. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: , The purpose of this Mayor and Council Communication (M&C) is to repeal and readopt an appropriation ordinance for the previously approved ARPA TXAMU Innovation Project (City Project No. 104766) to correct the fund from Grants Operating Federal Fund to Grants Cap Projects Federal Fund. On December 13, 2022, Mayor and Council approved M&C 23-0284 17FW INNOVATIONPARTNERSHIP authorizing the execution of an Interlocal Agreement with Tarrant County and Services Agreement with Fort Worth Now relative to services to be provided that support the future growth and success of the Texas A&M University System and Research and Innovation Hub (Innovation Hub) and allocated American Rescue Plan Act State and Local Fiscal Recovery Funds in the amount of $2,000,000.00 to pay for the services provided under the Services Agreement. Recommendation no. 4 errantly appropriated funding to the Grants Operating Federal Fund rather than the Grants Cap Projects Federal Fund. This M&C will eliminate the original appropriation and appropriate funds correctly within the ARPA TXAMU Innovation Project. The intedocal agreement (City Secretary No. 59240) between Tarrant County and the City of Fort Worth was executed on January 20, 2023. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
