HomeMy WebLinkAboutIR 9575 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 9575 To the Mayor and Members of the City Council July 23, 2013 `�` Page 1 of 1 r SUBJECT: PROPOSED ZONING ORDINANCE TEXT AMENDMENTS RELATING rF TO MODEL HOMES, FRONT-YARD SETBACKS AND COTTAGE FOOD PRODUCTION Staff is proposing minor amendments to the Zoning Ordinance relating to model homes, front-yard setbacks and cottage food production. The purpose of the amendments is to increase development flexibility and to reduce the number of routinely approved variance cases. Specifically, the amendments would do the following: • Allow model homes to be built in neighborhoods platted within the past five years rather than just the past two years, and allow them to be 500 feet from an arterial street rather than only 300 feet. Also allow model homes to remain five years rather than just three years. • Remove the 20-foot minimum front-yard setback in "E" Neighborhood Commercial zoning. Retain the projected front-yard requirement from adjacent residential districts. • For the minimum residential front-yard setback, clarify that the consideration of adjacent home setbacks only applies if at least 40% of the block face is improved and if the adjacent home is not on a cul-de-sac. • For home occupations involving cottage food production, allow direct sales to customers from the home in order to reflect a change in state law (HB 970). Staff has briefed the Boards of Adjustment, Zoning Commission and Development Advisory Committee on these proposed amendments. Staff also sent an a-news bulletin to development stakeholders and registered organizations. No opposition has been expressed to date. Public hearings on the amendment would be held by the Zoning Commission on August 14, 2013, and by the City Council on September 10, 2013.
