HomeMy WebLinkAboutOrdinance 27053-08-2024Ordinance No. 27053-08-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER & SEWER REVENUE BONDS SERIES 2021, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SANITARY SEWER MAIN M-245B & M-279 REPLACEMENT PROJECT (CITY PROJECT NO.103497) IN THE AMOUNT OF $3,268,208.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED ALIT FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water & Sewer Revenue Bonds Series 2021, by increasing estimated receipts and appropriations in the Sanitary Sewer Main M-245B & M-279 Replacement project (City Project No.103497) in the amount of $3,268,208.00 and decreasing estimated receipts and appropriations in the Unspecified All - Funds project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and aII other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with S.J. Louis Construction of Texas, LTD., in the amount of $2,893,650.00 for part 1 of the Sanitary Sewer Main M-245B & M-279 Replacement project; and 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Revenue Bonds Series 2021 by increasing estimated receipts and appropriations in the Sanitary Sewer Main M-245B & M-279 Replacement project (City Project No.103497) in the amount of $3,268,208.00 and decreasing estimated receipts and appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) by the same amount to effect a portion of Water's Contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: This Mayor and Council Communication (M&C) is to authorize a construction contract with S.J. Louis Construction of Texas, LTD., and appropriate funding for Part 1 of the Sanitary Sewer Main M-245B & M-279 Replacement project, which provides for trenchless rehabilitation slip lining for the existing 60-inch sanitary sewer pipe crossing Union Pacifc Railroad right-of-way South of E. Northside Drive. The project was advertised for bid on May 23 and May 30, 2024 in the Fort Worth Star -Telegram. On June 13, 2024 the following bids were received: Bidder Total Bid Contract Time S.J. Louis Construction of Texas, $2,893,650.00 750 Calendar LTD, Days Befit Construction, of Texas, LLC $3,195,467.00 In addition to the contract cost, $229,875.00 is required for project management and inspection and $144,683.00 is provided for project contingency. This project will have no impact on the Water Department's operating budget when complete. This project is part of the Water Departments Sanitary Sewer Overflow Initiative Program. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. The Business Opportunity Division placed a 6.86 percent business equity goal on this solicitation/contract. S.J. Louis Construction of Texas Ltd., will be exceeding the goal at 7.15 percent, meeting the City's Business Equity Ordinance. Any changes in subcontractors will be reviewed by the Business Opportunity Division. + The project is located in Council District 9. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified All -Funds project within the W&S Rev Bonds Series 2021 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Rev Bonds Series 2021 Fund for the SS Main M-245B and M-279 REPL project to support execution of the contract. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
