HomeMy WebLinkAboutOrdinance 27052-08-2024Ordinance No. 27052-08-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SANITARY SEWER M 503 REPAIR ON SOUTH ROSEDALE STREET PROJECT (CITY PROJECT NO.1.05408) IN THE AMOUNT OF $4,982,216.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED ALL -FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water and Sewer Capital Projects Fund, by increasing estimated receipts and appropriations in the Sanitary Sewer M-503 Repair on South Rosedale Street project (City Proj ect No.105408) in the amount of $4,982,216.00 and decreasing estimated receipts and appropriations in the Unspecified AII- Funds project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and aII other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Goodall L',City Secretary *O °mod �����00000000 aC7 City of Fort Worth, Texas Mayor and Council Communication DATE: 08/13/24 M&C FILE NUMBER: M&C 24-0676 LOG NAME: 60EMERSSM503REPAIR-CIRCLEC SUBJECT (CD 5) Adopt Appropriation Ordinance in the Amount of $4,982,216.00 for Emergency Sanitary Sewer M-503 Repair on South Rosedale Street to Effect a Portion of Water's Contribution to the Fiscal Years 2024-2028 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance adjusting appropriations in the Water and Sewer Capital Projects Fund by increasing appropriations in the Sanitary Sewer M-503 Repair on South Rosedale Street project (City Project No.105408) in the amount of $4,982,216.00 and decreasing appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) by the same amount to effect a portion of Water's contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: On January 28, 2024 Water Field Operations became aware of a sanitary sewer overflow that was discharging into Lake Arlington. Upon further investigation a collapse was discovered on the City's 54-inch sewer main (M-503) south of Rosedale Street which caused up -stream sewer backup, resulting in overflow at the discharge point in the vicinity of the 3000 block of Quail Street. The segment of the pipe crossing Rosedale Street was also discovered to be deteriorated and blocked with debris further exacerbating the situation. Water Department Field Operation crews are not equipped to handle an emergency of this nature. Under the February 1, 2024 Emergency Authorization (copy attached), the Water Department engaged William J Schultz, Inc. dlbla Circle C Construction Company (Circle C) to conduct the necessary work to replace the sewer main. The emergency work was estimated to be $2,000,000.00 (City Secretary Contract No. 60914). The original plan provided for the existing sewer tunnel to be rehabilitated and put back into service. However, it was determined that the tunnel was too severely deteriorated to be rehabilitated and must be abandoned and removed from service. It was therefore necessary to install a new tunnel across from Rosedale Street which necessitates a tunnel liner plate, additional 54-inch sewer pipe, 6-ft diameter manholes and additional by-pass pumping. Under the April 24, 2024 Supplemental Memorandum (copy attached) to the February 1, 2024 Emergency Authorization, the City authorized additional construction costs in the amount of $2,982,215.21 for the additional work to be performed on the emergency City Secretary Contract (CSC No. 60914-CO1). The contract and work will be billed on a task order basis. Mayor & Council Communication(s) (M&C) will be circulated to ratify the above contract after the work has been performed. With the supplement, the revised contract amount is $4,982,215.21. Section 252.022 of the Local Government Code exempts from normal bidding requirements that are necessary to preserve or protect public health or safety of the municipality's residents and procurements that are necessary because of unforeseen damage to public machinery, equipment or property. The purpose of this M&C is to secure funding to compensate Circle C for work performed and to speed up the pipe replacement project. This is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.
