HomeMy WebLinkAboutOrdinance 27057-08-2024Ordinance No. 27057-08-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER & SEWER REVENUE BONDS SERIES 2021, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WALNUT CREEK SANITARY SEWER EXTENSION PROJECT (CITY PROJECT NO.103414) IN THE AMOUNT OF $3,196,450.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED ALL -FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water & Sewer Revenue Bonds Series 2021, by increasing estimated receipts and appropriations in the Walnut Creek Sanitary Sewer Extension Project (City Project No. 103414) in the amount of $3,196,450,00 and decreasing estimated receipts and appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with Jackson Construction LTD, in the amount of $2,792,412.00, for Phase 2 of the Walnut Creek Sanitary Sewer Extension project; and 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Revenue Bonds Series 2021 by increasing estimated receipts and appropriations in the Walnut Creek Sanitary Sewer Extension Project (City Project No. 103414) in the amount of $3,196,450.00 and decreasing estimated receipts and appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) by the same amount to effect a portion of Waters Contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: The Mayor and Council Communication (M&C) is to authorize a construction contract with Jackson Construction LTD, and appropriate funding for Phase 2 of the Walnut Creek Sanitary Sewer Extension project, from 4,400 feet west of the Chapin School Road/Aledo Road intersection westerly 2,800 feet then northwesterly 2,700 feet. The project was advertised for bid on May 9th and May 16th, 2024 in the Fort Worth Star -Telegram. On June 6th, 2024 the following bids were received: Bidder Total Bid Contract Time Jackson Construction LTD $2,792,412.00 210 Calendar Days Arcadia Services LLC $3,511,094.00 Mountain Cascade of Texas $3,529,308.00' Belt Construction, Inc. $3,988,724.00Iy S.J. Louis Construction of Texas $5 524,203.00 Ltd. In addition to the contract cost, $264,417.00 is required for project management and inspection and $139,621.00 is provided for project contingency. This project will have no impact to the Water Department's operating budget when complete. This is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Business Equity placed a 25 percent business equity goal on this project. Jackson Construction, LTD, is committing to 14.54 percent MWBE participation. A Good Faith Effort (GFE) with supporting documentation was submitted, which is in accordance with the City's Ordinance. This project is located in Council District 3. FISCAL INFORMATION ! CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified All -Funds project within the W&S Rev Bonds Series 2021 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Rev Bonds Series 2021 Fund for the Walnut Creek SS Extension project to support the execution of the construction contract. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
