HomeMy WebLinkAboutOrdinance 27135-09-2024Ordinance No. 27135-09-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND, SUBJECT TO RECEIPT OF THE GRANT, IN THE AMOUNT UP TO $21,740.00, FOR THE PURPOSE OF FUNDING UNITED STATES MARSHALS SERVICE VIOLENT OFFENDER TASK FORCE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the grants Operating Other Fund, subject to the receipt of the grant, in the amount up to $21,740.00, for the purpose of funding United States Marshals Service Violent Offender Task Force. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent j urisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. 00111101ZE l This ordinance shall take effect upon adoption. Goodall City Secretary i0o0 0XP 0 0 °O 0oo *� Haan AEx M City of Fort Worth, Texas Mayor and Council Communication DATE: 09/17/24 M&C FILE; NUMBER: M&C 24-0834 LOG NAME: 35FY24 USMS INCREASE SUBJECT (ALL) Adopt Appropriation Ordinance to Increase Appropriations in the Grants Operating Other Fund in an Amount Up to $21,740.00 for Additional Reimbursable Funds from the United States Marshals Service for the Fort Worth Police Department Fugitive Unifs Participation in the United States Marshals Service Violent Offender Task Force RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Other Fund, subject to receipt of the grant, in an amount up to $21,740.00, for the purpose of receiving reimbursable funds for the Fort Worth Police Department Fugitive Unit's participation in the United States Marshals Service Violent Offender Task Force for Fiscal Year 2024. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate additional funds for the Police Department Fugitive Units participation in the United States Marshals Service (USMS) Violent Offender Task Force (VOTF) for Fiscal Year (FY) 2024 USMS TF project (City Project No. 104752). On March 19, 2024, the City Council approved M&C 24-0211 to appropriate $239,146.00 for reimbursable funds for overtime expenses related to VOTF participation. On June 7, 2024, a modification document was received from the USMS to increase funding for task force officer overtime. The additional appropriation of $21,740.00 for Fiscal Year 2024 in the USMS TF project, results in total reimbursable funds of $260,866.00 to the City of Fort Worth (City). Adoption of the attached appropriation ordinance will provide the capacity to account for the expenses to be reimbursed from the additional funds. The Fugitive Unit has participated in the USMS VOTF for many years, most recently with M&C 24-0211 and City Secretary Contract No. 50153. The program operates pursuant to the Presidential Threat Protection Act of 2000 (Public L. 106544; 28 U.S.C. §566 note), which provides for the establishment of permanent Fugitive Apprehension Task Forces consisting of federal, state and local law enforcement authorities in designated regions of the United States, to be directed and coordinated by the United States Marshals Service, for the purpose of locating and apprehending fugitives. The primary mission of the USMS VOTF is to investigate and arrest, as a part of joint law enforcement operations, persons who have active and federal warrants thereby improving public safety and reducing violent crime. The City receives funds from the USMS to reimburse a portion of the City's expenditures associated with participation in the VOTF. Reimbursement is limited to overtime expenses related to the VOTE. The City of Fort Worth will be responsible for officer salaries and associated fringe benefits. Indirect costs are not eligible for reimbursement. There is no required match. This Task Force serves ALL. COUNCIL DISTRICTS. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: United State Marshals Ser% tce FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, in the Grants Operating Other Fund. The Police Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City.
