HomeMy WebLinkAboutOrdinance 27037-08-2024Ordinance No. 27037-08-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE DEVELOPER CONTRIBUTION FUND, IN THE AMOUNT OF $37,073.55, FROM RECEIVED DEVELOPER CONTRIBUTIONS, FOR THE PURPOSE OF FUNDING THE 465 SOUTH MAIN PEDESTRIAN ILLUMINATION PROJECT (CITY PROTECT NO. 105611); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Developer Contribution Fund in the amount of $37,073.55, from received developer contributions, for the purpose of funding the 465 South Main Pedestrian Illumination project (City Project No. 105611). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Developer Contribution Fund in the amount of $37,073.55, from received developer contributions, for the purpose of funding the 465 South Main Pedestrian Illumination project (City Project No. 105611); and 2. Amend the Fiscal Years 2024-2028 Capital Improvement Program. This Mayor and Council Communication (M&C) accepts funding from 465 South Main, LLC, a private developer, in the amount of $37,073.55 to install two new decorative pedestrian lights along West Tucker Street, adjacent to the new commercial development at 465 South Main Street in Fort worth. As part of the City commitment to ensuring the safety and beautification, the installation of these pedestrian lights aligns with the City Development Services requirements for new public infrastructure abutting new development. The City has already received an executed Developer Funding Agreement with 465 South Main, LLC (City Secretary No. 60387). Upon appropriation of these funds by the City, Transportation and Public Works Department will promptly commence construction of the pedestrian lights. This project is a demonstration of successful collaboration between the public and private sectors for the betterment of our community. The new decorative pedestrian lights will enhance the aesthetics of West Tucker Street and contribute to the safety and accessibility of the area creating a more vibrant and inviting atmosphere for residents and visitors alike. Funding for this project was not included in the Fiscal Years (FY) 2024-2028 Capital Improvement Program due to the developer funds were unknown at the time. The action in this M&C will amend the FY2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. Funding has been received and available in the Developer Contribution Fund for the 465 South Main Pedestrian Illumination project. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available within the 465 South Main Pedestrian Illumination project and upon approval of the above recommendation and adoption of the appropriation ordinance, funds will be available in the Developer Contribution Fund for the 465 South Main Pedestrian Illumination project. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability of funds.
