HomeMy WebLinkAboutOrdinance 27110-09-2024Ordinance No. 27110-09-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND, IN THE AMOUNT OF $865,000.00, TRANSFERRED FROM THE GRANTS OPERATING FEDERAL FUND FOR THE PURPOSE OF FUNDING THE AMERICAN RESCUE PLAN ACT PEDESTRIAN SAFETY IMPROVEMENT PROJECT (CITY PROJECT No. 104299); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. HE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount up to $865,000.00, transferred from the Grants Operating Federal Fund for the purpose of funding the American Rescue Plan Act Pedestrian Safety Improvement project (City Project No. 104299). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent j urisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to allocate and appropriate additional American Rescue Plan Act (ARPA) funding in the amount of up to $2,307,939.00 for anticipated increased construction costs for pedestrian safety, intersection improvements and traffic signals at multiple locations in the City. On May 21, 2024, M&C 24-0459, City Council approved reductions in existing ARPA allocations. The scope of the American Rescue Plan Act Pedestrian Safety Improvement project (City Project No. 104299) includes the design and construction of intersection and pedestrian improvements along Long Avenue, from Azle Avenue to Angle Avenue, as originally recommended in the City of Fort Worth High Injury Network Corridor Evaluation Report prepared by IGmley-Horn in March of 2022. Those improvements include new traffic and pedestrian signals, accessible curb ramps, median modifications, left turn lanes and some new pavement markings. ARPA funding must be committed by December 31, 2024, and spent by December 31, 2026. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08- 2022) provided liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until the debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05- 2022). Funding for these projects was not included in the Fiscal Years 2024-2028 Capital Improvement Program (CIP) because the additional scope and funding needs were not identified at the time of CIP development. The actions in this M&C will amend the Fiscal Years 2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. These projects are located in COUNCIL DISTRICTS 2, 4, 8 AND 10. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the American Rescue Plan Act project within the Grants Operating Federal Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available, as appropriated, in the Grants Cap Projects Federal Fund for the ARPA Pedestrian Safety Improve, N Beach St. at Champions View, Basswood &Old San Fe Traff Sig, Wichita St &Martin St Signal and Western Center & Sandshell projects. Prior to any expenditures being incurred, the Transportation & Public Works Department shall be responsible for ensuring funds are available and that only expenditures allowable under the American Rescue Plan Act are charged to the ARPA funding source. Grant funds will be transferred to the Grants Cap Projects Federal Fund for the project on a reimbursement basis.
