HomeMy WebLinkAboutOrdinance 16170ORDINANCE NO. ~~ ~ ~~ AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF NORT~I ELM STREET LOCATED IN BLOCK 123 OF THE ORIGINAL TOWN OF FORT WORTH, AN UNRECORDED ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS AND BEING 90.31 TO 81.13 FEET VARIABLE LENGTH AND 26.82 TO 0 FEET VARIABLE WIDTH AND CONTAINING 908 SQUARE FEET OF LAND, MORE OR LESS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITIFI; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED DY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of North Elm Street located in Block 1.24 of the original Town of Fort Worth, an unrecorded addition to the City of Fort Worth; Tarrant County, Texas and being 90.31 to S 1.13 feet variable length and 26.82 to 0 feet variable width and containing 908 square feet of land, more or less; and as more specif cally described in Exhibit "A" attached hereto and incorporated herein by reference, be and the sane is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street and alley rights-vf--way is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION S. That this ordinance shall take effect on December 31, 2005 or upon the acceptance by the City of the replat of the property, whichever occurs first. It is the intent of the City to repeal this ordinance vacating the above-described a11ey if the replat is not accepted by the City on or before December 31, 2005.
