HomeMy WebLinkAboutOrdinance 20889-09-2013 Ordinance No. 211,0889-09-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND, MUNICIPAL COURT BUILDING SECURITY PROJECT, IN THE AMOUNT OF $361,120.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF STAFFING DEDICATED TO BUILDING SECURITY FUNCTIONS AND PHYSICAL ENHANCEMENTS TO BUILDING SECURITY; PROVIDING FOR A SEVERAJ31LITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Project, in the amount of $361,120.00, from available funds, for the purpose of staffing dedicated to building security functions and physical enhancements to building security. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 204 1 1-09-20 1 2 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Project, in the amount of $361,120.00 from available funds, and 2. Authorize a transfer in the amount of $361,120.00 from the Special Trust Fund, Municipal Court Building Security Project, to the General Fund. DISCUSSION: Since 1995, state law has authorized municipalities to create a Municipal Court Building Security Fund. On October 10, 1995, Ordinance No. 12204 was adopted by City Council creating the Municipal Court Building Security Fund. Defendants convicted of a misdemeanor offense in municipal court are required to pay a $3.00 Security Fund fee as a cost of court. Under state law, this fee may only be used for the purpose of providing or enhancing security services for buildings housing a municipal court. Acceptable uses include the purchase of equipment (such as parcel x-ray machines and hand-held and walk-through metal detectors), paying staff costs for personnel providing security services and providing continuing education on security issues for court and security personnel. On June 20, 2000, (M&C G-12942) the City Council authorized implementation of the Municipal Court Building Security Enhancement Plan. It authorized the use of Municipal Court Building Security Project funds for staffing dedicated to building security functions. The staffing level has been established at one Senior Deputy City Marshal and eight Deputy City Marshals. Additionally, the Municipal Court Services Department continues to review the security needed at the Court buildings. Several enhancements to the security have been identified by Staff. Some of these enhancements have already been implemented. Others will be implemented in the near future. These enhancements include: Magnetometer Operating Upgrade $ 4,000.00 Hardware Conversion-West Door $ 3,915.00 Hardware Conversion-South Door $ 8,800.00 Secure Doors-Phone Room, West Lobby Door and Cashier Door $12,169.00 Lognarne: 38SECURITY FUND APPROPRIATION Page I of 2 Secure Access-Judge's Hallway-2nd Floor $ 5,500.00 Total $34,384.00 The transfer in the amount of $326,736.00 from the Special Trust Fund, Municipal Court Building Security Project, reimburses the General Fund for Fiscal Year 2013 building security expenses related to the nine Marshal positions, repair/maintenance contracts for three x-ray machines, as well as the additional enhancement outlined above.
