HomeMy WebLinkAboutOrdinance 20891-09-2013 ORDINANCE NO. 20891-09-2013 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF MERCEDES AVENUE, SITUATED IN THE WILLIAM BUSSELL SURVERY, ABSTRACT NO. 151 IN THE CITY OF FORT WORTH, AS SHOWN ON A PLAT FOR LINWOOD ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TEXAS, AS RECORDED IN VOLUME 388-b, PAGE 181 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING APPROXIMATELY 18,061 SQUARE FEET OR 0.415 ACRE OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Mercedes Avenue (a 50' width public right-of-way), situated in the William Bussell Survey, Abstract Number 151, Tarrant County, Texas, as shown on plat for Linwood Addition, an addition to the City of Fort Worth, as recorded in Volume 388-B, Page 181 of the Plat Records of Tarrant County, Texas, and containing approximately 18,061 square feet or 0.415 acre of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the right of way easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. t All existing utility easements be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. DATE: Tuesday, September 10, 2013 REFERENCE NO.: **PZ-3034 LOG NAME: 060065030 VA-012-022 SUBJECT: Adopt Ordinance Vacating a Portion of Mercedes Avenue Between Carroll Street and Foch Street for Multi- Family Residential Development (COUNCIL DISTRICT 9) RECOMMENDATION: It is recommended by the City Plan Commission that the City Council: 1. Adopt an ordinance vacating a portion of Mercedes Avenue between Carroll Street and Foch Street for multi-family residential development; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and Council Communication G-15624). DISCUSSION: Kimley-Horn and Associates, Inc., on behalf of Greystar GP 11, LLC, has requested the vacation of this portion of Mercedes Avenue to replat it with the adjoining property for a future urban residential multi- family development. The City Plan Commission recommended approval of this request at its meeting on November 16, 2012. An acceptable final plat(FP-013-029) has been received. Since the remaining portion of Mercedes Avenue will now dead end into private property, a new portion of Mercedes Avenue is being dedicated by the plat which will turn to the south and exit onto Merrimac Street. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. 'rhe City does not own land under or adjacent to the above referenced streets. Since no City funds have been expended to purchase property or easement rights, collection of the fair market value or any portion, thereof, is recommended by Staff to be waived. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION CERTIFICATION: The Financial Management Services Director certifies that this action will have no material effect on City funds.
