AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
MERCEDES AVENUE, SITUATED IN THE WILLIAM BUSSELL
SURVERY, ABSTRACT NO. 151 IN THE CITY OF FORT WORTH, AS
SHOWN ON A PLAT FOR LINWOOD ADDITION, AN ADDITION TO
THE CITY OF FORT WORTH, TEXAS, AS RECORDED IN VOLUME
388-b, PAGE 181 OF THE PLAT RECORDS OF TARRANT COUNTY,
TEXAS; CONTAINING APPROXIMATELY 18,061 SQUARE FEET OR
0.415 ACRE OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That a portion of Mercedes Avenue (a 50' width public right-of-way), situated in the
William Bussell Survey, Abstract Number 151, Tarrant County, Texas, as shown on plat for
Linwood Addition, an addition to the City of Fort Worth, as recorded in Volume 388-B, Page
181 of the Plat Records of Tarrant County, Texas, and containing approximately 18,061 square
feet or 0.415 acre of land more or less, and as more specifically described in Exhibits "A" and
"B" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the right of way easement to the land in the above-described vacated street right of
way is hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.

All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the William Bussell Survey,Abstract No. 151, City of Fort Worth, Tarrant County, Texas
and being part of Mercedes Avenue (a 50-foot wide right-of-way)as shown on the plat of Linwood,an addition to the City
of Fort Worth, Texas, recorded In Volume 388-B, Page 181 of the Plat Records of Tarrant County, Texas,and being more
particularly described as follows:
BEGINNING at a 112*Iron rod found at the north end of a curving right-of-way comer cllp at the intersection of the north
line of said Mercedes Avenue with the east right-of-way line of Foch Street (a 50-foot wide right-of-way);same being the
beginning of a non-tangent curve to the left having a central angle of 101'52'08*,, a radius of 15.00 feel, a chord bearng
and distance of South 30048'34*East 23.29 feet;
THENCE with the said north right-of-way line of Mercedes Avenue, the following courses and distances:
In a southeasterly direction, with said curve to the left, an arc distance of 26.67 feet to a 1/2' iron rod found at the
beginning of a reverse curve to the right having a central angle of 14'50'42", a radius of 750.00 feet, a chord bearing
and distance of South 74*19*17"East, 193.78 feet;
In a southeasterly direction, with said curve to the right, an arc distance of 194.32 feet to a 5/8'iron rod with 'RPLS
16440'cap found at the end of said curve,
South 66*53'56"East,a distance of 36,01 feet to a point at the beginning of a tangent curve to the left having a central
angle of 11*05'55",a radius of 550.00 feet,a chord bearing and distance of South 72*2653"East,106.37 feet,
In a southeasterly direction, with said curve to the left, an arc distance of 106,54 feet to a point at the end of said
curve;
THENCE departing the said north right-of-way line of Mercedes Avenue,South 7*39'00"West,a distance of 50.15 feel to
a point in the south right-of-way line of said Mercedes Avenue at the beginning of a non-tangent curve to the Tight hav ng
a central angle of 11'27'50",a radius of 600.00 feet, a choro bearing and distance of North 72*37"51"West. 119.85 feet;
THENCE with the said south right-of-way line of Mercedes Avenue,the following courses and distances:
In a northwesterly direction, with said curve to the right, an arc distance of 120.05 feet to a point at the end of said
curve;
North 66'53'56" West, a distance of 36.01 feet to a point at the beginning of a tangent curve to the left having a
central angle of 15*38'48', a radius of 700.00 feet, a chord bearing and distance of North 74*43'20* West, 1190�57
feet;
In a northwesterly direction, with said curve to the left, an arc distance of 19".116 feet to a point at the end of said
curve;
North 82*29'59" West, a distance of 16.17 fee( to a point at the intersection of the said south right-of-way line of
Mercedes Avenue and the said east right-of-way line of Foch Street same being the beginning of a non-tangent
curve to the right having a central angle of 4'57'56", a radius of 800.00 feet, a chord bearing and distance of North
17*38'32"East,69.31 feet;
THENCE with the said east right-of-way line of Foch Street, in a northeasterly direction with said curve to the right,an arc
distance of 69.33 feet to the POINT OF BEGINNING and containing 18,061 square feet or 0.415 acres of land.
The bearings for this survey are based on a bearing of North 7*35'00" East for the east right-of-way line of Foch Street

SUBJECT:
Adopt Ordinance Vacating a Portion of Mercedes Avenue Between Carroll Street and Foch Street for Multi-
Family Residential Development (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt an ordinance vacating a portion of Mercedes Avenue between Carroll Street and Foch Street for
multi-family residential development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and
Council Communication G-15624).
DISCUSSION:
Kimley-Horn and Associates, Inc., on behalf of Greystar GP 11, LLC, has requested the vacation of this
portion of Mercedes Avenue to replat it with the adjoining property for a future urban residential multi-
family development. The City Plan Commission recommended approval of this request at its meeting on
November 16, 2012. An acceptable final plat(FP-013-029) has been received.
Since the remaining portion of Mercedes Avenue will now dead end into private property, a new portion of
Mercedes Avenue is being dedicated by the plat which will turn to the south and exit onto Merrimac Street.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. 'rhe City does not own land under or adjacent to the above referenced streets. Since no City
funds have been expended to purchase property or easement rights, collection of the fair market value or
any portion, thereof, is recommended by Staff to be waived.
This project is located in COUNCIL DISTRICT 9.

The Financial Management Services Director certifies that this action will have no material effect on City
funds.
