AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND
IN THE AMOUNT OF $2,000,000.00, FROM AVAILABLE PAYGO RESIDUALS IN
THE WATER AND SEWER CAPITAL PROJECTS FUND, FOR THE PURPOSE
OF FUNDING THE EMER 78" SANITARY SEWER REPAIR AT 7900 TRINITY
BLVD (CITY PROJECT NO.105652); PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09-
2023, as amended, is hereby further amended to make the following adjustments by increasing estimated
receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $2,000,000.00,
from available PayGo Residuals in the Water and Sewer Capital Projects Fund, for the purpose of funding the
Emer 78" Sanitary Sewer Repair at 7900 Trinity Blvd (City Project No.105652).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or j udgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water
and Sewer Capital Projects Fund in the amount of $2,000,000.00 from available PayGo residuals in the Water and Sewer Capital Fund for the
purpose of funding the Emer 78" Sanitary Sewer Repair at 7900 Trinity Blvd (City Project No.105652) and to effect a portion of Water's
contribution to the Fiscal Years 2024-2028 Capital Improvement Program.

On Saturday, May 4, 2024, Water Field Operations crews discovered multiple leaks at an aerial crossing location of a 78-inch sanitary sewer
main. The leaks were discharging into a creek that flows to the Trinity River. Due to high rate of flow and pressure in the pipe, attempts by City
crews to stop the leaks failed. City crews constructed a temporary dam to contain the overflows and then pumping the discharged wastewater
back into the collection system until the pipe crossing is repaired or replaced. Water Department Field Operation crews are not equipped to
handle an emergency of this nature. Under the June 13, 2024 Emergency Authorization (copy attached), the Water Department engaged William J.
Schultz, Inc. dlbla Circle C Construction Company (Circle C) to conduct the necessary work to replace the sewer main. The emergency work was
estimated to be $2,000,000.00 (City Secretary Contract No. 61668).
The contract and work will be billed on a task order basis. Mayor & Council Communication(s) (M&C) will be circulated to ratify the above contract
after the work has been performed.
Section 252.022 of the Local Government Code exempts from normal bidding requirements that are necessary to preserve or protect public health
or safety of the municipality's residents and procurements that are necessary because of unforeseen damage to public machinery, equipment or
property.
The purpose of this M&C is to secure funding to compensate Circle C for work performed and to speed up the repair project.
This is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance,
as projects commence, additional funding needs are identified, and to comply with bond covenants. The actions of this M&C will appropriate funds
in support of the Water's portion of the City of Fort Worth's Fiscal Years 2024-2028 Capital Improvement Program, as follows:

FISCAL INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified All -Funds project within the W&S Capital Projects Fund, and
upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital
Projects Fund for the Emer 78 SS Rpr Trinity Blvd project. Prior to any expenditure being incurred, the Water Department has responsibility of
verifying the availability of funds.
