AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION
OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH; PROVIDING FOR THE
ANNEXATION OF AN APPROXIMATELY 35.4 ACRE TRACT OF LAND SITUATED IN THE
J. MATTHEWS SURVEY, ABSTRACT NUMBER 1021, SITUATED ABOUT 14.9 MILES
NORTH 9 DEGREES EAST OF THE COURTHOUSE, TAItRANT COUNTY, TEXAS (CASE
NO. AX-13-005) WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE
PRESENT CORPORATE BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING
THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES;
PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES
OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE
SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN
DIRECT CONFLICT; PROVIDING FOR SEVERABILITY; AND NAMING AN EFFECTIVE
DATE.
WHEREAS the City of Fort Worth has received a petition in writing requesting the full-purpose
annexation of the area; and
WHEREAS the population of the City of Fort Worth, Texas, is in excess of 100,000 inhabitants; and
WHEREAS the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the
City of Fort Worth,Texas; and
WHEREAS the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas;
and
WHEREAS the hereinafter described territory contains approximately 35.4 acres of land (0.055 square
miles) of land, more or less;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the following described land and territory lying adjacent to and adjoining the City of Fort
Worth, Texas is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter
described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the
present corporate boundary limits of said City, at the various points contiguous to the area hereinafter
described, are altered and amended so as to include said area within the corporate limits of the City of Fort
Worth,Texas, to-wit:

and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens in accordance

SECTION 7.

annexed to the City of Fort Worth, the ineffectiveness of this ordinance as to any such part or parts shall not
affect the effectiveness ofthjo ordinance uato the remainder of such area. The City Council hereby declares
it to be its purpose 10 annex to the City of Fort VVodb every part of the area described in Scodoo l of this
ordinance, regardless of whether any part of such described area is hereby not effectively annexed to the

SERVICE PLAN FOR ANNEXED AREA

Location and Acreage: Approximately 35A acres ofland in Tarrant County. located north of Keller
Haslet Road and mao\of Old Denton Road.
Municipal services to the Annexation Area will be furnished byoron behalf of the City of Fort VVorth. Texas,
at the following levels and in accordance with the following service plan programs:
1. PROGRAM FOR SERVICES TO BE PROVIDED ON THE EFFECTIVE DATE OF THE
ANNEXATION
The City will provide the following services in the Annexation Area on the affaohve date of the annexation,
unless otherwise noted.
As used in this plan, the term 'providing services' includes having services provided by any method or
means by which the City may extend municipal services to any other area of the City, including the City's
infrastructure extension policies and developer or property owner participation in accordance with applicable
city ordinances.
A. Police Protection
The Fort Worth Police Department will provide protection and law enforcement services in the
Annexation Area commencing on the effective date of full-purpose annexation. The services will include:
Normal patrols and responses to calls for service
Handling of offense and incident reports
Special unibe, such aa traffic enforcement, criminal investigations, narcotics law enforcement,
gang auppvemaion, and crime response team deployment when required.
The area will bo combined with existing Police Reporting Areas O32U. The area will be added to Beet
N15 in Zone N1 in North Division.
B. Fire Protection
Fire protection services will be provided by existing personnel and equipment of the Fort Worth Fire
Department. These services will be provided based upon available water, road and street
conditions, and distances from existing fire stations. Services will be provided to the annexation area
commencing oo the effective date n/the full-purpose annexation. These services include:
Basic Life Support(BLS) 1ut responder emergency medical services
Fire suppression and rescue;
Hazardous materials mitigation and regulation;
Dive rescue;
'
Technical rescue;
Fire Safety Education;
Aircraft/rescue/firefighting;
Fire protection system plan review; and
Inspections.
These services are provided ona citywide basis. All Fort Worth firefighters are certified by the Texas
Commission on Fire Protection.
On the date of annexation, the first responding fire services will come from Fire Station 38, located at
13280 Park Vista Boulevard.The second responding fire company will be from Fire Station 35,
located at 2201 Flight Line Road. The Fire Department estimates the response time to be 4.6 and
5.1 minutes, respectively.

C. Eme,Lgency Medical Services—Basic Life Support
Basic Life Support(8LS)emergency medical services by existing personnel and equipment of the
Fort Worth Fine Department will be provided to the annexation area commencing on the effective
date of the full-purpose annexation. The Fort Worth Fire Department serves an the first responder
on life threatening medical emergencies maapart of the y@adStarsystem. All Fort Worth Fire
Department personnel are certified as Emergency Medical Technician basic level or higher. All
engines, trucku, and nonoue units carry Automated External Defibrillators for use with victims who are
in cardiac arrest.
Emengency Medical Services—Advanced Life Suppo
Advanced uoa Support response provided by MeUbkar is greater than 0 minutes to the full-purpose
annexation area with a potential of at least a 30-minute transport time to the nearest trauma center.
D. Solid Waste Collection
Solid waste collection shall be provided ho the Annexation Area in accordance with existing City
ordinances and pnUdeu commencing on the effective date of the full-purpose annexation. As the
proposed land use is for multi-family use(multi-family dwelling complexes having three or more
unika), solid waste services will be provided by private solid waste service providers and not the city.
Private solid waste collection providers must have an active Grant ofPrivilege issued by the City of
Fort Worth ho provide service within the city limits.
E Operation and Maintenance of Water and Wastewater Facilities
Existing occupied homes that are using water well and on-site sewer facilities(and therefore have
service)may continue to use the existing water well and on-site sewer facilities. |f the existing
property owner would like to connect to the City water and sewer system, then the property owner
may request connection and receive up to 200 LF of water and sewer extension at City ooai for each
occupied property lot or tract in accordance with the"Policy for the Installation of Community
Facilities"and as consistent with the Texas Local Government Code,
Upon connection to the City's water and sanitary sewer mains,water and sanitary sewage service
will be provided at rates established by City ordinances for such service mt the normal rates charged
throughout the City.
F� Operation and Maintenance of Roads and Streets, Including Street Lighting
The following services will be provided in the Annexation Area commencing on the effective date of
dhehuUpurxose annexation, unless otherwise noted.
These services include emergency pavement repair and repair maintenance of public streets on an
as-needed basis. Preventive maintenance projects are prioritized ono region-wide basis and
scheduled based on a variety of factors, including surface nondihon, ride abi|ih/, oga, trmOio volume,
functional class, and available funding. Any necessary rehabilitation o/reconstruction will bo
considered and prioritized by the City.
Streetlights installed on improved public streets shall be maintained by the City nf Fort Worth in
accordance with current City policies. Other street lighting ahoU not hemaintained by the City ofFort
VVndh.
The City will also provide regulatory oignageservices in the Annexation Area. Traffic signal, stop,
and all other regulatory studies are conducted in conjunction with growth of traffic volumes. All
regulatory signs and signals are installed when warranted following an engineering study. Fmded,
vandalized, o/missing signs are replaced as needed. "CALL BACK" service io provided 24 hours u
day, 3S5 days a year for emergency sign repair.

G. Operation and Maintenance of Parks, Playgrounds, and Swimming Pools
Residents of this property may utilize all existing parks and community service facilities throughout
the Cih/, beginning with the effective date of the full-purpose annexation. Existing parks,
p|aygnoundo, swimming pools and other recreational and community facilities within the Annexation
Area that are private facilities will be unaffected by the annexation.
Existing parks, playgrounds, swimming pools and other recreational and community facilities within
this property shall, upon deeding to and acceptance by the City and appropriations for maintenance
and upenadona, hooperated by the City mf Fort Worth, but not otherwise.
H. Operation and Maintenance of Any Other Publicly Owned Facility, Building or Service.
In the event the City acquires any other facilities, buildings or services necessary for municipal
services located in the Annexation Area, the appropriate City department will provide maintenance
services upon the effective date of the full-purpose annexation.
2. PROGRAM FOR PROVIDING ADDITIONAL SERVICES
In addition to the services identified abova, the following services will be provided in the Annexation Area on
the effective date of the full-purpose annexation, unless otherwise noted:
A. With o Fort Worth library card, residents can access the Library's online resources which include
obooks, e-audio and reference databases from home and borrow ma\eho|a from any Fort Worth
Library branch and our MetrOPAC partners and from participating TexShare libraries.
B. The City will provide general municipal administration and administrative services.
C. The Annexation Area will be included in the Transportation and Public Works Department's
StuxnwaVer Utility service area. Properties in this area will be assessed a monthly fee based onthe
amount of impervious surface. The fees will cover the direct and indirect costs ofok>rmwobar
management aen/ioee' including routine maintenance(at current citywide service levels)for all public
drainage channels and for all public storm sewers within dedicated public drainage easements. The
SVunnwuter Utility will also provide Ouodp|ain management and information regarding flood p|aims, as
well au watershed development review and inspection.
O. City codes, consumer health, and animal care and control ordinances and regulations, that include
but not limited to: high weeds and Onsms, trash and debris, solid waste. trash carts and iUmge|
dumping,junked and abandoned wshio|en, zoning, hood, dayoane, public pool and spa inspections,
stray animals, cruelty and bite investigations will beenforced. Complaints of ordinance orregulation
violations within the area will be answered and investigated by existing personnel within the
appropriate Code Compliance Division beginning on the effective date of the annexation.
E. The City's bui|ding, p|umbing, meohan|ua|, e|eobioa|, and all other construction codes will be
enforced within the Annexation Area beginning with the effective date of the full-purpose annexation.
F. The City's zoning, subdivision, sign, manufactured housing,junk yard and other ordinances shall be
enforced in the Annexation Area beginning on the effective date of the full-purpose annexation.
G. All inspection services furnished by the City uf Fort Worth, but not mentioned abuve, will be provided
to the Annexation Area beginning on the effective date of the full-purpose annexation.
H. In addition to vaeidenbo| solid waste collection services,the Environmental Management Division will
provide the following services:
Emergency spills and pollution complaints response;
Sb>nn sewer discharge pollution prevention; and
Water quality assessments for creeks.

3. PROGRAM FOR PROVIDING FULL MUNICIPAL SERVICES WITHIN 2-112 YEARS
In addition to the services listed above. the City will provide full municipal services to the Annexation Area
commensurate with the levels of services provided in other parts of the City except if differences in
topography, land use, and population density constitute a sufficient basis for providing different levels of

full municipal services cannot be reasonably provided within the aforementioned time period, the City will
propose a oohmdu|o for providing said men/ioem within u period of four and one-half(4-1/2)years after the
offaoUva date of the annexohon, and/or upon commencement of development ofa subdivision within this
property,whichever occurs later.
"Full municipal narvimya^are services provided by the annexing municipality within its full-purpose
boundarieo, excluding gas or e|euthoo|service. The City shall provide the services by any of the methods by
which i(extends the services 0m any other area of the City,
4. CAPITAL IMPROVEMENTS PROGRAM
The developer will initiate acquisition or construction of capital improvements necessary for providing full
municipal services adequate to serve the Annexation Area.Any such construction shall be substantially
completed within two and one-half(2-1/2)years after the effective date of the full-purpose annexation. If
capital improvements necessary for providing full municipal services for the Annexation Area cannot be
reasonably constructed within the aforementioned time period, the City will propose a muhodu|a for providing
said oarvimyo within a period of four and one-half(4-1/2)yeam, and/or upon commencement of development
ofa subdivision within this property, whichever occurs later.
Acquisition or construction nhmU be accomplished by purchase, |easo, or other contract. Any such
construction shall be accomplished in continuous process and shall be completed ansoon as reasonably
possib|a, consistent with generally accepted local engineering and architectural standards and practices.
A. Police Protection. No capital improvements are necessary at this time to provide police protection 0u
the Annexation Area. Need for construction o[new facilities will be assessed periodically based on
population growth, predicted growth and call volume.
B. Fire Protection. Currently, Fire Station 38 has 4.6 minute response time to the Annexation Area.
Consideration should be given to constructing new stations and staffing new facilities prior tofinal
decision to complete annexation. Current fire department response time goal is to arrive on the
scene of emergencies within 5 minutes or|oos from the time of dispatch at 75% of the time. Based
Vn the existing fire stations located close\nthis proposed annexation area, the fire department will
be able tn meet this response time goal. No capital improvements are necessary at this time to
provide One protection to the Annexation Area. Need for construction of new facilities will be
assessed periodically based on population growth, predicted growth, and call volume.
C. Solid Waste Collection. No capital improvements are necessary at this time to provide solid waste
collection services(otha Annexation Area.
D. Water and Wastewater. Currently, existing 12-and 3O'inch water mains and existing 2i'and 24-
inch sewer lines are adjacent to the annexation area.
Vacant properties'water and sewer extensions will be installed by the Developer in accordance with
the"Policy for the |nobmUaUun of Community Facilities". All water and wastewater facilities will be at
the 6ewe|opa/a cost and as consistent with the Texas Local Government Code. Water and sewer
line sizes will be determined based upon the water/sewer study provided by the developer's
engineer. Any City participation on water and sewer facilities will be in accordance with the
"Installation Policy of Community Faoi|iUma^ and the Texas Local Government Code. Upon
nonnaoUon, to existing water and sanitary sewer mains, water and sanitary sewage service will be

provided at rates established by City ordinances for such service at the normal rates charged
throughout the City,
E Roads. Future capital improvements are required for the widening Westport Parkway from 2 lanes to
o 4-lane divided adoha| street and the construction of future North Beach Street as a 6-lane divided
arterial street.
F. Storm Water Utility, Nn capital improvements are necessary at this time hz provide drainage
services.
G. Street Lighting. |\iaanticipated that new subdivisions in the Annexation Area will install street
lighting in accordance with the City's standard policies and procedures. |n other cases, the City will
consider installation of additional street lighting in the Annexation Area upon request, with priority
given to street lighting for tmMio safety, Provision of street lighting will be in accordance with the
City'n sinamt lighting po|ioiea, and those of the providing utility.
H. Parks, Playgrounds and Swimming Pools. Capital improvements such ws parkland acquisition and
development of facilities will be dictated by future land use of the area, goals established by the
Park. Recreation and Open Space Master Plan and appropriation of resources. Should additional
residential development occur, parkland dedication, neighborhood park development and
neighborhood park infrastructure or payment in lieu thereof will be required in accordance with the
Park Policy of the Subdivision Ordinance.

functions and services, and the additional services described above can be provided for the
Annexation Area by using existing capital improvements. Additional capital improvements are not
necessary h> provide City services.
5. |KHPACTFEES
Notwithstanding any other provision of this service plan, a landowner within the Annexation Area will not be
required to fund capital improvements necessary to provide municipal services in a manner inconsistent with
Chapter 395 of the Local Government Code governing impact hees, unless otherwise agreed to by the
landowner.

RECOMMENDATION:
It is recommended that the City Council institute and adopt the attached ordinance annexing
approximately 35.4 acres of land, north of Keller Haslet Road and east of Old Denton Road, 3295 Keller
Haslet Road, AX-13-005.
DISCUSSION:
On June 10, 2013, representatives for the property owners, Frances Clark and Phillip Sotel, submitted an
application to petition for the full-purpose annexation of the above-referenced property into the City of Fort
Worth (City). The annexation area is situated within the extraterritorial jurisdiction of the City in the
northeast quadrant of 1-35W (North Freeway) and SH 170. Under Section 43.028 of the Texas Local
Government Code, the governing body may grant or refuse the petition.
This request meets the criteria defined in Texas Local Government Code Section 43.028 for owner-
initiated annexation and will not require public hearings. The adoption of the attached ordinance
completes the annexation process. The City is able to provide municipal services upon annexation, in
accordance with State law, without negatively impacting service provision within the City. Annexation of
this site is consistent with the City's annexation policy of annexing enclaves, including portions of
enclaves, and property proposed for urban development. This site is also identified in the City's 2013-
2017 annexation program. In 2011, the City initiated annexation and entered into a five-year Development

The owner has also initiated zoning case ZC-1 3-088 requesting "C" Medium Density Multifamily zoning,
which is on today's City Council agenda with a recommendation of approval from the Zoning
Commission. In response to the annexation and zoning cases and given adopted land use policies, the
City Plan Commission recommended an amendment to the Comprehensive Plan on June 26, 2013 to
extend the Alliance Gateway West mixed-use growth center to the north to encompass this property. The
proposed multi-family development is consistent with the mixed-use future land use designation and
complements the jobs within the nearby Alliance Airport and Alliance Gateway East industrial growth
centers.
Staff notified The Ranches Neighborhood Association and the North Fort Worth Alliance regarding the
proposed multi-family development. Residents from The Ranches neighborhood have expressed
opposition to the development citing traffic congestion, lower property values and overcrowding of
schools. The North Fort Worth Alliance noted opposition due to incompatible adjacent land uses, lack of
payment for transportation impact fees and overall traffic impacts.

If the requested "C" zoning is approved, the proposed development could have up to 450 multi-family
units, which would generate up to 2,992 trips per day. The property abuts Keller Haslet Road, which is
designated as the future Westport Parkway arterial street, and abuts future North Beach Street. During
the platting process, the owner will be required to dedicate right-of-way for North Beach Street and for
Westport Parkway (Keller Haslet Road), which is currently a two-lane rural road. In addition, the
developer would be required to construct up to $3.6 million worth of arterial street expansion on Westport
Parkway and potentially North Beach Street, as part of the Community Facility Agreement (CFA), required
during platting. The dollar amount is the developer's proportional share based on the anticipated traffic
impact and is equivalent to the amount that would be required if the property were subject to
transportation impact fees. The property is not subject to transportation impact fees since it was not in the
city limits at the time of the last impact fee study adopted by the City Council earlier this year.
The Transportation and Public Works Department would determine how the developer's CFA funds would
be allocated to the arterial streets. If appropriate, Staff can consider also allocating transportation impact
fee funds from the service area to support the expansion of Westport Parkway, which is an eligible
project. Otherwise, Westport Parkway east and west of the site would remain in its existing two-lane
configuration. North Beach Street is not an eligible impact fee project since much of it is outside the city
limits. North Beach Street and Westport Parkway (Keller Haslet Road) are on the unfunded capital
improvement program list. No active preliminary plats in the vicinity are noted.
Based on existing conditions, the Police Department has estimated no impact, and other General Fund
services have estimated a very slight impact, due to the current rural nature of the proposed annexation
area. The revised fiscal impact analysis shows that the property will have a slight positive impact to the
General Fund each year after construction. Staff revised the fiscal impact analysis provided with the
September 10, 2013 Informal Report to use an estimate of two persons per unit rather than three persons
per unit used in the initial analysis. According to U.S. Census household estimates for Fort Worth, two
persons per unit is more appropriate for multi-family development, while three persons per unit is
appropriate for single-family development.
If annexed, this property will become part of COUNCIL DISTRICT 7.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on the
City's funds until the site is developed.
