AMENDMENT No . 2
TO CITY SECRETARY CONTRACT No. 58487
WHEREAS, the City of Fort Worth (CITY) and Plummer Associates, Inc.
(ENGINEER) made and entered into City Secretary Contract No. 58487, (the
CONTRACT) which was authorized M&C 22-0892 on the 8th day of November,
2022, in the amount of $1,773,698.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No.1 in
the amount of $5,057,498.00 authorized by M&C 23-0828 on September 26th,
2023; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Ma.ry's creek Water Reclamation Facility, CPN C01239; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $14,666,092.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $21,497,288.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Dear Ms. Abbe:
On behalf of Plummer Associates, I am pleased to submit Amendment 2 for additional
services to City project number 103648. Amendment 2 includes the scope and effort for the
Final Design and Bidding Phase for the Mary's Creek Water Reclamation Facility. Tasks in
the amendment include final design of civil and site development, architectural, mechanical,
HVAC, plumbing, structural, electrical, instrumentation and controls, equipment preselection
for the major mechanical equipment, development of OPCCs, quality review of the design,
services during the bid phase, and additional workshops and meetings. The related scope of
work and LOE documents are attached.

Effect a Portion of Water's Contribution to the Fiscal Years 2025-2029 Capital
Improvement Program for a Revised Contract Amount of $21,497,288.00
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 2, in the amount of $14,666,092.00, to an
Engineering Agreement with Plummer Associates, Inc. (City Secretary Contract No. 58487)
for the final design of the Mary's Creek Water Reclamation Facility project for a revised
contract amount of $21,497,288.00 (City Project No. C01239); and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations
in the W&S Rev Bonds Series 2024 Fund by increasing estimated receipts and appropriations
in the Mary's Creek Water Reclamation Facility project (City Project No. C01239) in the
amount of $14,966,092.00 and decreasing estimated receipts and appropriations in
the Commercial Paper project (City Project No. UCMLPR) by the same amount to effect a
portion of Water's Contribution to the Fiscal Years 2025-2029 Capital Improvement Program.
DISCUSSION:
On November 8, 2022 the City Council authorized execution of an agreement with Plummer
Associates, Inc. in the amount of $1,773,698.00 to conduct process evaluation and concept design
for the Mary's Creek Water Reclamation Facility (MCWRF) (Mayor and Council Communication
(M&C) 22-0892). The agreement was subsequently revised by Amendment No.1 in the amount of
$5,057,498.00 authorized by City Council on September, 26, 2023 (M&C 23-0828) to conduct
preliminary design for the Mary's Creek Water Reclamation Facility. Amendment No. 2,, in the amount
of $14,666,092.00, will allow Plummer Associates, Inc. to conduct final design of Mary's Creek Water
Reclamation Facility for a revised fee not to exceed $21,497,288.00. In addition to the amendment
amount, $300,000.00 is required for project management.
This project will have no impact on the Water Department's operating budget when complete.

Funding is currently available in the Commercial Paper project within the W&S Rev Bonds Series
2024 Fund for the purpose of funding the Mary's Creek Water Reclamation Facility project.
BUSINESS EQUITY: Plummer and Associates, Inc. agrees to maintain its initial M/WBE commitment
of 16 percent that it made on the original agreement and extend and maintain that same M/WBE
commitment of 16 percent to all prior amendments up to and inclusive of this Amendment No. 2.
Therefore, Plummer Associates, Inc. remains in compliance with the City's M/WBE Ordinance and
attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form
executed by an authorized representative of its company.
This project is located in the Extraterritorial Jurisdiction (ETJ) west of Council Districts 3 and 7.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Commercial Paper project
within the W&S Rev Bonds Series 2024 Fund and upon approval of the above recommendations and
adoption of the attached appropriation ordinance, funds will be available in the W&S Rev Bonds
Series 2024 Fund for the Mary's Creek Reclam. Facility project to support approval of the above
recommendations and execution of the contract amendment. Prior to an expenditure being incurred,
the Water Department has the responsibility of verifying the availability of funds.
