To the Mayor and Members of the City Council X"`'* Subject: ASSESSMENT PAVING OF SEMINARY DRIVE, EVANS TO BERKE On September 19, 1989, at the benefit hearing for the assessment paving of Seminary Drive (Evans to Berke) , Mr. Aaron Rashti and Mr. Lamar Stuckert , Jr. appeared and raised questions regarding the project. The hearing was contin- ued until September 26 so that the independent appraiser could present his findings regarding enhancement. Mr. Rashti was concerned that curb, gutter and sidewalk which he had pre- viously paid for was now being replaced. The plans for this project provide for the street grade to change somewhat to provide for proper drainage and smooth riding surface. The Seminary Drive pavement is in a generally deterio- rated condition with extensive base failures. Over the years, the roadway and adjacent curbs and gutters have been displaced vertically as the ground under- neath the road swelled and contracted . The profile of the street and curbs will be corrected when the street is rebuilt. This is normal design practice when an old street is reconstructed. Along most of the project length, the sidewalk adjoins the curb, and any change in the grade of the street will necessitate corresponding changes in that of the curb and abutting sidewalk. Where concrete curbs and sidewalks are separated by a grassed parkway area, changes in the curb grades may not require removal of existing sidewalks. This determination can best be made during construction when the new curb ele- vations are actually surveyed and staked on the ground. Sidewalks which can be saved will be saved upon request by the adjacent property owner, and the final assessment rolls will be reduced accordingly. The assessment policy allows credit against assessments for relatively new curb and gutter. Staff has not been able to ascertain when the concrete facil- ities were installed adjacent to Mr. Rashti 's property; however, Mr. Rashti is researching his records and will provide staff the necessary information so that credit can be granted if appropriate. Mr. Stuckert , representing the owners of property at 1155 E. Seminary, expressed concerns about the effect of reduced access to businesses during the street construction. The contract for this project will allow 86 working days for construction with a penalty of $315.00 per day for any time in excess of the 86 working days allowed. The contract also requires that the street be kept open throughout the construction phase. Despite these contract provisions, street construction causes obvious disrup- tions to traffic movement and the accessibility to adjoining property. The staff has in the past taken this fact into consideration through such actions as scheduling construction work in the CBD, Stockyards, and Cultural District at night and around scheduled events, allowing the contractor on North Beach to completely close the street in order to reduce construction time, and work- ing with the State Highway Department to facilitate a timely opening of the South Freeway access ramps to Town Center Shopping Center. On certain streets there may well be an overall advantage to the City to pay a premium in order to complete the project in a shorter time frame. With the large number of projects planned to be advertised in October and November, we should quickly be able to develop data as to the cost effectiveness of reducing our construction time allowed on street and drainage construction.
