HomeMy WebLinkAboutOrdinance 27208-10-2024Ordinance No. 27208-10-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $218,560.00, TRANSFERRED FROM AVAILABLE PAYGO FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE SANITARY SEWER REHABILITATION CONTRACT 113, PROJECT PART 2 (CITY PROJECT NO. 102785); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $218,560.00, transferred from available PayGo funds in the Water and Sewer Fund, for the purpose of funding the Sanitary Sewer Rehabilitation Contract 113, Project Part 2 (City Project No. 102785). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Schultz, Inc. dba Circle C Construction Company for the Sanitary Sewer Rehabilitation Contract 113, Project Part 2 for a revised contract amount of $3,022,859.00; and Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $218,560.00, transferred from available PayGo funds within the Water and Sewer Fund, for the purpose of funding the Sanitary Sewer Rehabilitation Contract 113, Project Part 2 (City Project No. 102785) and to effect a portion of Water's Contribution to the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: On December 12, 2023 by Mayor and Council Communication (M&C) 23-1077 the City Council authorized a construction contract with William J. Schultz, Inc. dba Circle C Construction Company in the amount of $2,804,299.00 for Sanitary Sewer Rehabilitation Contract 113, Project Part 2. Change Order No. 1 will provide the following pay items quantities: the installation of a 177 foot segment of a project sewer main by hand tunneling instead of open cut in order to minimize disruption to steep backyards and eliminate the removal of several large existing trees, the installation of a 150 foot segment of the sewer main by trenchless pipe enlargement to minimize disruption to existing front yards and the installation of a double drop manhole to pick up an incoming sewer main. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Business Equity- William J. Schultz, Inc. dba Circle C Construction Company, has agreed/committed to maintain its initial Business Equity participation commitment of 6.13 percent that was made on the original agreement. William J. Schultz, Inc. dba Circle C Construction Company, has also agreed to commit to all prior change orderts up to and inclusive of this Change Order No. Therefore, William J. Schultz, Inc. dba Circle C Construction Company, remains in compliance with the City's Business Equity Ordinance and attests to its commitment by its signature on the Acceptance of Previous M1WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are available in the Water & Sewer Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capita[ Projects Fund, for the SS Rehab Contract 113 project to support the above recommendations and execution of the change order.
