HomeMy WebLinkAboutOrdinance 27231-10-2024Ordinance No. 27231.-10-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECT STATE FUND, IN AN AMOUNT UP TO (1) $1,500,000.00, SUBJECT TO RECEIPT OF THE GRANT, AND (2) $1,500,000.00 AS A TRANSFER FROM THE 2022 BOND PROGRAM FUND, TO SATISFY THE CITY'S MATCH REQUIREMENT, TOTALING $3,000,000.00, FOR THE PURPOSE OF FUNDING THE 2022 BOND SYCAMORE PARK PROJECT (CITY PROJECT NO. 104193); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Project State Fund, in an amount up to (1) $1,500,000.00, subject to the receipt of the grant, and (2) $1,500,000.00 as a transfer from the 2022 Bond Program Fund to satisfy the City's match requirement, totaling $3,000,000.00, for the purpose of funding 2022 Bond Sycamore Park Project (City Project No. 104193). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Goodall City Secretary A Resolution NO.5769-06-2023 TO CONDUCT A PUBLIC HEARING AND DESIGNATE THE ASSISTANT CITY MANAGER OVER THE PARK & RECREATION DEPARTMENT TO ACT ON BEHALF OF THE CITY OF FORT WORTH IN COMMUNICATIONS WITH THE TEXAS PARKS & WILDLIFE DEPARTMENT FOR THE PURPOSE OF PARTICIPATING IN THE LOCAL PARK GRANT PROGRAM FOR PROPOSED IMPROVEMENTS AT SYCAMORE PARK; CERTIFYING THAT THE CITY OF FORT WORTH IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE AND THAT THE CITY OF FORT WORTH'S MATCHING SHARE WILL BE READILY AVAILABLE; AND SPECIFYING THAT SYCAMORE PARK IS DEDICATED FOR PERMANENT PUBLIC PARK AND RECREATIONAL USES WHEREAS, the Recreation Grants Branch of the Texas Parks and Wildlife Department (TPWD) administers the Local Park Grant Program, which includes the Urban Outdoor Recreation Grant (Program); WHEREAS, the Program assists local units of government with the acquisition and development of public recreation areas and facilities throughout the State of Texas through matching fund reimbursement grants. - WHEREAS, the City of Fort Worth (City) is applying for a $1,500,000.00 grant from the Program to assist with the development of the existing Sycamore Park in Fort Worth, the approximate Iocation of which is set forth in the attached Exhibit A; WHEREAS, the Program requires a match from the City equal to the amount applied for under the grant application, for which the match will be readily available; WHEREAS, the City is fully eligible to receive assistance under the Program; and WHEREAS, the City wishes to authorize a representative to act on its behalf in dealing with the TPWD concerning the Program: NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF FORT WORTH: SECTION 1: That the City hereby certifies that it is eligible to receive assistance under the Program, and that notice of the grant application has been posted according to local public hearing requirements. SECTION 2: That the City hereby certifies that the matching share for this grant application will be readily available. SECTION 3: That the City hereby authorizes and directs its Assistant City Manager over the Park & Recreation Department to act for the City in dealing with the TPWD for the purposes of the Program, and that Jesica McEachern is hereby officially designated as the City representative in this regard. SECTION 4: The City hereby specifically City Manager, to submit a Program application known as Sycamore Park in the City of Fort Worth public park and recreation uses in perpetuity. Authorize the acceptance of an Urban Outdoor Recreation Grant from the Texas Parks & Wildlife Department for the Sycamore Park project (City Project No. 104193) with State participation in the amount of $1,500,000.00 fora total grant project cost of up to $3,000,000.00; 2, Authorize the use of up to $1,500,000.00 of 2022 Bond Program funds as the City's direct match; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project State Fund in an amount up to (1) $1,500,000.00, subject to the receipt of the grant, and (2) $1,500,000.00 as a transfer from the 2022 Bond Program Fund to satisfy the City's match requirements, totaling $3,000,000.00, for the purpose of funding the 2022 Bond Sycamore Park project (City Project No. 104193); and 4. Amend the Fiscal Years 2025-2029 Capital Improvement Plan. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to accept a grant in the amount of $1,500,000.00 from the Texas Parks & Wildlife Department (TPWD) Urban Outdoor Grant Program. This grant will provide for the development of park improvements at Sycamore Park (City Project No. 104193), an approximately 154-acre tract of land located at 2525 E. Rosedale Street, in east Fort Worth. On June 27, 2023, the City Council adopted Resolution NO.5769-06-2023 authorizing the Park & Recreation Department (PARD) to apply for an Urban Outdoor Recreation Grant from the TPWD. The application was successful, and on January 25, 2024, the Texas Parks and Wildlife Commission approved the issuance of $1,500,000.00 in grant funding to the City of Fort Worth to develop proposed improvements at Sycamore Park. Per the TPWD grant application structure, an in -kind grant match is required. For the in -kind match, the PARD leveraged $1,500,000.00 of 2022 Bond Funds already appropriated for the development of Sycamore Park project (City Project No. 104193). This follows the City's fiscal policy regarding the use of bond funds. This is a reimbursement grant, and all grant funding is to be used for construction purposes only, no indirect costs are applicable. The City of Fort Worth is solely responsible for any additional costs associated with project administration, design, construction inspection, and materials testing. This contract will be with a governmental entity, state agency, or public institution of higher education: Texas Parks and Wildlife Department. It does not request approval of a contract with a private business entity. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08-2022) provided liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is Issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). The PARD's Capital Improvements Plan (CIP) does not include potential grant awards. Therefore, the action in this M&C is not included in the FY2025-2029 CIP and will amend the FY2025 CIP. Sycamore Park is located in COUNCIL DISTRICT 8. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION ! CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, in the Grants Capital Project State Fund. The Park & Recreation Department (PARD) (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City.
