0M—TO DEVELOP A CAPITAL IMPROVEMENT -PLAN PURSUANT TO WHICH
AN IMPACT FEE OR FEES MAY BE—I—M—P-03rr-
BACKGROUND
Senate Bill 336 (codified in Chapter 395, Local Government Code), the enabling
legislation which authorizes municipalities to impose impact fees against new
development, mandates both procedural and substantive duties on a political
subdivision as prerequisites to the adoption of any impact fees. These duties
apply to both the adoption of new impact fees and to the replacement of existing
impact fees. The statute defines a detailed procedure for adoption of impact
fees, including the appointment of an advisory committee, requirements for
, public notice and provision for public hearings on land use assumptions, a
capital improvements plan and the impact fee ordinance. The foundation for the
impact fee program is a set of land use assumptions which are defined in Senate
Bill 336 as "a description of the service area and projections of changes in
land uses, densities, intensities, and population in the service area over at
least a ten—year period." The land use assumptions in turn serve as the
planning basis for the development of a capital improvements plan, which is used
to determine a maximum impact fee per service unit.
00* PREVIOUS ACTION
On December 5, 1989, the City Council established the Capital Improvements Plan
Advisory Committee whose duties include reviewing and assisting the City in
adopting the land use assumptions for water and wastewater service areas.
On December 12, 1989, the City Council approved a resolution calling for a
public hearing to consider land use assumptions for water and wastewater service
areas.
On January 10, 1990, the Capital Improvements Plan Advisory Committee
recommended approval of the land use assumptions subject to amendment as new
information becomes available.
LAND USE ASSUMPTIONS
The documents entitled "Land Use Assumptions" establish separate land use pro-
jections for water and wastewater facilities, summarize assumptions about popu-
lation growth and employment that are projected to occur in Fort Worth and sur-
rounding cities for the years 1990 to 2000, provide a description of the Fort
Worth Service area and describe the general nature of the capital facilities
which may be required to serve new development through the year 2000. Since
Fort Worth provides water and wastewater services outside its boundaries, the
wholesale customers currently served have been included within the population
and employment projections for the service area; however, since Fort Worth does
not have regulatory authority over new development within its wholesale
Customer's jurisdiction, a separate "benefit" area is defined as only that area
within the corporate boundaries or extraterritorial jurisdiction of Fort Worth
for the purpose of imposing impact fees.

The population and employment estimates for Fort Worth and its
wholesale customers are based on the most current approved projections
developed by the North Texas Council of Governments (NTCOG) . The Fort
Worth estimates were also reviewed by the City of Fort Worth Planning
Department. These projections , along with the percentage of water
and/or wastewater services provided by Fort Worth to wholesale
customers were the foundation for the development of the twenty-year
Water and Wastewater Master Plans completed in 1989.
Two modifications to the printed documents have been recommended by
the Capital Improvements Plan Advisory Committee and staff .
Population estimates for the City of Burleson were revised to be
consistent with NTCOG data and the service areas for both water and
wastewater were modified to reflect the population and employment
projections in the document.
The appropriate Council action on Tuesday's "Public Hearing" Agenda
item is to listen to any public comments, then close the hearing. An
M&C adopting the land use assumptions will be on the January 30
Council Agenda for adoption.

RECOMMENDATION:
It is recommended that the City Council approve the attached
resolution adopting the land use assumptions that will be used to
develop a Capital Improvements Plan for which an impact fee or
fees may be imposed. -
DISCUSSION:
On December 5 , 1989, the City Council approved a resolution
establishing the Capital Improvements Plan Advisory Committee as
required by Chapter 395 , Local Government Code. The duties of
the Advisory Committee include reviewing the land use assumptions
and assisting the City in Adopting the assumptions.
On December 12 , 1989, the City Council approved a resolution
calling a public hearing to consider land use assumptions .
Chapter 395 requires that notification of the hearing be
published at least one month prior to the public hearing for
three consecutive weeks; notification was published on December
19, December 26, 1989, and January 2 , 1990 . The land use
assumptions and water and wastewater service area maps were made
available to the public on December 15, 1989.
On January 10 , 1990 , the Capital Improvements Plan Advisory
Committee recommended approval of the land use assumptions
subject to amendment as new information becomes available. At
its regular session of January 23, 1990 , the City Council
conducted a public hearing to consider land use assumptions .
