HomeMy WebLinkAboutOrdinance 18701-07-2009Ordinance No. 1 8701-0 7-2009 AN ORDINANGE INCREASING ESTIMATED RECEIPTS ANf) APPROPRIATIONS IN THE FEDERAL AWARDED ASSETS FUND !N THE AMOUNT OF 3163,105.82 AND DEGREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING INFORMATION TECHNOLOGY SERVICES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANGES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. 'That in addition to thaw amounts allocated to the various City departments for Fiscal Year 20Q8-2009, there shall also be increased appropriatons in the Federal Awarded Assets Fund in the amount of 5103.105.87 and decreasing the unreserved, undesignated fund balance by the same amount for the purpose of funding Information Technology Services. SECTION 2. That should any portion, section or park of a section of this ordinance be declared invatid, inoperative or void for any reason by a court of competent jurisdiction. such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute a Lease Agreement with The Armory Building, LLC, for approximately 14,649 square feet of office space for an annual rent of $15.44 per square foot, with a three percent annual escalation beginning in year three, located at 1289 Hemphill Street for a ten year term from October 1, 2449, to September 34, 2419; 2. Authorize the City Manager, or his designee, to renew the Lease Agreements at the City's option for up to two successive Five year terms provided that sufficient funds have been appropriated to satisfy the City's obligations during the renewal term; 3. It is recommended that the City Council adapt the attached supplemental appropriation ordinance increasing the appropriations in the Federal Awarded Assets Fund in the amount of $143,105.87 and decreasing the unreserved, undesignated fund balance by the same amount for the purpose of funding Information Technology Services. DISCUSSION: The Fart Worth Police Department NPD2 {NPD2} has been leasing property at 1004 West (vlagnolia Avenue since September 1, 2402. That lease expired August 31.2447, and since they have been leasing the property on amouth-to-month basis. The Gity of Fort Worth wiH be required to pay a cancellation penalty in the event of early termination of the lease because the landlord will be constructing $1,200,000.04 in improvements to the Armory Building. These casts will be amortized aver the ten year period of the (ease. Therefore, far example, if the (ease is terminated in year seven, the City will be required to pay a penalty of $360,000.00. Completion of the office space will also include approximately $103,105.87 far Information Technology Services {ITS). This Agreement may be renewed far up to two successive five year terms at the City's option. This action does not require specific City Council approval provided that the Gity Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term. The Armory Building, LLG, is agreeable to these terms. The Armory Building is located in GC)UNCIL DISTRICT 9, Mapsca 76R. FISCAL INFORMATIQN I CERTEFICATIQN: __ _ __ __ The Financial Management Services Director certifies that funds will be included in the City Manager's Proposed 2009-2010 Budget in the General Fund and Crime and Control Prevention District Fund. Upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated of the Federal Awarded Assets Fund.
