HomeMy WebLinkAboutOrdinance 15395Ordinance No. ~~~~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND, MUNICIPAL COURT BUILDING SECURITY FUND IN THE AMOUNT OF $374,796.28 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE REIMBURSEMENT OF FY2001-2002 ANNUAL SECURITY COSTS; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in~addition to those amounts allocated to the various City departments for Fiscal Year 2002- 2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Fund in the amount of $374,796.28 from available funds for the purpose of funding the reimbursement of FY2001-2002 annual security costs. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such .other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take efFect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Fund by $374,796.28 from available funds; and - 2. Authorize the City Manager to transfer $374,796.28 from the Municipal Court Building Security Fund to the General Fund. DISCUSSION: The requested appropriation is required to reimburse the General Fund for actual building security expenditures incurred during FY2001-2002: The Texas Legislature, during the 1995 regular legislative session, adopted an amendment to Article 102.017 of the Code of .Criminal Procedure that allows the governing body of a municipality to create, by ordinance, a Municipal Court .Building Security Fund. Defendants convicted in trial for a misdemeanor offense in municipal court are required to pay a $3 security fee as a cost of the court. On October 10, .1995, Ordinance No. 12204 was approved by the City Council to create the .Municipal Court Building Security Fund. The funds collected may only be used for purposes of providing security services for. buildings housing a municipal court. This may include the purchase of parcel X-ray machines, hand-held and walk- through metal detectors, security personnel providing security services, and continuing education on security issues for court and security personnel . On June 20, 2000 (M&C G-12942), the City Council authorized implementation of the Municipal Court Building Security Enhancement Plan.. It authorized a Senior Deputy City Marshal and eight Deputy City Marshal positions dedicated to building security functions. The FY2001-2002. adopted budget for building security operations was $361,664, and the actual salaries and departmental support totaled $365,603.02.
