Subject: REVISION OF CITY-WIDE DISADVANTAGED BUS INESS
ENTERPRIS�POLI�CY ����
On September 26, 1989, the City Council adopted Council Policy
145 (C. P. 145) in order to implement a race-neutral Disadvantaged
Business Enterprise Program due to a recent Supreme Court
decision. As a result of further review by the Department of
Law, it is necessary to revise C. P. 145. The new Council Policy
148 is included on the March 13, 1990 City Council agenda for
action.
BACKGROUND OF REVISIONS
Council Policy 145 included as part of the definition for a
Disadvantaged Business Enterprise (DBE) , a list of presumptive
groups; Black Americans, Hispanic Americans and Women. On the
advice of the Department of Law, Council Policy 148 will exclude
any presumptive groups. This will render the City' s DBE Policy
totally race-neutral and allow any firm meeting the certification
guidelines to participate in the City' s DBE Program.
This policy will be discussed during the Pre-Council Meeting
during March 13, 1990. If additional information is desired it
