HomeMy WebLinkAboutIR 7452 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 7452 To the Mayor and Members of the City Council April 10, 1990 Subject: PUBLIC HEARING TO CONSIDER CMUTAI vIMPROVEMENT PINKS PURSUANT TO WHICH AN IMPACT FEE_M1VY�Bff_ IMPOSED BACKGROUND Senate Bill 336 (codified in chapter 395, Local Government Code) , the enabling legislation which authorizes municipalities to impose impact fees against new development, mandates both procedural and substantive duties on a political subdivision as prerequisites to the adoption of any impact fees . These duties apply to both the adoption of new impact fees and to the replacement of existing impact fees. The statute defines a detailed procedure for adoption of impact fees, including the appointment of an advisory committee, requirements for public notice and provision for public hearings on land use assumptions, a capital improvements plan and the impact fee ordinance. The deadline for complying with State law is June 20, 1990. The foundation for the impact fee program is a set of land use assumptions which are defined in Senate Bill 336 as "a description of the service area and projections of changes in land uses, densities, intensities, and population in the service area over at least a ten-year period. " The land use assumptions in turn serve as the planning basis for the development of a capital improvements plan, which is used to determine a maximum impact fee per service unit . PREVIOUS ACTION On December 5, 1989, the City Council established the Capital Improvements Plan Advisory Committee whose duties include reviewing and assisting the City in adopting the Land Use Assumptions for water and wastewater service areas. On January 23, 1990, the City Council held a public hearing to consider the Land Use Assumptions for water and wastewater service areas. On January 30 , 1990 , the City Council approved a resolution adopting the Water and Wastewater Land Use Assumptions . On February 27 , 1990, the City Council approved a resolution calling for a public hearing to consider the Capital Improvements Plan for water and wastewater facilities and the 001- associated impact fees . -ISSLIED BY THE CITY MANAGER FORT WORTH, TEXAS .......... To the Mayor and Members of the City Council April 70, 7990 C, Subject: PUBLIC HEARING TO CONSIDER CAPITAL IMPROVEMENT PLANS PURSUANT TO WHICH AN IMPACT FEE MAY BE IMPOSED CAPITAL IMPROVEMENTS PLAN The documents (Attachment 1) entitled "Water Capital Improvements Plan and Wastewater Capital Improvements Plan" identify capital projects and their associated costs which serve new development within the respective service area for the planning period from 1990 to 2000 . The plan is based on the Land Use Assumptions which projected population and employment growth in the service area. The Capital Improvements Plan costs and the projected growth in the respective service areas serve as the basis for calculation of the maximum potential impact fee per service unit for the "benefit area" (Fort Worth and its extra-territorial jurisdiction. The Capital Improvements Plan costs are limited to treatment facilities for water and wastewater; neither collection or distribution lines , nor the cost of money are included in the calculation of the impact fee. The Water Capital Improvements Plan includes project costs for the Eagle Mountain Treatment Plant and associated structures, various storage tanks and pump stations, the Northside Satellite Service Center for Field Operations and a portion of the cost of the Water Master Plan. An allocation of the eligible facilities has been determined to coincide with anticipated growth during the ten year planning period. out of a total cost of $64, 935 ,797 estimated for water improvements, the portion of cost attributable to new development during the period is estimated to be $54, 187 , 919. The Wastewater Capital Improvements Plan includes project costs for expansions to Village Creek Treatment Plant , a portion of the construction costs associated with Trinity River Authority Facilities (Central Plant and Denton Creek Treatment Plant) , the Northside Satellite Service Center and a portion of the costs of the Wastewater Master Plan. A similar allocation process to that used in the Water Capital Improvements Plan was developed to determine the costs attributable to providing service for existing development , costs attributable to providing service to new development until 2000 , and costs attributable to new development belong year 2000 . The portion of cost of wastewater capital improvements attributable to new development during the planning period is projected to be $56,135 , 613, out of a total cost of $153,848, 201. 00,10. All meter sizes were converted to determine the number of 3/4" equivalent meters in the respective service areas. The increase in the number of service units represents the anticipated growth within the service area which is calculated by dividing the number of service units by the total eligible capital cost . The number of service units was determined to be 64,616 for water and 43,693 for wastewater, thus resulting in a maximum potential impact fee of $839 and $1,285 respectively. CAPITAL IMPROVEMENTS PLAN ADVISORY COMMITTEE One of the duties of the Advisory Committee is to review the documents as prepared by staff and file written comments to the City Council regarding the plan. The Committee may also provide recommendations on the level of fees to adopt . The Committee has filed its comments as to the accuracy of the documents, but has 00,11- chosen to defer from offering a recommendation at this time as to the level of impact fees. Attachment 2 contains the Committee's report and a summary of their meetings . At the Committee's request, Attachment 3 , was prepared to identify the effects of varying levels of impact fees on water and wastewater revenue requirements. The result of imposing no impact fee is increases in revenue requirements from other sources in each year for which capital projects are planned. A maximum level of impact fee imposed requires an increase in other revenues only for the first two years and the debt is thereafter reduced by the collection of fees. The appropriate Council action on Tuesday' s "Public Hearing" agenda items is to consider public comments, then close the hearing.
