Subject: CONSIDERATION OF ADOPTION OF WATER AND WASTEWATER
IMPACT FEES
Senate Bill 336, impact fee enabling legislation, defines a
detailed procedure which municipalities must follow in order to
adopt water and wastewater impact fees within their jurisdiction.
The statute requires the appointment of an advisory committee and
public notification prior to adoption of land use assumptions, a
capital improvements plan and impact fee ordinance. The deadline
for complying with the State law in June 20, 1990.
The following major activities have taken place in this process:
On December 5, 1989 the City Council established the Capital
Improvements Plan -Advisory Committee whose duties included
reviewing and assisting the City in adopting the Land Use
Assumptions, Capital Improvements Plan and ordinance for water
and wastewater.
On January 23, 1990, the City Council held a public hearing to
consider the Land Use Assumptions for water ' and wastewater
service areas.
On January 30, 1990 , the City Council approved a resolution
adopting the Water and Wastewater Land Use Assumptions.
On March 10, 1990, the City Council held a public hearing to
consider the Capital Improvements Plan for water and wastewater
facilities; the hearing was recessed, reconvened and closed on
May 15, 1990.
On May 15, 1990 , City Council considered an impact fee ordinance
which recommended the assessment of the maximum impact fee
service unit of $839 and $1285 for water and wastewater
respectively and collection at the recommended level of $839 and
$502 for water and wastewater respectively. The ordinance was
deferred to the City Council Water, Sewer and Solid Waste Rates
Committee for review and staff was instructed to meet with
wholesale customers to discuss the access fee/impact fee and its
effect on customer cities.
On May 23, 1990 staff met with the City Council Rate Committee.
Information was provided and the Committee requested that the
Council reconsider the ordinance on June 5, 1990.
On May 30, 1990 , the Access Fee Advisory Committee, which is
OPL comprised of six representatives from the customer cities,
appointed by the Tarrant County Mayor's Association, and three
members of the Fort Worth City Council , met to discuss the access

City Council has thirty days from the close of the final public
hearing to adopt an impact fee ordinance.
