HomeMy WebLinkAboutOrdinance 15399~~~~ Ordinance No. AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AIRPORT CAPITAL GRANT FUND IN THE AMOUNT OF $399,640.95 FROM THE PROCEEDS OF THE SALE OF A PORTION OF THREE SEPARATE TRACTS OF LAND LOCATED AT 1304, 1404,AND 1504 WESTPORT PARKWAY TO THE CITY OF HASLET FOR THE PURPOSE OF FUNDING THE RECONSTRUCTION AND WIDENING OF WESTPORT PARKWAY ALONG THE SOUTHERN BOUNDARY OF FORT WORTH ALLIANCE AIRPORT (DOE 3531); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Airport Capital Grant Fund in the amount of $399,640.95 from the proceeds of the -sale of a portion of three separate tracts of land located at 1304, 1404, and 1504 Westport Parkway to the City of Haslet for the purpose of funding the reconstruction and widening of Westport Parkway along the southern boundary of Fort Worth Alliance Airport (DOE 3531). That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Find that the sales prices being accepted in the amounts of $115,608.00 for 1304 Westport Parkway, $1..19,299.95 for 1404. Westport Parkway, and $164,733.00 for 1504 Westport Parkway are Fair Market Value (FMV) with a just compensation amount to be received totaling $399,640.95; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Airports Grant Fund by $399,640.95 from the proceeds of this sale; and 4. Authorize temporary construction easements (TCE) to the City of Haslet for use during construction of the roadway; and 5. Authorize the acceptance and recording of the appropriate instruments. DISCUSSION: The City of Haslet has requested that the City of Fort Worth sell some frontage of the above listed properties to the City of Haslet for right-of--way in order to reconstruct and widen Westport Parkway along the southern boundary of Fort Worth Alliance Airport and just west of Interstate Highway 35W. The above parcels were acquired by the City of Fort Worth in connection with the Federal Aviation Regulations (FAR) Part 150 Noise Study for Fort Worth Alliance Airport utilizing grant funds for Land - Noise Compatibility. . On July 31, 2001 (M&C. L-13108), the City Council authorized the acceptance of a grant from the Federal Aviation Administration (FAA). The grant allowed the City to acquire fee simple title or other property interests to tracts of land within the 65 LDN (Day-Night Sound Level), as identified in the Fort Worth Alliance Airport Noise Compatibility Program, FAR Part 150 Noise Study. Two of the above parcels, 1304 and 1404 Westport Parkway, were acquired under this grant.. The parcel at 1504 Westport Parkway was acquired in 1989 under an earlier similar grant. The sales proceeds will be returned to the grant funds account and must be reinvested in the noise mitigation program at Fort Worth Alliance Airport. In addition to acquiring the three tracts,' the City of Haslet has requested the temporary use of additional land on each tract to be used by the contractor during construction, after which the TCEs will expire.
