AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF CAPULIN AVENUE, TALTON AVENUE, MORNINGSIDE SRIVE, COLVIN AVENUE, PUMA AVENUE AND PORTIONS OF ALLEYS IN BLOCKS 21, 22, 33 THROUGH 35 AND 47, RYAN SOUTHEAST ADDITION, CITY OF FORT WORTH, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY'THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT PORTIONS OF the 1300 and 1400 Block of Talton Avenue (formally Judd Street), Nlorningside Drive, and Colvin Avenue and a portion of the 2600 to 2800 block of Capulin Avenue and Yuma Avenue ,and 15-foot wide alley portions running through blocks 21, 22, 33, 34, 35, 36 and 47 Ryan Southeast Addition, as recorded in Volume 388, Page 7, Deed Records of Tarrant County, Texas, and containing 318.035 square feet, and as more specifically described in Exhibit "A", attached hereto and incorporated herein, by reference be and the same are vacated and extinguished: SECTION 2. That the fee to the land in the above described street and alley rights-of-way is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. AND ALLEY PORTIONS RUNNING THROUGH BLOCKS 21, 22, 33, 34, 35, 36 AND 47, RYAN SOUTHEAST ADDITION, FORT WORTH, TEXAS (VA-02-084) RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance vacating portions of the 1300 and . 1400 block of Talton Avenue (formerly Judd Street), Morningside Drive, Colvin Avenue, and a portion of the 2600 to 2800 block of Capulin Avenue and Yuma Avenue, and 15-foot wide alley portions running through blocks 21, 22, 33, 34, 35, 36 and 47, Ryan Southeast Addition, as recorded in Volume 388, Page 7, Deed Records, Tarrant County, Texas, and containing 318.035 square feet. DISCUSSION: The Fort Worth .Independent School District, owner of the above-described properties, has requested vacation of the above referenced street and alley portions to consolidate a school site and to replat with adjoining land. Existing improvements include paving, fences/walls, telephone, water, sewer and electric lines. A utility easement shall be retained for existing utilities. The City Plan Commission recommended approval at its public hearing on November 27, 2002. The Engineering Department, Real Property Services Division states that a fee. of $1.00 will satisfy the public interest. The reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS=02-188). This request is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
