HomeMy WebLinkAboutOrdinance 15402Ordinance No. ~~~`~ l AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $698,032.00 AND THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $83,317.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN AWARD OF CONTRACT TO MCCLENDON CONSTRUCTION COMPANY, INC. FOR ALTERNATE "A" FOR THE RECONSTRUCTION OF 28T" STREET NW (SHERMAN AVENUE TO TITUS STREET), 28T" STREET NW (MACIE STREET TO KEARNEY AVENUE) AND 28T" STREET NW (WEST LONG AVENUE TO EPHRIHAM AVENUE) INCLUDING WATER AND SANITARY SEWER MAIN REPLACEMENTS; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the Budget of the City Manager, there shall also be increased estimated. receipts and appropriations in the Water Capital Project Fund in the amount of $698,032.00 and the Sewer Capital Project Fund in the amount of $83,317.00 from available funds for the purpose of funding an award of contract to McClendon Construction Company, Inc. for Alternate "A" for the reconstruction of 28th Street NW (Sherman Avenue to Titus Street), 28th Street NW (Macie Street to Kearney Avenue) and 28th Street NW (West Long Avenue to Ephriham Avenue) including water and sanitary sewer main replacements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining .portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. FOR RECONSTRUCTION OF NW 28TH STREET (SHERMAN .AVENUE TO TITUS STREET), NW 28TH STREET (MACIE STREET TO KEARNEY AVENUE) AND NW 28TH STREET (LONG AVENUE TO EPHRIHAM AVENUE INCLUDING WATER AND SANITARY SEWER LINE REPLACEMENTS RECOMMENDATION: It is recommended that the City Council: 1.- Authorize the transfer of $781,349.00 from the Water, and Sewer Operating Fund to the Water Capital Project Fund in the amount of $698,032.00, and the Sewer Capital Project Fund in the amount of $83,317.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $698,032.00, and the Sewer Capital Project Fund in the amount of $83,317.00 from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc. for Alternate "A" in the amount of $1,223,718.85 for the reconstruction of NW 28th Street (Sherman Avenue to Titus Street), NW 28th Street (Macie Street to Kearney Avenue) and NW 28th Street (Long Avenue to Ephriham Avenue) including water and sanitary sewer main replacements. DISCUSSION: On December 19, 2000, the City Council adopted a resolution authorizing the issuance of $45 million in Certificates of Obligations to address critical capital projects which included $8,000,000.00 in street improvements to supplement the 1998 Capital Improvement Program (CIP) street improvements. The .reconstruction of NW 28tH Street (Sherman Avenue to Titus Street), NW 28th Street (Macie Street to Kearney Avenue) and NW 28th Street (Long Avenue to Ephriham Avenue) are projects included in the 1998 .CIP. The street improvements include 6-inch lime stabilized subgrade and asphalt pavement, construction of standard concrete curb and gutter, and driveway approaches and sidewalks where shown on the plans. In addition to the reconstruction of the identified streets, this contract also includes replacement of 4,138 feet of 8-inch water main, 3,004 feet of 24-inch water main, 1,150 feet of 8-inch sanitary sewer main and appurtenances. The Water Department has determined that the severely deteriorated water and sanitary sewer mains should be replaced with the street reconstruction. ~ . Green Scaping, L.P., did. not complete the bid proposal and was determined. to be non-responsive. After review of all the documents and bid tabulations, staff recommends award of the Alternate "A" contract to.. the second low bidder, McClendon Construction Company, Inc. M/WBE -McClendon Construction Company, Inc. is in compliance with the City's MNVBE Ordinance by committing to 11 % M/WBE participation and documentirig good faith effort. McClendon Construction Company, Inc. identified several subcontracting and supplier opportunities. The M/WBEs contacted in the areas identified did not respond or did not submit the lowest bids.. The City's goal on this combined project is 23%. This project is located in COUNCIL DISTRICT 2, Mapsco 47X and Y, and 61 C and D. In addition to construction costs, a $34,882.00 contingency (water: $31,162.00, sewer: $3,720.00) is required for possible change orders, and $48,834.00 (water: $43,627.00, sewer: $5,207.00) is required for inspection and survey. The contingency for possible change orders for street reconstruction is $25, 000.00.
