TO CITY SECRETARY CONTRACT No. 61306
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, INC,
(ENGINEER) made and entered into City Secretary Contract No. 61306, (the
CONTRACT) which was authorized by M&C 24-0230 on the 19th day of March
2024, in the amount of $ 366,877.00; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Fort Worth Water Gardens, CPN 104751; and
WHEREAS, it has become necessary to execute Amendment No. 01 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $19,118.00. (See Attached Funding Breakdown Sheet, Page
-4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $385,995.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Scope of Services
PROJECT UNDERSTANDING
Freese and Nichols, Inc. (FNI) understands that, the purpose of this proposal is to:
1. Investigate and provide recommendations on the failure of light poles following the incident on
September 25, 2024, when one pole fell, and the subsequent removal of four others due to
observed weakening and instability.
2. FNI will review all previous project documentation and compile a historical timeline of
renovations, detailing improvements and changes made over the years.
This project will be accomplished as Amendment # 1 under the original project, Fort Worth Water
Gardens — Project No. 104751.
BASIC SERVICES
FNI will render professional services for the below scope of work:
A. Project Management
1. Meeting, communication, and coordination
B. Technical Memorandum (for Light Pole Failure Investigation, Recommendations & Report)
1. Provide a technical memorandum including investigations and recommendations.
2. Site visit (occurred September 26, 2024), meet with the city staff, and gather
information and feedback.
C. Timeline Document
1. Review previous renovation projects documents.
2. Provide a timeline document detailing improvements and changes made over the years.
3. Meet with City staff to capture major maintenance and repair work undertaken by the
City to include in the timeline document.
4. The report is approximately five pages long and includes tables, bullet points, and
other relevant content detailing the actions taken and timeline of renovations at the
Water Gardens since 1971.

Water Gardens Assessment — Amendment # 1: Light Pole Failure Investigation and Recommendations
CLARIFICATIONS AND EXCLUSIONS
A. Basic Services shall not include any services or work products by FNI beyond those specifically
described above.
B. CITY shall provide review, coordination, and submittals related to historic resources.
C. This proposal is valid for 90 days.

All deliverables will be electronic version (PDF) only.

PROJECT SCHEDULE
FNI is authorized to commence work upon execution of the agreement and agrees to complete
investigation and report phase services per the following:
A. Technical memorandum: 10/2/2024
B. Timeline document: 10/25/2024
Both documents will be incorporated into the current assessment report.
COMPENSATION
The City shall pay the Consultant a lump sum amount of fee for each task listed below. Consultant shall
not perform any additional services for the City not specified unless the City requests and approves in
writing the additional costs for such services.
